M. All members were present. President Fish presided. Council :greed to dispense with the reading of the minutes for the last meeting. CERTIFICATION OF POSTING NOTICE TO TAXPAYERS In the Matter Determining Additional Appropriations for extra funds for the rurchase of four new tires for the flusher of the Street Department; also for the employment of special judges for the balance of the year 1937. REPORT OF THE COMMITTEE OF THE WHOLE #3211 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred An Ordinance appropriating the sum of Three Hundred Sixty Dollars ($360.00) to account I -7, the same being the account for Tires BmA Tubes for the Street Department, for the purchase of four (4) new tires for the flusher of the Street Department. Respectfully report that they have examined the matter and that in their opinion should be re- ported favorable. Geo. W. Goetz, cheirman. A petition hevino been filed bti the proper .legal officials of-the City of South Bend St. Joseph County, Indiana, in the matter of additional appropriations in the amount of 41,750.00. and; This matter having been set for hearing on June 2nd, 1937, at 10:00 A.M., report having been made, and all the facts having been carefully considered, this board does now affirm said additional appropriations in an amount not to exceed the sum of 01,000.00, from the General Fund of the City of South Bend to the Electrical Depertrr;ent, for the installation of new -traf- fic lights on North Michigan st Angella and North Shore Drive. The sum of $750.00 for salaries for vacations of Electriopl.employees, is hereby denied. CITY OF SOUTH BEND, INDIANA OFFICE OF THE MAYOR May 12, 1937 Members of the Common Council, City of Scu th Bend, South Bend, IndlAne. Gentlemen: Your honorable body has referred to me a communication from the City of Cleveland in regard to the Unit -ed States Housing Act of 1937. I have a copy of this Act, S 1655, entitled "A Bill to provide financial•Pssista.nce to the States and political subdivisions thereof for the elimination of unsafe and insanitary housing conditions, for the provision of decent, safe, and sanitary dwellings for families of low in- come, and for the reduction of unemployment and the stimulation of business activity, to create a. United States Housing Authority, and for other purposes." I have studied this Bill and find it would be of greet benefit to the City of South Bend, if enacted into law. I therefore recommend that your honorable body adopt a. resolution in support of this measure and send copies of same to the Honorable Frederick Van Nuys, Honorable Sherman Minton, and Honorable Samuel B. Councilmen Goetz moved to emend Councilman Chambers motion, that ssid letter be held up for two weeks and a committee of three be appointed to investigate this law and report back to the Council. PETITIONS: TO: THE HONORABLE COYMON COUNCIL OF THE CITY OF SOUTH BEND AND MEMBERS: OF THE SOUTH BEND CITY PLANNING CONIAISSION. GENTLEMEN: As-owner of Lots 99 to 96, both inclusive, in Lincoln Manor Second. Addition to the City of South Bend I desire a shame of cla.ssific ^tion of these lots from B residential district and A Height and area district to C Commercial District end D Height and area. district. It is,the intention-of the undersigned to build on said lots, which are loceted•on West - moor on the corner of Westmoor and Goodlpnd Streets in the City of South Bend., a restaurant building. This property is within four ( 4) blocks of the Bendix Bra-ke Corporation and is a territory little used for residential purposes. The lots are all. vacant at present, and I in- tend to construct on said property a modern storeroom and to operate a, restaurant business there in. This territory is now being built up ns commercial and industrial property and has very little use es residential property. It is the belief of the undersigned that there will be no objection from any of the adjoin- ing property owners to such.change of use by your honorable bodies. Mrs. Anne. P E T I T I O N To the Member of the Common Council of the City of South Bend: We, the people end property owners bordering on Elmer Street and Huey Street between Olive end Johnson, anal between Rorrers and Fredrickson Streets, do vigorously protest against any and all dumping of garbage, tin/ cans, trash and all dump upon Elmer and 4uey Streets. This terrible nuisance is infested with rats and mice and is endangering the lives of the community, devaluing surrounding proper•tL, endangering the lives and. health of children who play along this misused area-. We therefore petition the City Council, Police Department, the Board of Health and the property owners of these vacant lots to take immedi .te action and place warning sign end clean up this commons from any and all dump so conspecuous and obnoxious. We insist this petition be acted upon.immediately. (32 signers) Councilman Goetz moved that said petition be referred to the Board of Safety. Councilman Kerner seconded the motion. ?!:otion cp.rried. ORDINANCE NO. 23 16 An Ordinance fixing the salaries for the various officials of the Civil City of South Bend, Indiana, for the period commencing January 1, 1938, to December 31, 193,, both inclusive. The Ordinance was given its first reading by title, its second reading in full and on motion of Councilmen James was referred to the finance committee and that it be considered at Budget Time. Councilman Bierwegen seconded the motion. ?potion carried. The condition in the Lity of.South Bend hus become extreme- lv serious. The Health Depflrtmert finds it necessary to condemn many houses in order to protect the health of the city, Fnd the scs•reity of de- Rings is such that families are unr:ble to find a place to live when forced to move from these condemned houses. In me.ny cases they Fre taken in by relatives or friends, thus cn using overcrowding which again creati�s�-° unsanitary conditions detrimental to .,the health of the community. These fpmilie s must be taken care of as soon_ as possible in crder to eliminate this condition. Provision -has been.mede by the Indi =3na Legislature for the clearance of slum areas and the er- ection of sanitary dwellings for families of lour income. OF SOUTH BEND AND AUTHCRIZING THE *?AYOR OF THE CIVIL CITY TO CREATE--SUCH HOUSING BOARD PURSUANT TO THE ACTS OF 1937, CHAPTER 207, SECTION 4. BE IT RESOLVED by the Common Council of the Civil City of South Bead: That it appearing to the setisfaction Of this body th:r:t there are unsanitary and unsafe inhabited dwelling accomodat ions in the City, and further that there sre shorta.gee of safe and sanitary dwelling accomodations in the City of South Bend available to persons of low income at rentals they can afford, end it appearing to the satisfaction of this body that such overcrowding and lack of housing facilities constitute a peril to the life of the peonle,occupying such dwellings by reason of unsanitary health conditions and dap ger of fire and other pestilence, it is the sense sfd thought of this body that the Mayor of the Civil City of South Bend be authorized and directed to create a housing boerd consisting of five (5) commissioners: one to be appointed for one year, one for two yepTr, one for three years and two for e term of four years. Said Commiss- ioners to serve without compensation excepting expense allowances as set out in Section.5 of Chapter 207 of the Acts of 1937. And further it is the se -se of this body that said board so created shsll operate under and pur- suant to Chapter 207 of the Acts of 1937 end eh?11 have such rowers and duties as set out In said Chapter 207 of the Acts of 1937.
