M. All members were present except Councilmen Rasmussen, Kerner and James. President Hull presided. Honorable Sirs: Sept. 11th, 1939 Enclosed copies of resolution adopted by the Legislature of the State of Indiana, also by the last session of United States Congress, proclaiming October 11th; 1938 as Generel Pulaski's . Memoriel nay, therefore it would be appropriate in compliance of same to have the Common Council of the city of 6outh Bend, Indiana_, adopt a similar resolution end desigaete OCTOBER 11th, 1939 as GENERAL PULASKI'S MEMORIAL DAY in the City of South Bend, Indian6, eeking and in- viting the people of south Bend to observe the day in schools and churches, or other suitable places, with eppropriate ceremonies in commemoration of the death of General Casimir Pulaski, the Hero of the Revolutionary War. PETITIOY: TO THE COMMON COUNCIL - CITY OF SOUTH BEND, IND. The undersigned residents in the City of South Bend, and'more particularly within the immediete vicinity of the Fellow Street Bus Line, respectfully petition the Honoarble Body to take such steps as may be e.dvisable and necessary to maintain the operation of the bus line on Fellow Street daily every 20 minutes and every 30 minutes all day on Sunday and holidays and to prevent any elimination. . We also request that the Sunday service on said bus line be extended from 9 A.M. to 9 P.V., Instead of the present service which is limited from 9 A.M. to 12 noon. (188 signers) Councilmen Goetz moved.that seid petition be referred to the Boerd of Works and thst they take immediate steps to rectify same. Councilman Bierwagen seconded the motion. ORDINANCE -NO. 32 9 An Ordinance epproprin.ting the sum of Forty Thousand Dollars ($40,000.00) from the funds to be received from the Auditor of St. Joseph County under order of the Portage Township Trustee for funds to be supplied to assist the Municipal City of South Bend in the sponsoring of projects pursuant to an agreement filed with this body entered into by and between the Board of Public Works and Safety and the Portage Township Trustee and to be a. fund known as the Special W.P.A. Fund. The Ordinance was given its first reeding by title, its second reading in full. Councilman Chembers moved that slid Ordinance be referred to the Committee of the Whole and public hear- ing Qn September 26th. Councilmen Bierwagen seconded the motion. Motion carried. 0RDI1,ANCE NO. 3260 An Ordinance appropriating the sum of Six Thousand Dollars ($6,000.00) from the funds to be received from the Auditor of St. Joseph County under order of the Porta.�e Township Trustee for funds to be supplied to assist the Municipal City of South Bend in the sponsoring of pro- jects pursuant to en agreement filed with this body entered into by and between`the department of Public Parks end the Portage Township Trustee and to be a Fund known as Account #712A. The Ordinance was given its first reading by title, its second reading in full. Councilmen Chambers moved that said ordinance be r eferred to the Committee of the Whole and public hear- ing on September 26th. Councilman Palicki seconded the motion. Motion carried, RESOLUTION: RESOLUTION OF THE BOARD OF PARK COMMISSIONERS APPROVING THE ACTION OF THE OFFICIALS OF SAID PARK BOARD IN ENTERING INTO A CERTAIN CONTRACT WITH ALEX LANGEL, PORTAGE TOWNSHIP TRUSTEE, FOR THE JOINT SPONSORSHIP OF CERTAIN PROJECTS UNDER DATE OF AUGUST 5th, 1938) A COPY OF WHICH CONTRACT IS FTLED WITH THE MINUTES OF THIS BOARD. BE 'IT RESOLVED by the Board of Park Commissioners of the Municipal City of South Bend, Indiana: That said Park Board. does now officially concur in the action of the President and Secretary of said Park Board in entering into a certain written contract with the Trustee of Portage Township, Alex La.ngel, under date of August 5th, 1938, for the joint sponsorship of certain projects in the furnishing of materials on the part of the Park Board, and the furnishing of money by the Trustee, and the furnishing of men by the Trustee, all as set forth in said con- tract above referred to be in all things retified and confirmed by this body, and that the said President and Secretary of said Park Board be authorized and directed to sign said instruments above referred to for and on behalf of said Board of Perk Commissioners. Langel, as Portage Township trustee end overseer of the poor, for and on behelf of Portage Township, St. Joseph County, Indiana, for-the employment of men upon certain projects now filed with the Works P40gress Administretion for certain described improvements jointly beneficial to the Municipal City of South Bend, Indiana., especially its -pa.rks, and Port- age Township, St. Joseph County, Indiena. This agreement entered into this 9th day of august, 1938, by and between the Board of Park Commissioners of the Municipal City of South Bend., Indian. and hereinafter referred to as party of the first.pprt, end Portage Township, St. Joseph County, Indiana by Alex S. Langel, trustee of said Portage Township, St. Joseph County, India =na, end hereinafter referred to as party of the second