Be it remembered that the Common Council of the City of South Bend, Indiana, met in the
Regular Session in the Council ChRmbers of the City Hall, Monday evening, December 14th, 1936
Pt the hour of 7 :59'P. V. All members were present except Councilman James. President Fish
presided. Councilmen Hull moved that the reading of the minutes for the last three meetings
be dispensed wits. Councilman. Goetz seconded the motion. :Motion. carried.

having carefully considered the sa-tie, now fixes and re €apportions the tax rates for the City of

The rate for City Planning is eliminated for the reason that there are sufficient funds
in the department to carry over next year, end meet the budget items without a tax levy.
The tax rate for the Sinking Fund is increased from 2 to 4 cents to prepare a sufficient
fund to meet the peyment of $200,000.00 due in the year 1939, and the same rate ought to be
continued next year.
The increase in the Firemen's and Policemen's Pension Fund is necessary to keep those
funds in a better condition to meet requirements of the funds.
The Park 4a.intenance Fund is increased one-half cent to meet the requirements of that•Fund.
The budget items effected b-y the reduction in the General Fund are as follows:

The receirts, other thanloxes which includes excise tax and gasoline taxes and the in-
creased fell collection of property tax, will supply sufficient funds to meet the budget as re-
duced and approved.
Public officials shaould not fail to do their full duty and aim to keep the cost of gov-
ernment within proper limits.

Gentlemen: .
The City Plan Commimion begs to make the following report of progress toward the actual
fulfillment of the Council's wishes as set forth in its resolution of April 27, 1936.
The City PZen Commission is aware - that -a comprehensive Master Plan for the city of South
Bend and the immediate suburban areas will necessarily be of graduel development, and as-the
lnw provides that it may be prepared and adopted in parts, it is logical that such parts of
the Master Plan as will come into earliest application be first prepared and put into operation,
then to this may be added subsequent portions as they reach the proper ata.ge of development.
A Master Plan for a city of the size and character of South Bend should embrace not less
than the followIng:
Official Map of the City.
Official map of the sub —urban areas within the territorial jurisdiction of the Commission.
Major thoroughfare plan.
Secondary street plan.
Subdivision regulations.
Comprehensive zoning.
Continued land use and occupancy studies.
Application of available traffic studies to the thoroughfare plan.
Housing studies Pnd recommendations.
In addition to the above, the 1935 City Plan Law requires that the Master Plan also pro-
vide for:
A continuous improvement program extending ten'yea.rs into the future.
Supervision of property transfer within the City Plan Limits.
The City Plan Commission believes that the preparation of a ten -year improvement progrPm.
should be the product of P. gradual evolution in that direction, and that the function of the
City P1.sn Commission in that connection must be that of a co- ordinating agency ectir_g i.n_an
sdvosory cppncity on_plenning rather than having executive powers, and in so doing,
n: exercise
no Puthority that mill encroach upo the.functions of the officials or boards having_ immediate
jurisdiction over the work of the individual -rroject.
The City Plan Commission is aware of the fact that a large amount of detail work will be
called for in supervising the transfer of real estate so that this work mey.be handled.ex-
peditiously. Maps must be prepared showing the platted and unblaited areas as well as the re-
corded plats. Provision must be made for facilitating the transfer of property in unrecorded
additions. It will be -the recommendation of the City Plan Commission that, at the time the
property transfers pass through the department, a. certification of the zoning of the property
be :.made s. part of the report. It will further be recominended that a fee be charged for each
transfer of property submitted to-the City Plan Commission for approval.
The City of South Bend now has a comprehensive zoning law, which may be revised as the
progress of 3bnd use studies may show to be advisable.
The major thoroughfare plsn is being revised to correspond to the new limits of territoria
jurisdiction and to include the present state end national traffic routes.
At the proper time relations will be established with adminstrative officials of the'
county end neighboring municipalities to the end of establishing uniform methods es far Ps

