HomeMy WebLinkAbout02-22-37 Council Meeting MinutesREGULAR MEETING FEBRUARY 22nd., 1937 MINUTES Be it remembered th ^t the Common Council of the City of Seuth Bend, Indinne met in the regulpr session in the Council Chambers of the City Hall, Monday evening, February 22nd, 1937, pt the hour of 8:55 P. M. All members were present. President Fish presided. Councilman Hull moved that the reading of the minutes for the last meeting be dispensed with. Co=cilman Goetz seconded the motion. Motion carried. CERTIFICATION OF POSTING NOTICE TO TAXPAYERS In the Matter Determining Additional appropriations for extra funds for the employment of pn additional milk inspector, providing a. car for him and pay for the gasoline for the balance of the year 1937.. - South Bend, Indiana February 23rd., 1937 I; Mary B. REPORT OF THE COMMITTEE OF THE WHOLE #3001 To the Common Council ;of the City of South Bend: Your Committee of the Whole to whom was referred an Ordinance appropriating the sum of $2,325.00 from the General Fund of the City of South end to certain accounts under the Board of Health for the employment of pn ed.diti.onsl Milk Inspector, rmovid.ing a car for him and pay for the gasoline for the balance of the year 1937• Respectfully report that they have examined the matter and that in their opinion should be re- oorted favorable. Ordinanceadopted. The following resolution was introduced. at this time and passed by the following vote: Goetz., Bierwagen, James, Kerner, Fish, Chambers, Rasmussen and Palicki. 8 eves. Hull. 1 nPy. Resolution passed. A RrSOLUTTON DIRECTING THE BOARD OF PUBLIC HEALTH AND THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND TO MAKE CERTAIN TRANSFERS OF MONEY AND PROPERTY UNDER CERTAIN CONTINGENCIES HEREINAFTER SET FORTH, BE IT RESOLVED by the Common Council of the 'City of South Bend, that: ' WHEREAS, there is now pending in the Common Council of the'City of South Bend and ordinance appropriating money for the purchase of a new automobile for the Board of Public Heelth for the use of a new Milk Inspector, end WHEREAS, it is the belief of this Council that the funds for said automobile should be Prplied to the purchase of a new car for the Police Department in the event said ordinance is duly pass- ed and approved by the State Tax Board, end WHEREAS, it is the sense of this body that the Board of Public Safety should.turn over unto the Board of Health in 'Lieu thereof an automobile suitable for the use of said new Milk Inspector. It is the sense of this body that in the event this ordinance appropriating the money'for the new car is pessed by this body and is approved by the State Board of Tax Commissioners, thus per ipttting. the use of said money for the purposes described in ssid.ordinance, that the Board of Public Health relinquish their rights to said money, when thus received, upoh. the receipt by, them from the Board of Public Safety of the possession and title of an.a..utomobile suitable to said Board of Public Health for the use of said Milk Inspector, and that said funds so released shell be released to the Board of Public Safety end may be used by them for the purchase of an automobile for the Police Department of the City of South Bend, and to consummate the purposes, and idea of the Common Council in making this transfer, the Board of Health shall purchase the automobile and transfer the tttle thereof immediately to the Board of Public Safety, and the Board of Public Safety shall transfer title of the Police Car to the Boerdof Public Heel.th for the purposes hereinbefore expressed. And this .Common Council by this Resolution binds itself that it will approve and ratify the acti.ons'of the Board of Public Safety end the Board of Public Health in carrying out the intent of this Resolution by the necessary approving ordinance, when submitted, by the proper official bodies. James MEMBER OF THE COMMON COUNCIL ORDINANCE NO. 3202 An Ordinance smending section 13 of Ordirr.nce #2682 with particular reference to the part setting forth the fees to be paid by dealers In the production of milk or cream. .The Ordinance wee given its first reading by title, its second reading in full and on motion of.Councilmsn Goetz was moved to be tabled. Councilmen Hull seconded the motion. Motion carried ORDNANCE NO. 3203 An Ordinance eppropriating the sum of three thousand dollars from the General Fund of the (City of South Bend to account under the Board of Public Works for repair of fire stet ons, this sum being the amount necessary to meet the bids of the.proposed improvement to #2 fire station in excess of the ninety -five hundred dollars appropriated in the 1937 budget. -The Ordi.ninee was given its first reading by title, its second reading in full and on motion of Councilman Chambers was referred to the Committee of the Whole and also that a public hearing be held March 8th, 1937. Councilmen Kerner seconded the motion. Motion cerried. ESOLUTION: P O L I S H- A_M,E R I C A N C E N T R A L C I V I C C O M M I T T E E OF SOUTH BEND, INDIANA South Bend, Indiana. Feb. 16, 1937 RESOLUTIk` ,,ANENT MAYOR GEORGE W. FREYERMUTH'S PARK PLAN WHEREAS, the local Press recently printed a. news item to the effect that Mayor George W. reyermuth of South Bend, Indiana, made public a letter in which he recommends to the Board of ark Commissioners the accomplishment, within P period of five years, the following objectives, o wit: 1. Provide adequate recreation parks and pleygrouds in all sections of the city; P. Provide playgrounds for pupils of ell schools not provided for by the school city; 3. Provide bathing beaches, pools end ice - skating rings for each section of the city; 4. Provide entertainment such Ps music, lectures end displays at the various parks at stated times, taking advantage of the services that can be given by the electrical snd other departments of the city; AND WHEREAS, the objectives just recounted afford, it would seem, a primary- purpose for the aintaining of P municipal park board anywhere; AND WHEREAS, these objectives ss recommended by ?Mayor George W. Freyermuth ere quite compre- ensive, and eminently and refreshingly fair to all tax- pryers; THEREFORE; BE IT RESOLVED th^t the Polish - .American Central Civic Committee of South Bend, ndiena, i.nplenery session esser_bled this the 16th day of February, 1937, make known its reedy pprovnl of Mayor George W. Freyermuth's recommendations to'the Board of Perk Commissioners Ps bove set forth; AND BE IT FURTHER RESOLVED that said.Centiel Civic Committee does hereby so make known and xpress its unreserved approveir©f Ma-yor:Freyermuth's park recommendations, as also, does hereby ive a vote of complete confidence to the effect that Mayor Freyermuth, in so far as will be with - n. his power, will. pursue his perk recommendations to their full reolization within the period tst ed; AND BE IT FURTHER RESOLVED.that said Central Civic, Committee looks hopefully to a hearty ndorsement of Mayor Freyermuth's perk recommendations by all city departments in any way concern - d thereiri, and tYpt these departments will cooperate efficiently in bringing about the a.tta.in- ent of the objectives of these recommendations; 11 • *I • 01 • 461 (CONTINUED FROM PAGE 460) ACCORDINGLY, BE IT RESOLVED, in conclusion, that a copy of this resolution be sent to Mayor George W. Councilman James moved that the City Attorney give en opinion on the'legality of the milk *fee bt his earliest convenience, if not legel bring in ordinance rescinding the section on fees. Councilman ti'erwa-cren seconded the motion. Motion carried. There being no further business, Councilman Palicki moved to adjourn_: Councilman Bierwagen seconded the motion. Motion carried.
