Motion carried by vote of 7 ayes - 2 nays (McCarthy and Niezgodski) REPORT OF CLAIMS COM1 IITTEE TO THE MEMBERS OF THE COMMON COUNCIL: March 16, 1940 In accordance with instructions given the Claims Committee at the regular meeting of the Common Council of the Ci of South Bend on March 11, your Claims Committee has investigated the alleged charge of the Indiana & Michigan Electric Company against the City of South Bend, for an unpaid bill they claim due for electric power and light furnished in the years of 1932, 1933 and 1934. We find that the balance of appropriation brought forward from 1933, as authorized by the State Board of Accounts, was X93,770.56, and the regular appropriation for the year 1934 was $95,000.00, making a total of $188,770.56. The amount of appropriation and the balance was entirely paid out on December 20, 1934, and the amount claimed was beyond the monies appropriated for that particular use. Your Committee was reliably informed that under existing laws the Controller has no legal authority to pay out the monies claimed unless authorized to do so by court mandate. It is the opinion of your Committee that while a certain measure of responsibility should be placed upon the Board of Public Works in office at the time the appropriation was exhausted, that a larger portion of the responsibility rests with the Indiana & Michigan Electric Company, who knowingly furnished more power and light than what was appropriated for in the budget for that year, and that the City Attorney be instructed to use every effort within his legal control to procure a verdict in favor of the city, as, in our judgment, this is not a just claim. REPORT OF, THE COP.MITTEE OF THE WHOLE To the Common Council of the City of South Bend: 3/18/40 Your Committee of the Whole to whom was referred an ordinance amending sections 1,2,3,4,17 of an ordinance numbere 2682, being an ordinance regulating the production, grading, labeling, handling, pasteurization, districuuion, and sale of milk, cream and certain milk products and providing for issuing permits and licenses therefor Respectfully report that they have examined the matter and that in their opinion this ordinance shall be held in t Committee of the Whole for further consideration. LEO M. JORDAN, Chairman Councilman Hull made a motion to accept the report. Councilman Pulaski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South. Bend: Your Committee of the Whole to whom was referred a Proposed Milk Ordinance for the City of _South Bend, Indiana, "An ordinance defining "milk's and certain "milk products ", "milk producer ", "pasteurization', etc. prohibiting the sale of adulterated and misbranded milk and milk products, requiring permits.for the sale of milk and milk products, regulating the inspection of dairy farms and milk plants, the.examination, grading, labeling, placard ing, pasteurization, regrading, distribution, and sale of milk and milk products, providing for the publishing of milk grades, the construction of future dairies and milk plants, providing for the licensing of dairies - retail and wholesale distributors, the enforcement of this ordinance, and the fixing of penalties." Respectfully report that they have examined the matter and that in their opinion this ordinance shall be held in the Committee of the Whole for further consideration. LEO M. Councilman Bishop made a motion that the ordinance pertaining to the public display of foodstuffs be enforced. Councilman Richardson seconded the motion.