TO THE HONORABLE MEMBERS OF
THE SOUTH BEND CITY COUNCIL:
GENTMEN :
In the lest twenty or twenty -five years city public improvements have amounted to
hundreds of thousands of dollars including schoold, playgrounds, parks and etc. Every pert of
the city benefited except the North -west section. And beceuse of our property assessed value
we believe that we paid for about forty percent or more of the amount of these improvements.
Our traffic system is bad end our mein street is absolutely unusable.
Especially during the Notre Dame Football games the-,-traffic at the corner of Portage
Ave. and Angela Blvd. was so heavy that cars were driven over lawns as there were no traffic
officers Rvs.ilable end there isn't -any traffic signal. Then two blocks Away the Angela. bridge
over the St. Joseph River is too narrow to take care of the amount of traffic t ha.t.pa.sses over
it especially during these.gemes. It is really dangerous not only to people driving but also
to pedestrians we have to use the very narrow walk provided only on one side of the bridge.
If there Pre any-new bridges to be built the first one should be on Angela. Blvd.
Now Gentlemen, every one of you a. member of the City Council, before you give your
vote for the next improvement that improvement should be on Portege Ave. This street is so
bad that -if -it stays the way it is we will be forced to hang red lanterns out at night to warn
drivers of the holes. And according to the condition its in we are afraid that there would
have to be almost as many lanterns as bricks in the pavement.
We, the undersigned, residents and property owners of this section of the city ask
every member of the City Council to take advantage of the Federal money available to improve
the following conditions in the North -west section of the City of South Bend.
1. Pave Portage -Ave. from Navarre St. to Keller St. with concrete and asphalt pave-'
ment. Widening street two feet on each side if necessary. Replace street car with bus service
2. Build a new concrete viPduct to replace the wooden one which is in a. very bed
condition, over the rPilroed on Portage Ave.
3. To install an electric traffic signal to regulate traffic on Portage Ave. where
Diam ^nd Ave.,_Blaine And Angela enter it.
U•. Widen or build. a new bridge at Angela. Blvd. were it crosses the St. Joseph River.
It is therefore the prayer of the undersigned that your Honorable Council sees to
make these improvements. Respectfully submitted,

BE IT RESOLVED by the Common Council of.the City of South Bend, Indinns:
That this body does in all things confirm and approve the action of the Board of Public Works
'under date of the 14th day of December, 1936, in'signing and entering into the following
contract with the Studebaker Corporetion, organized under the State.of Delaware, having its
principal place of business in the City of South -Bend, State of Indiana, which contrect is in
the following words and figures, to -wit:
MEMORANDUM OF AGREV?EYT entered into this. 10th day of December -1936, by end between
the City of South Bend, a municipal corporation of the State own ia.na, by and through its
,Board of Public Works, (hereinafter referred to as CITY), party of the first pert, and The
,Studebaker Corporation, a corporation organized under the laws of the State of Delaware end
!having & principal place of business in the City of South Bend, State of Indiana, (hereinafter
referred to as COMPANY), party of the second part.
WITNESSETH THAT:
WHEREAS, City is the owner of the easterly ten feet (101) of Lot No. 245 and the westerly
twenty -one feet (211) of Lot No. 244 in'Daniel Garet's First Addition to South Bend City under
and by virtue of the terms of certain deeds executed on the 8th day of July, 1893, recorded
in Deed Record 93 on page 24P; and February 6, le94,- recorded'in Deed Record 94 on page 397
in the Recorder's Office in St Joseph-County, Indi�ena, by Studebaker- Brothers Manufacturing.
Company, by the terms of which said property was conveyed to the said City upon certain re-
strictions and conditions as set forth in said deeds; and
WHEREAS City desires to exchenge.said above described property for a piece of roperty.
Company 178 and a parcel of land fifteen feet (151) in width

WHEREAS, Company is the succepoor in interest of the said Studebaker Brothers Manufacturing
Company and is grilling to make 81&- +exchange of the said property above described upon the follow-
ing terms and conditions.
NOW, THEREFORE, IT TS AGREED AS FOLLOWS;
1.
City agrees to convey to Company.the said above described easterly ten f eet.(10') of
Lot No. 245, Pnd the westerly twenty -one feet (21') of Lot No. 244 in Daniel Garst's First
Addition to South Bend City by warranty deed, free of all liens and encumbrances, including
taxes.

