May 10,1940 To the Mayor and South Bend City Council City Hall - South Bend, Indiana Gentlemen: We have been reading in our South Bend paper on various days recently, about a new milk law or Mild Ordinance that has been placed before the City Council of our city for consideration. We as tax payers and citizens of South Bend think this so called Quality Milk Program should be adopted by all We have been told that several hundred cities in the United States have this ordinance. We also think that any improvement for dairy products is a step forward and should be passed without any opposition by the council. We the undersigned do hope this Grade A Law or Ordinance meets with the approval of the entire council for the pro- tection of.our children and ourselves. REPORT TO THE C OT,05ON COUNCIL CITY OF SOUTH BEND, IND. GENTLEMEN: CITY PLAN CO!,,1MISSION May 9, 1940 At a special meeting of the City Plan Commission May 8th the petition of F. L. Alward for change of zoning classifi- cation of Lot +4 Moon's First Addition from B residence and A height and area district to C, commercial use and D height and area district was acted upon. The City Plan Commission approves this change. The appended remonstrance is intended to apply both to this petition and to the petition of Cory A. and Beatrice L. Augustine for change on lots +54 and 55 Augustine's Add. the properties being located on opposite sides of Lincoln Way West between College and Brookfield Streets. D. Moomaw, Secty. Motion THIS ORDINANCE -IS AMENDATORY OF ORDINANCE NUMBERED 2331, ADOPTED BY THE COMMON COUNCIL OF-THE CITY OF SOUTH BEND, INDIANA ON JUNE 2;50 1923, OO1,1MONLY KNOWN AS THE ZONING ORDINANCE. y This ordinance was given first reading by title and second reading in full. Councilman Pulaski made a motion that the ordinance be given public hearing at a special Committee of the Whole meeting on May 27, 1940. Councilman Bishop seconded the motion. Motion carried by a vote of 9 ayes - 0 nays. ORDINANCE A PROPOSED ORDINANCE GOVERNING THE PRODUCTION AND DISTRIBUTION OF GOAT MILK IN THE CITY OF SOUTH BEND, IND. ALL MILK REFERRED TO IN THIS ARTICLE SHALL APPLY ONLY TO GOAT MILK. This ordinance was given first reading by title and second reading in full. Councilman Richardson made a motion that the ordinance be considered at the special Committee of the Whole meeting on May 27. Councilman Pulaski seconded the motion. This ordinance was given first reading by title.and second reading in full. Councilman Niezgodski made a motion to suspend the rules. Councilman Bishop seconded the motion. Motion carried by vote of 9 ayes - 0 nays. The ordinance was given third reading. Councilman Richardson made a motion that the contract be ratified and returned to the Board of Works. Councilman Brannon seconded the motion. Motion passed by roll call vote of 9 ayes - 0 nays, Clyde E. Williams, President of the Board of Works, addressed the Council and advised that certain verbal agree- ments were made by the Northern Indiana Transit, Inc., with the Board of Works, which agreements are set out in a Resolution (copy of which was miven to the Clerk of the Council). Mr. Williams suggested that this Resolution be spread on the records of the Council. RESOLUTION That Whereas, hearings have been held by this Board upon the proposal to enter into a contract between the City of South Bend and Northern Indiana Transit, Inc., which contract is intended to carry out the purpose of the City to obtain the substitution of motor busses for street cars, and during said hearings said corporation has agreed to make certain rates independent of said contract; that it will before June 15, 1940 file a schedule of rates with the Public Service Uommission whereby it agrees to carry school children of the public and parochial schools of said City during school hours and on school days at a .rate of five cents, and that it will sell to all riders seven tokens (giving the right to seven rides) for fifty cents. Therefore,.thzs Board finds that with said understanding said contract as published in the South Bend Tribune and The Mirror Press should be executed by the City, and it is so ordered, and this Board further recommends that said corporation should be permitted to operate upon the rates stated in said contract and upon the above rates a reason- able time without the same being questioned. Motion carried by a vote of 9 ayes - 0 nays. Councilman Heideman requested that the anti -noise ordinance be given consideration. Councilman Jordan stated that he has had several citizens suggest to him that the lampposts in the central part of the city should be more ornamental and decorative. Therefore, Councilman Jordan made a motion that the Streets & Alleirs Committee be instructed to contact the Indiana and Michigan Electric Company in regard to the matter.
