to whom was referred An Ordinance appropriating the sum of One Thousand One Hundred and
Sixty -Five Dollars ($1,165.00) to the various accounts of the Park Board from monies already
a propriated to account no. 321, fuel & oil, of which amount One Thousand Two Hundred Dolle,rs
0,, 200.00) will_.not be needed during balance of the year 1938.
Respectfully report that they have examined the matter and that in their opinion should be
reported favorable. Geo. W. Goetz, Chairman.

The Honorable Common Council:
Your resolution requesting the Board of Public Works and Safety to file an application for
R WPA grant for river crossovers, pumping stetion and sewege,disposel plant was presented
to the Board of Public Works end Safety at their me6tings this morning.
After discussing this matter thoroughly, it was regularly moved, seconded and carried that
this Board refer back the above named resolution as introduced by Mr. W. S. James for further
consideration by the Common Council, in line with the communication received from-.Harry B.
Roach, acting Director of the WPA, addressed to the Mayor end supplemented by a. communica.tion
:from Raymond L. Pike, Director of the Division of Operations to Mr. Harry. Roach, which
are attached hereto end which sets forth additional requirements necessary.before the applictL-
tion for a WPA grant can be properly filed.

Dear Sir:
In order to bring to your attention the situation as pertains to the possible starting of
work on the project covering the construction of the South Bend interceptor sewers, I am
submitting a copy of a letter which I have received from Mr. Raymond L. Pike, Director of the
Division of Operations in Indianapolis, T111-s letter, of course, is self-explanatory end will
bring out clearly the points necessary to be complied with before work can be started.

Construction of Intercepting Sewers
South Bend, St. Joseph County
Dear Sir:
In reply to your letter of November 25th, we regret very much that the city of South Bend's
Common Council rejected the PWA grant for construction of the sewage treatment plant and
river crossings.
Relative to placing this project in operation in the near future, we will be unable to author-
ize such action unless the following provisions are made by the sponsor:
(1) A resolution shall be passed by the South Bend Common Council authorizing the
construction of the river crossings by private contract an'd making available
immediately the necessary funds for such river crossing construction.
(2) Sponsor's funds pledged as their shere of the :cost of this project shall be made
available prior to the placing of this project in operation)
(3) A supplementary project application shall be prepared covering the construction of
the sewage treatment plant and such application shall be approved by a resolution
of the South Bend Common Council, which resolution shall also provide authoriza-
tion for the financing of the Sponsor's cost,of construction. This application
must receive the approval of the State Administrator.
The supplementary project application should include the cost of the river crossings as well
as the treatment plant, as the sponsor is entitled to full credit for the cost of such crossings
The submission of a supplementary application will necessitate a slight change in the President-
ial letter description whib# will be accomplished by this office. The use of this method of
obtaining the necessary funds for the construction of the river crossings and treatment plant
will enable you to operate the entire project under one officisl and work project number.
Upon receipt-of your initial WPA Form 701 -R, accompanied by proper evidence of compliance rith
the above enumereted conditions, authorization will be granted to place this project in
operation.

The rate you incorporated et-the request of taxicab operators into the City Ordinance was
disapproved of by the members of the drivers union. They are most vitally concerned and in
order to maintain our amiable relationships we have agreed upon a rate which we, the under -
signed, hereby petition that you place into effect by amending the ordinance in question to
read as follows:
MAXIMUM RATE -
25¢ for first mile or fraction thereof and 50 „for each succeeding J mile.
MINIMUM RATE -
25¢ for first mile or frection thereof end 5¢ for each succeeding J mile.

RIVER PARK POST 303, THE AMERICAN LEGION, IN

RESOLUTIONS PERTAINING TO AN ORDINANCE GOVERNING THE REGISTRATION, OPERATION AND LICENSING
OF BICYCLES IN THE CITY OF SOUTH BEND-, STATE OF INDIANA.
WHEREAS: The American Legion is a patriotic organization striving for the welfare of the
community, State and nation.
AND WHEREAS,: The - Legion- safety program is-one of our most important objectives.
AND WHEREAS: There are some seven thousend (7000) bicycles in operation in the City of South
Bend. _
AND WHEREAS: Of these seven thousand (7,000) bicycles only about fourteen hundred (1,400)
are now registered in the city of South Bend.
AND WHEREAS: The present city ordinance pertaining to bicycles is outmoded and inadequate.
AND WHEREAS: The Parent Teachers Association of the city of South Bend have been endeavoring f
some time to secure the passage of an ordinance to remedy the above situation.
BE IT THEREFORE RESOLVED:
That RIVER PARK POST NO. 303 AMERICAN LEGION INC. go on record as favoring the
proposed ordinance being sponsored by the parent teachers association, pertaining
to the licensing of the regulating of the operation of bicycles in the city of
South Bend.
THAT: There be a_ Juvenile.Court composed of pupils enrolled in the various schools, crested
and set-Tip for the enforeements and for instruction of the school pupils of the above
proposed ordin ence.
BE IT FURTHER RESOLVED;
THAT: A copy of these resolutions be sent to the following; the Mayor of the City of South
Bend; President of the Common Council of the city of.South Bend; City Attorney of the
City of South Bend; Chief of Police of the city of South Bend; President of the Parent
Teachers Association, end to the Commander of each American Legion post in the city of
South Bend'.

REGULAR MEETING.

Petition for change of zoning classification of Lots #492 50 and 51 in Baker and McHenry's
addition from "B" residence and "A" height and area districts to "D" light industrial use distrii
was acted upon by the City Plan Commission at their meeting Dec. 1.
The City Plan Commission approves this change and further recommends that the height and
area district be changed to "E" height and area district to correspond to the change of use
district.

Chambers moved for suspension of rules. Councilman Goetz seconded the motion. Roll call

RESOLUTION:
BE IT RESOLVED BY THE COMMON COUNCIL of the City of South Bend, State-of Indiana, that the
City Controller<of said City is hereby authorized end, directed to pay on the 20th day of
December, 1939, all monthly salaries of officials and employees of ssid,city, becoming due
for the month of December, 1939.
