A11 members were present. President McCarthy -presided. The reading of the minutes wa&,et dispensed with on the motion of Vice President Hull and seconded by Councilman Jordan. ?aotion cerried. City Attorney Beamer introduced City Controller Hzrry Dxiggs and City Engineer Clyde Williams to the members of the Council. ORDINANCE 3271 AN ORnIIvAXCE A *RFT?DING ORDINANCE X3112, WHTCH PROVIDED FOR THE OF BICYCLES. This ordinance was read by the Clerk by title. The or-dinnnce previous council. Vice President Hull motioned that this ord anee committee to draft another ordinance to cover the points seconded the motion. Motion carried. ORDINANCE 3237 AN ORDINANCE REGULATING AND LICENSING THE SELLING OF FOOD. REGISTRATION AND IDENTIFICATION hcd been carried. over from the inpnce be referred to the ordin- involved. Councilmen Niezgodski This ordinance was referred by the previous council. Vice President Hull addressed the meet- ing and suggested that while the ordinance is commendable, the present man -power of the Boerd of Health makes it unworkable. Vice President Hull made a motion that the ordinance•be re- ferred to the Ordinance Committee to7work out with the Board of Health. Motion secended by Councilman Bishop. Motion. carried. RESOLUTION: A RESOLUTION ALLOCATING THE SUM OF THIRTY THOUSAND DOLLARS ($30,000.00) FROM THE AMOUNT APPROPRIATED FROM WPA AND PWA IN THE 1.939 BUDGET UNDER ACCOUNT NO. H -27, DEPARTIENT OF PUBLIC WORKS TO THE SPECIAL WPA FUND, SUCH ALLOCATION BEING FUNDS TO BE RECEIVED FROM THE AUDITOR OF ST.•JOSEPH COUNTY UNDER ORDER OF THE PORTAGE TOWNSHIP FOR FUNDS TO BE SUPPLIED TO ASSIST THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, IN THE SPONSORING.OF PROJECTS, PURSUANT TO AN AGREEP:.�ENT TO BE FILED WITH THIS BODY, AND ENTERED INTO AND BETWEEN THE BOARD OF PUBLIC i?VORKS AND SAFETY, AND THE PORTAGE TOWNSHIP TRUSTEE. Be it resolved that the sum of Thirty Thousand Dollars ($30,000,00) be and the same is hereby allocated from the -mount a -ppropripted under account No. H -27, Department of Public Forks to the Fund known as The Special WPA Fund. It is expressly stipulated that only such Funds for this allocution are subject to and limitedin the amount of monies received by the City Con- troller of the City of South Bend, from the Auditor of St. Joseph County, by virtue of Funds paid for the employment of men taken from the relief rolls of Portage Township, St. Joseph County, Indiana, which funds are to be provided on order of the portage Township Trustee directed to the Auditor of St. Joseph County In conformity with a written agreement, to be entered Into between the Trustee of Portage Township and the Board of Public Works and Safety of the City of South Bend, Indiana. It is expressly agreed and stipulated that the amount set forth is thp, estimated emount to be received for four months from the 1st day of January, and the purchese of materiels, equipment, truck hire, and other supplies necessary to be furnished as the -,ponsor's share of various City Projects. In contemplPtion of the terms of said agreement it shall be in line with the amount of money so received by the Controller of the City of South Bend from the Auditor of St. Joseph County in accordance with the teams of agreement referred to above. William F. Pulaski Member of Common Council Vice President Hull moved that the Resolution be adopted. Councilman Richardson seconded the motion. Councilman Heideman made inquiry Ps to whether the Council should adopt the resolution before an agreement is made with the Trustee. City Attorney Beamer explained thet the Trustee, Mr. Langel, had contacted the city officir-is that dry regarding an agreement for truck hire. Mr. Driggs mentioned that the contract is practically r continuation of the contract which expired December 31, 1930. Motion for adoption of resolution carried. RESOLUTION: RESOLUTION ALLOCATING THE S:JM OF TEN THOUSAND ($10,000.00) FROM THE AMOUNT APPROPRIATED FOR WPA AND PWA IN THE 1939 BUDGET UNDER ACCOUNT NO. H -27, DEPARTMENT OF PUBLIC WORKS TO ACCOUNT NO. 1 -101 WPA. MATERIAL OF THE STREET DEPARTMENT. BE IT RESOLVED by the Common Council of the City of South Bend, Indiane: That the sum of Ten Thousand Dollars ($10,000.00) be and the same is hereby allocated from account No. H -27 Department of Public Works to the 1939 Budget to .Account No. 1 -10, WPA Materit =1 recount in the Street Department, and that this amount so allocated by the Common Council may be used during the year 1939, for the purchase of materials, labor and other items chargeable to the various City WPA projects by the Street Department, subject to the approval of the Board of Works. The amount so allocated shell be deducted from the amount of One Hundred Seventy -Five Thousand Dollars ($175,000.00), appropriated in the 1939 Budget under account H -27, Department of Public Works. William F. Pulaski Member of the Common Council Councilmen Pulaski moved for the adoption of the Resolution. Councilman Bishop seconded the motion. Motion carried. 102 RESOLUTION: RESOLUTION concerning the depth of the Honorpble J. W. McInerny WHEREAS, the Common Council of the City of South Bend, Indipnp, has learned of the recent depth of J. W. McInerny, Juvenile Referee, Pnd WHEREAS, J. W. McInerny vrps a hivhly iesnected citizen of the community of South Bend, Indian end p conscientious and efficient -public officisl of St. Joseph County, and WHEREokS, he has given of his time ?nd energy to the improvement of this community for mrny years past and his depth will be s serious loss to the City of South Bend and St.. Joseph County, and WHEREAS, The Common Council of the City of South Bend pnd the citizens of this City deeply regret his ppesing, THEREFORE, be it resolved, that the Common Council of the City of South Bend, on behalf of the City and its citizens, extend to Mrs. McInerny, the rife of J. W. McInerny, and his children, who survive him, their deepest regrets ^nd sincerest sympathy, and. BE IT FURTHER RESOLVED, that p copy of this resolution be delivered by the Clerk to Mrs. Mc- Inerny and a copy be sprerd on the records of the Common Council of the City of South Bend, Indiana. Resolution wps reed by Councilmpn Pulpski who motioned thf.t the resolution, be approved. Councilmpn Richprdson seconded the motion. Motion carried. Mr. Harry Lewis requested that Ordinance 3245, which had been tabled by the previous Council body, be reconsidered by present council. Vice President Hull. moved to Adjourn. Adjourned at 5 :05 P.M.
