Council Chambers, City Hall, Monday, September 25, 1939, at 7 :30 P.M. Councilmen Pulaski and
Richardson were absent. President McCarthy presided. It was agreed to dispense with the read-
ing of the minutes of the previous meeting.
COMMUNICATION
To whom it may concern:
We are informed that the Board of Public Safety contemplates retiring ten veteran policemen. Do
you realize what this means to the city, namely, that according to the last ruling of the legis-
lature, councils of cities are compelled to appropriate funds to the pension fund whenever there
is a deficiency in such pension fund to meet the pensions. At the present time this is not
necessary, but with an additional ten pensioners, the fund will become exhausted and it will
then become the duty of the Secretary to the Pension fund to appeal to the council for such
sums as are needed to meet pensions which will become a burden on taxpayers.
Inasmuch as these men are all ablebodied mien and are willing to continue on the force, we deem
it very inadvisable to force their retirement.
Furthermore, the pension board is not compelled to accept policemen under twenty -five years of
service unless they resign voluntarily.
Not only will these additional pensions have to be met but the salaries of ten additional
policemen.

Councilman Nie;zgodski- made a motion to refer the petition to the Board of Public Works. The
motion was seconded by Councilman Bishop. Motion carried.
COMMITTEE OF THE WHOLE REPORT
To the Common Council of the City of South Bend:
Your Committee of the Whole to whom was referred an ordinance approving the contract for the
collection and disposal of garbage entered. into between. the Board of Public Works and Safety
of-the City ,o.f,South Bend., and Victor W. DeFreese.
Respectfully report that they have examined the matter and that in their, opinion the ordinance
shall be approved.

man Hull made a motion for suspension of rules. -Councilman Brannon seconded the motion.
Motion carried 7 ayes - 0 nays - 2 absent. The ordinance was given third reading by title.
Councilman Hull made a motion for the adoption of the ordinance. Councilman Niezgodski seconded
the motion. Ordinance passed by a vote. of 7 ayes - o nays - 2 absent.

Councilman Niezgodski made a motion to adjourn. Councilman. Brannon seconded the motion. Counci
adjourned at 8 :00 P.M.
