HomeMy WebLinkAbout04-22-40 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend met in regular session, Monday, April 22, 1940, at 7:34 P.M. in the Council Chambers, City Hall, with President McCarthy presiding. Councilman Richardson was absent. The minutes of the previous meeting were accepted without a reading. REPORT OF THE C%P5ITTEE 'OF THE WHOLE (Amended report of Streets & Alleys Committee) To the Common Council of the City of South Bend, Indiana: It is the recommendation of the Streets & Alleys Committee that the Ordinance governing the obstruction of public property be rigidly enforced where it interferes with public health and convenience, and that the Board of Safety be so instructed. REPORT OF THE COMMITTEE OF THE WHOLE N - (Referring to "An ordinance amending sections 1, 2, 3, 4, 17 of an ordinance numbered 2682, being an ordinance re lating the production,grading, labeling, handling, pasteurization, distribution, and sale of milk, cream and cert milk products and providing for issuing permits and licenses therefor -) This ordinance was given consideration in the Committee of the.Vdhole meeting on April 15, 1940. Councilman Niezgodski made a motion to hold.the ordinance in the Committee of the Nihole•. Councilman Richardson seconded the motion. Councilman McCarthy suggested that the motion be withheld until action was taken on ordinance setting up new milk code. Councilman Niezgodski withdrew his motion. This report of the status of this ordinance was given the council. Councilman Pulaski made a motion that the repo be accepted. Councilman Brannon seconded the motion. Motion carried by a vote of 8 ayes - 0 nays - 1 absent. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred an ordinance defining "milk" and certain "milk products ", "milk producer ", "pasteurization ", etc., prohibiting the sale of adulterated and misbranded milk and milk products, re- quiring permits for the sale of milk and milk products, regulating the inspection of dairy farms and milk plants, the examination grading, labeling, placarding, pasteurization, regrading, distribution, and sale of milk and milk products, providing for the publishing of milk grades, the construction of future dairies and milk plants, provid- ing for the licensing of dairies - retail and wholesale distributors, the enforcement of this ordinance and the fi ing of penalties. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be kept in Committee of the Whole for further consideration. Councilman Hull made,a motion to accept the report. Councilman Pulaski seconded the motion. Motion carried 8 ayes 0 nays - 1 absent. RESOLUTION BE IT RESOLVED by the Common Council of the City of South Bend, that in view of the many statements in the press, radio and elsewhere, concerning the acceptance of a report submitted by the Streets and Alleys Committee of the Cit Council, pertaining to the investigation -of parking meters, that the Council considers it advisable to present in the form of this Resolution a statement to the public, and to record on the Minutes of the Council, their position on this subject. The Council considers it their duty to give due consideration to any and all subjects submitted to them by groups of citizens who are sincerely interested in the welfare of the City of South Bend, and the idea of considering park- ing meters by the City Council was advanced by certain groups and persons who are sincerely interested in continu- ing the safety record of the City last year, both by the municipal city and by voluntary groups of industrial and business establishments through the Safety Division of the Association of Commerce. At a joint meeting of the City Traffic Committee, a Committee from the Safety Division, the Streets and Alleys Committee of the City Council, and other persons interested in the safety program of the city, it was suggested that the parking meters be considered as a means of raising the necessary revenue for the city to continue its safety program, for the purchase of safety supplies and equipment, such as - "no parking" signs, "stop"-signs, speed warnings, labor and materials in marking off safety zones, installing "stop" and "go" signals where needed, adop- tion of uniform "stop" and "go" signals, equipment for making safety surveys and other miscellaneous expense inci- dental to continuing and improving the City's -program for the safety of the public. The City Council approved an amount of $11,245.00 for this work which was set up in the budget for the year of 1940, but it is recalled that through the pressure of a self- appointed and 'self- styled tax - payers' protective group, the St. Joseph County Board of Tax Adjustment was prevailed upon to eliminate this entire amount set up for the City's safety program, and in view of the f act that budgets were curtailed as much as possible from the other city depart- ments, there are now no funds available for the continuance of the City Traffic Committee's safety program. ?Nhile there are a number of citizens interested in the installation of parking meters, both to procure revenue for the continuance of safety work and to improve parking conditions in our business district, the Council feels, after due deliberation, that, by far, the majority of the citizens and tax - payers of South Bend are opposed to giving parking meters a trial and the Council therefore resolves that the proposed ordinance, when introduced, be tabled. Councilman Jordan made a motion to accept but not read all other communications pertaining to the Parking Meter subject. Councilman Pulaski seconded the motion. ?lotion carried.