part. _ NITNESSETH That, whereas, party of the first pert, is now the sponsors of projects filed with the Works Progress Administration and by them approved, which projects has been consolidated into one project known as the City-wide Parks Project, No. 1638, for the improvement of the following parks: pottawatomi, Howard, Studebaker, Leeper, North Park, Pinhook, Erskine, Rum Village and La.Salle, which projects contemplate the building of an administration building at Leepter Part; establishment of a play field at Rum Village; Completion of contraction and grede at Pinhook Park; building rain shelters at Erskine Park; constructing winter quarters for nnimhls at Pottewatomi Park; building log cabin and general lendsceping at North Park; building river wall and general landscaping at LrSalle Pa.rkJ and fill in the creek end enlarge the play field at Studebaker Park; in all manners and mtthdds aPProfed by the Board of park Commissioners of the Municipel City of-6outh Bend, Indiann, and the Federal Government. And Whereas, said projects are of such e large ebnrecter that they can be made to furnish employment' for a large number cf citizens of South Bend, and Portage Township, provided funds are available to pay the sponsor's Share ofsdP form �elt nequipment ne essnry to induce, the orks Pr og ��GAdministrPtion toprovde for thepaymentof pay roalsAnd Whereas, the said party of the first part is unable to pay the e.mount necessary to provide for the employment of sufficient men to, properly carry out the terms of se-id projects. And Whereas, it is found expedient end desirable to contract with party lbf the second pa.rt`f.or the purpose of obtaining men to work upon'said projects. Whereas second party is to pa.y the sponsor a consideration hereinafter set forth for each man so employed upon said projects end for the further purpose that said party of the second part may find employment for P., large number of people now on direct relief in Portage Township. And Whereas Party of the second pert is charged by statute with administering needs of the poor';of' Portage Township and find employment in the most reasonable manner possible. And Whereas, now second party has on direct relief in said Portage Township at least Three Hundred (300)- employable men that could be transferred and put upon the above mentioned projects, And Whereas it is the desire of both parties of this egreement that the respective obligations of each party shell be strickly set forth. It is mutually agreed: 1. That party of the second part shell become P. contributor to the sponsor's share and in consideration of said party of the second part becoming a contributor of the sponsor's share of said projectg party of the first pert agrees and stipulates that said first party shell: • A. Furnish the necessary engineering, architectural, supervision and the necessary information to ley out the particular work seid employees would be put on said. project. B. To furnish the equipment, tools a.nd machinery now owned by the party of the first part and necessary to the carrying out of the details of said project. C. To furnish on this project above described materials to the amcant of the balance epproprinted in the 1938 budget of said party of the first past for Works Progress Administra:ti -oi projects. Party of the second pert on his part agrees that in consideration of the employment of such men as he may certify to seid projects from relief-rolls of the seid Township tht;.t he will furnish. moneys for the purchase of materials, tools, equipment and enything else necessary to rrovide the sponsor's Share of said Projects in an amount equivalent to Six. Dollars and seventy -five cents ($6.75) per month per men, so certified.by him and employed on said Projects in the pro- jects above set forth. It is mutually agreed that the emount of moneys for materials, equipment, tools and other suppli to be furnished by party of the second part shell be limited to end in direct line with the number of emplcynbles furnished to said projects end used thereon by authority of party of the �s second. pert at the rate specified Pbove. 63 It is awreed that monthly audit of employebles shall be made under direction of first party and thrt money due said-first party by readon of the amount shown in said audit when verified by second party shall be due end payable on the 10th of the month following the submission of the verified statement-to the said second party. It is expressly a reed that this contract for and on behalf of the Board of Park Commissioners of the Municipel My of south Bend shall be subject to and dependent upon the ratification by the proper resolution Pdopted by said Board and by the Advisory Board of Portage Township St. Joseph County, Indiana.. It is expressly agreed by end between the respective parties of this agreement that the terra of this agreement shell be limited to the period of time between the dpte of the d.igning of this instrument end December 31, 1938. This agreement is executed by and between the parties hereto this 9th day of August, 1938-.