North side of Lot No. 179, ell as shown on the recorded plat of Daniel Garet's First Addition

and encumbrances, including taxes, but upon:the following terms and conditions:
(a) That said property is to be used for the sole use of said City, and for the
sole purpose of. and upon condition that it at once proceed to establish, equip
and at all times maintain in active service, a Hose House for its Fire Depart -
'ment, for-the purpose as aforementioned, and incase of abandonment on the part
of said City of said premises, diversion of use end purpose as aforesaid, or
failure to keep said Hose House and maintain equipment therein in active ser-
vice as aforesaid, then the title and estate herein granted and conveyed, and
the use, occupancy end possession of said premises with the improvements there -
.:on shell immediately determine and cease as to said City and shall revert to
and belong to said Company.
(b) That if said Company shall at any time determine, and shell so notify said
City iri writing, that the needs of said Company demand the use by it of ell
or any part of said demised premises and-Company shell furnish to said City P
plot of ground of equal area located within three (3) city clocks of sand
demised premises, then said City will, *ithin six (6) months efter notice, re-
move its equipment from the building located upon the said above described
premises and install the same in a building to be erected by it, at its own
cost, upon the premises so furnished by Company, and in such event the above
described premises with the buildings and appurtenances at that time thereon
shall revert to and belong to said Company, and City agrees to reconvey the
same to Company by proper warranty deed.

(1) That Company shell be free of all expense involved in the performance of this
agreement end in the transfer of said property, it being understood that City
accepts the above described premises in their present condition and assumes all
cost and expense necessary for reconstructing the premises for its use;
(2) That the building end appurtenances now located upon said easterly ten feet
(101) of Lot No. 245 anal the westerly twenty -one feet (211) of Lot No. 244 of.
Daniel Garst's First Addition to.South Bend, :City, shall be surrendered to
Company in its present condition, except that City shall be entitled to remove
any and all of its equipment;
(3) that City agrees to be respnnsible for and agrees to reimburse Company for
United States stamp tax required to be affixed to either or both of said deeds;
(4) that the terms and conditions of this agreement shall not be binding upon
either party until the same shell have been authorized by appropriate action of
the City Council of said City, Approved by the Mayor, and attested by the City
Clerk;
that upon approval of this contract, as above set forth, the parties hereto
agree to make the above described transfers end deliver possession of the

properties within thirty (30) days fiom the date of such e_pprove.l;
(6) that this contract and ell the terms and conditions thereof shall be binding
upon the inure to the benefit of the successors and assigns fo the parties
hereto.

WHEREAS, the above contract was submitted for approvel to the City Council of South Bend,
Indiana; and
WHEREAS, P resolution was submitted, seconded *nd duly passed, wherein the execution of
said contract was approved at e regular meeting of the said Council on the 14 dey of
December, 1936 and
WHEREAS the Honorable George W. Freyermuth, Ma.yor of said City of South Bend, approved
said resolution on the 15th dAy of December , 1936;
NOW, THEREFORE, THIS contract is duly Accepted in behalf of the City of South Bend this

end that it be the action of this body that said action be in all things confirmed, and the
Mayor of the Glty of South Bend end the City Clerk are authorized and directed by this resolu-
tion to spread upon the minutes of this Corporation this approval and acknowledge said approval
in writing on the contract with said Studebaker Corporation of Delaware having its principal
place-of business in South Bend, Indiana.

Councilman Chambers moved said resolution be adopted. Councilman Hull seconded the motion.
Motion carried.
Councilman Chambers moved that all city cars, except certain police cars, be labeled, city of
South Bend and name of department. -- Councilman Rasmussen seconded the motion. Motion carried.
There being no further business, 'Councilman Rasmussen- moved to, adjourn. Councilman Bierwagen
seconded the motion. Motion carried. Council adjourned at x:55 P.M.
