HomeMy WebLinkAbout07-27-36 Council Meeting MinutesREGULAR MEETING MINUTES - JULY Be it remembered-thet-the-Common Council of the City of South Bend, Indiana, met in the Regular Session in the Council Chambers of the City Hall, Monday evening, July 27th, 1936, at 81 =00 P. M. All members-were present. President Fish presided. Councilman Hull moved that the reading of the minutes for the last meeting be dispensed with. Co-.ancilman Chamberw seconded the motion. Motion carried. CERTIFICATION OF POSTING NOTICE TO TAXPAYERS In the mutter determining Additional 'Appropriations for extra funds to purchase an extension ladder for the Fire Department; to employ an enspector for the balance of the year 1936 for the Building Department; to discharge a judgment and Court Costs rendered against --the City in favor of the Henry Eckler Manufacturing Co. South Bend, Indiana. July 28th, 1936 I. REPORT OF THE COMMITTEE OF THE WHOLE: #3176 To the Common Council of the City of South Bend: Your Committee of.the Whole.to. whom was referred An Ordinance appropriating the sum of $400.00 from the General Fund of the City of South Bend to Account Numbered N -2 in the Building Department under the Board.of Public Works for the employ0ent of an inspector for the balance• of the year 1936. REPORT OF THE COMMITTEE OF THE WHOLE: #3177 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred An Ordinance Eppropriating the sum of 1750. from the General Fund of the City of South Bend to account #Q -16 in the Fire Department, the same being the account for motor Equipment, for the purchase of a new extension ladder. Respectfully report that they have examined the mutter and that in their opinion should be re- ported favorable. Goo. W. Goetz, Chairman. REPORT OF THE COMMITTEE OF THE WHOLE: #3178 To the Common Council of the City of South Bend: Your Committee of the whole to whom was referred an Ordinance appropriating-the , Sum of $1145,99 from. :the _ Generel Fund. of the City of South Bend to account 0 -11 -A under the Controller Office for the discharge of a judgement and-court costs rendered against the City and in favor of the Henry Eckler Manufacturing Co. Respectfhly- report that they have examined the matter and that in their opinion should be re- ported favorable. Goo. W. Goetz, Chairman -. COISfUNI CATION : A letter and affirmation from the State Board of Tax Commissioners were read in repard to Ordinance #3162 for additional appropriations in the §um of $100.00. Councilmen Chambers moved said bommunication be accepted and placed on file. Councilmen•Reamuss seconded the motion. Motion carried. PETITION: STATE OF: ",INDIANA PETITION TO THE CITY COUNCIL OF THE CITY OF SOUTH BEND, SS: INDIANA, BY THE TOWN OF ROSELAND AND CERTAIN TOWNSHIPS ST. JOSEPH COUNTY DESIRING TO CO- OPERATE IN THE PURCHASE AND MAINTENANCE OF FIRE FIGHTING APPARATUS AND EQUIPMENT Whereas it becomes necessary to have fire protection in the outlying districts-and rural communities adjacent to the City limits of the City of South Bend, Indiana, and such out -lying districts or sections cannot maintain an adequate fire fighting system, and Whereas the Legisleture in 1927 passed a. law whereby the Common Council of any city and the proper euth6rities of any tornship in which said. city is located or in any townships adjoining the township in-which said city is located is authorized to co-operate-with the proper author- ities of any such city in the purchase, maintenance and up -keep of such fire fighting apperatus end equipment and equipment as may be deemed necessary to afford the requisite fire protection to such city and the townships and Whereas said law provides that the trustees of any two or more townships may unite in the joint purchase of fire fighting and extinguishing tend apparatus and equipment, and Whereas the proper officials_ of the various townships hereinafter enumerated either in which the City of South Bend, Indiana, or in the Townships contiguous to the to�rnship in which the City of South Bend, Indiare, is located-believp that -the better protection can be procured by co- opera ing. -with the City of South Bend, Indiana, in the purchase, maintenance, up -keep of the .fire fight ing apparatus and equipment then they could do it either separately or jointly, believes they should file with said Common Council of the City of South Bend, Indiana, a petition under this lew and work out, l f possible, a co�-opere.tive system of fire protection. (CONTINUED FROM PAGE 4b) We, the undersigned being the Trustee end Advisory Board of Center,-Civil