Be it remembered that the Common Council of the City of South Bend, Indiana., met in the
special'Session in the Council Chambers of the City Hall, Monday evening, December 21st, 1936,
at the hour of 8:35 P. M. All members were present axzapI. President Fish presided.

To the Members of the Common Colzncil
of the City of South Bend, Indiana:
You are hereby notified thAt under and by virtue of the authority by lew vested in me as
Mayor of the City of South Bend, of the State of Indiana, a. special meeting of the Common
Council of said City of South Bend, is hereby called to be held at the hour of 7:30 o'clock
P. M. or as soon thereafter as convenient, on Monday evening December 21st, 1936, to the
Council Chambers in said City, for the purpose of considering the following:
COMMUNICATIONS:
A letter and affirmation from the State Board of Tax Commissioners.
ORDINANCE ON THIRD READING;
#3197 - "An Ordinence transferring the sum of $1,750-00 from* certain accounts under
the Board of Public Safety of the City of South Bend to account S -15 -under the electri-
cal department of-the Board of Public Safety for the installation of traffic lights on
Lincoln Way West of the City of South Bend."
RESOLUTIONS:
"Resolution_ of the Common Council of the City of South Bend approving the action of the
Board of Aviation Commissioners of the City of South Bend in tra.nsferriing -and assigning
ell'right title and interest in and to the Bendix Municipal Airport to St. Jospph
County and releasing the interest of said City to leases with the Bendix Aviation Corp-
oration and other leases with persons occupying sites on the Bendix Municpel Airport
as , of January lst , 1937."
"Resolution of the Board of Aviet ion Commissioners of the Municipal City of South Bend
providing for the transfer end assignment of certain described personal property to
St. Joseph County, Indiana, for eonsiderations stated and releasing the interest of
the City of South Bend in and to certain leasers hereinafter set forth."

1. That the following personal property, to -wit: four (4) hangars of ortable
steel construction; one (1) garage building, portable steel, one (1) tool
shed; outside toilet; wind tee; one (1) beacon light; six N flood l- fights;
field lighting equipment; mowing machine: snow removal equipment; one (1) trp-ff6c
control projector; office equipment and hand tools shall be- transferred, assigned
and delivered unto-the control, custody and ownership of St. Joseph, County,
Indiana, as of January 1, 1937.
2. That a certain lease and swreement entered into -between the Board of Aviation
Commissioners of the City of South Bend and the Bendix Aviation Corporation as 6f
September 26; 1932, which was renewed and carried f orwe.rd as of November 26, 1934,1
under Ordinance #3085, be released by said City of South Bend insofar as the
period of time from January 1, 1937,to December 31, 1938, and that the Bendix
Aviation Corporation having received copy from the Board of Aviation Commissioners'
• of this resolution of the Board $t to be released from the above lease and a gree-
ment and the said Bendix Aviation Corporation having notified the Bcerd of Avie-
• tion Commissioners that the Bendix Aviation_ Corporation has released the Board of
Aviation Commissioners then and in that event the Bendix Aviation Corporation is
authorized and directed to turn over to St.-Joseph County the possession and
evidence of control as of January 1, 1937, of the property described in said lease
and option agreements.

3. And that' the Board of Aviet ion Commissioners, acting for and on behalf of the
City of South Bend, hereby releases and quit claims any interest said City of
South Bend may have in and to the- leases covering the personal property on the
-airport to St. Joseph County subject to the agreements in- said leases contained.
4. And the said Board of Aviation Commissioners of the Munic•tpa.l -City•of South Bend
covenants and agrees that they heve good right and full authority, subject to the
approval of the Common Council of the City, of South Bend, to transfer, deliver
and assign all of the personal property above described, and that the obligations
end bills against said Municipal Airport have.been fully paid and. di'sch urged
by this Commission, excepting the taxes assessable against 6aid real estate and
current telephone and telegraph cherges that will not accrue until sfter January
1, -?937 •
50 It is . expr.essly - understood by the passage of this resolution that the management,
control and operation of said Bendix Municipal Airport shall be no longer under
the operation and control of the City of South Bend after midnight December 31,
1936•
6..-It is the sense and thought of this body that this resolution, when duly psssed-
by e majority of this Board of Aviation Commissioners of the Civil City of
South Bend, shall be presented to the City Council -of the City of Sou!th'Bend for
thtir approval, approval of the Mayor-of said City, and when said resolution has
been formally ratified by the concurrent act of this body and the city Council
of the, City of 'South Bend, signature by the Mayor, that the president and secret-
ary of this body shall issue and deliver any indicies of title necessary to carry
ont the thought and intention of this instrument.