Township, Clay Civil Township, German Civil Township, Portage Civil Township,, Greene Civil Township end Warren Civil Township snd-the Board of Trustees of the Town of Roseland all in St. Joseph County, Indiana, desiring-to co- operate with the City of South Bend, Indiana, in the purchasing, maintenance and up-keep-of such fire fighting apparatus and equipment as may be necessary to afford the requisite fire--protection to said City- of South Bend, Indiana, the Town of Roseland and the Toornships • enumerated - above hereby petition the Common Council of the City of South Bend, Indiana, that sai Townships including- the Town- of- Roseland desires to co- operate with' the City -cf South* Bend in the purchase, maintenance and up8keep of such fire fighting apparatus and equipment as may be nev- essery -to afford the requisite• fire protection to both the City of South Bend, the Town of Rose- land e,nd the Townships enumerated above and asks the Common Council of the City of South Bend to consider this petition and if And when the same is approved and _en ordinance . for that purpose shall have been enacted-accepting and approving of such petition, then euch.Common Council on be helf of the City of South Bend and the Trustees on behalf of the Townships mentioned above in signing this petition- shall enter into a contract which contract will set forth the terms and conditions upon and in compliance with which such Lity -of South Bend, Indiana, and -the - Townships enumerated herein in subscfibing hereto to- co- operate- andthe interest that each shall have and hold in and to the equipment and apparatus purchased by such city and said townships. !• Wherefore the undersigned duly constituted -and legal officials of the various townships end the Town of Roselend prey your Honorable Board to consider and act upon the above and foregoing petition. ORDINANCE NO.376 An Ordinance appropriating the sum of $400.00 from the General Fund of the City of South Bend to account numbered M -2 in the Building Department under the Board of Public Works for the • employment of an inspector. for the balance of the year 1936. The Ordinance was given its third reeding by title and was �,bst by the following vote.: Hull, Goetz, Kerner, Chambers and Rasmussen 5 ayes. Bierwa_gen, James, Fis# end Palicki 4 noys. Ordinance lost., ORDINANCE NO.317 An Ordinance approprieting the slam -of $750.00 from the General. Fund of the City of South Bend to account #Q -16 in the Fire Department, the same being the account for Motor Equipment, for -the purchase of a new extension ladder-. The Ordinance was given its third reading by title and was- placed upon its passage end pass ed btr the following vote: Hull., Goetz, Bierlgagen, James, Kerner, Fish, Chambers, Rasmussen and Pelicki. 9 ayes 0 nays. Ordinance adopted. • ORDINANCE NO.3179 An Ordinance appropriating the sum of $1145.99 from the General Fund of the City of South Bend to account #B -11 -A under the Controller's Office for the discharge of a. Judgement and court' ebsts_ rendered against the City and in favor of the Henry Eckler Manufacturing Co. The Ordinance was given its third reading by title and was lost by the following vote: Hull, Goetz, Kerner, Chambers, and Rasmussen, 5 ayes. Bierwagen, James, Fish and Pa.licki, 4 nay . Ordinance lost. ORDINANCE NO.3179 An Ordinance appropriating certain sums from the Maintenance Fund or Operating Balance in the :Department -of Public Parks -in the City of South Bend, Indiana., to certain Subdivisions in • ssid department of-- Public Parks all as hereinafter set out. The Ordinance was given its first reading b5 title, its second reading in full and on mono of Councilman Chambers was referred- to the Committee of the Whole and also that a public hearing beheld Aug ust.10th,_1936. Councilman Hull seconded the motion. Motion carried. Councilman Chambe 8 moved that said message be placed on file. Councilman Rasmussen seconded the motion. Motion carried. Councilmen Chambers moved that the Secretary of the Park Board bring in the information in re- Bard to the cost of materials forzepairing the Natatorium, W. P. A. labor doing the totkr Counc l-• man Rasmussen seconded the motion. Motion carried. Councilmen Chambers moved that the mayor or the president of the council appoint the Heber_ for the Civil Service Committee as stated in the Resolution, and to do so at once. Councilmen James seconded the motion. Motion carried. 407 (CONTINUED FROM PAGE 406) There being no further business, Councilman Hull moved to adjourn. Councilmen Goetz seconded the mot -ton.
