M. All members were present.eaid-,nt Fish presi�ed. Council an Hull moved that -the reading of the minutes of the last meeting be dispensed with. Councilman Goetz seconded -the motion.- Motion carried. REPORT OF CITY CLERK'S CERTIFICATE OF PROOF OF POSTING OF NOTICE TO TAXPIYERS. Notice is-hereby given the taxpayers of the City-of South Bend St. Joseph County, Indiana, that the proper legal officers of sp.id-miinicipality a.t their regular meeting place, on the 11th day of May; -1936, at 7:30 o-1--clock P. M., in the Council Chamber, will consider the following additional appropriations which said officers consider necessary to meet the extraordinary emergency existing at this time. To the Common,., Council of the City of South Bend: Your Committee of the Whole to whom was referred an Ordinance appropri8ting the sum of Seven Thousand Four - .Hundred end. Ninety -one Dollars ($7,491:00) from, the General Fund of the Department - -of- Public Parks of the City of South Bend, Indiana, to- said - Department for the pur- chese -of Real Estate and material for its Riverside Parkway Project: Respeoftu?ly report -thet they have examined the matter and that in their opinion should be re- ported favorable. COMMUNICATIONS: CITY OF SOUTH BEND, INDIANA office of the Mayor _ May 9, 1936 The - Common Council, City of South Bend, South Bend, Indiana. Gentlemen: - Your.. re_solut -cm dated April 20, 1936, calling for civil service, advancement end. retirement of a31 employees-below-the rank-of Chief; etc* has been returned not signed: When my attention was called to this_ resolution councilman- informed me that that part-of the third paragraph which reads "end eventua7:Ily for other departments of the city government" would be omitted but the resolution shows that this was not done. Hearty agreement with civil service for members of the Police and Fire Departments should be ex pected but, however- civil service for- -- other. employees.of the City is impractical and should not be considered at this time. It is believed wise not to resolve on eventualities, such matt should be taken -acre of when events show them to -:be practical. Your-honorable body knows that the Mayors of Indiana will -meet here -next October -and the very subject- of your resolution- will. be discussed ther:, as, it has -been - considered by them on several previous occasions. On this account -it is- respectfully requeeted- that this mat's er be deferred until after the meetting-of the Municipal teague of Indiana. Nothing can be done until the next session of the legislature, and there will be ample time to formulate a bill after the Mayors of Indiana meet in our City. Very truly yours, George W. Councilmen Bierwagen seconded the motion Councilman Goetz moved -to amen °�, to hold said resolution in the committee of the Whole for 2 weeks, till the 1st Monday in June. Councilman Jamee moved that -the traffic ordinance be taken up in the Committee of the Whole on Msy 18th, 1936. Councilman Chambers seconded the motion. Motion carried. PETITION: TO THE-HONORABLE COMMON COUNCTL OF THE CITY OF SOUTH-BEND, INDIANA: to We, the ,undersigned- property owners, hereby r espe °etfully petition your Honorable body in amend that portion of Ordinance No. 2331,.adopted June 25, 1923, commonly known as the "Zoning Ordinance affecting lots and lands in Eliss-Rupel's First Addition to the city of South Bend Indiana, particulerl:, Lots numbered One (1) and Two (2) end Three ( ) in said addition, and to thereby ._change the above described property from the "C" Commercial District to the "D "- Light Indust el District, so that -the said property may be used for Light Industrial purposes by the owners °'Ohereof. Gentlemen: Regarding the Controller's recommendation for passage of Appropriation Ordinance #x-'157: I am making-a conditional recommendation of the passage of this Ordinance for the reason that there is now in the fund against which this appropriation would be charged-, inn insufficient u lo ; amount to.py out the whole� of the Topriat-ton asked _ for. The balance available in the Park i Ma ntenence Fund as of April 30, was V,519-58, after -8n advance of $20.,000.00 from Spring Tazes. It is my duty ss Controller to keep the Cduncil advised as to the amount offunds, available for the various purposes for which the Council appropriates money. The Park Board-members- have - assured -the Mayor -snd myself that- sufficient funds will be available for this appropriation be fore they are needed by reason of an increase in the receipts from park activities. With that statement in mind, I am recommending -the passage of the Ordinance. It is only fair to say, however, that if sufficient funds,-become available, the money will be paid out -on-- proper requist- tions from the PP-rk Board. ORDTKANCE NO. 3157 An Ordinance appropriating the sum of Seven Thousand Four--Hundred -end'Ntnety —one Dollars ($7,.491.00) from the General Fund of the Department of Public Parke of the City of South Bend, I n d m e of Estate and material for its Riverside -t P is: - to said Department for the Durchas f' % Parkway Project. The Ordinance was given its third reading by title and wee placed upon its passage,and passed by the following vote: Hull, Goetz, Bierwagen, James, Kerner, Fish, Chambers, Rasmussen and Palicki. Ayes 9 Nays t Ordinance adopted. - ORDINANCE NO - 3158 An Ord-inence to amend Ordinance No. 2331 adopted June 25, 1923, eommonly known es "Zoning Ordinande", by changing a certain described tract from the 110.0 Commercial District to the "Dif Light Industrial District, and subjecting the same to the provisions of.Sections VI end XIV of Zoning Ordinance. The Ordinance was-given its first reading by title, its second reading in full and on motion of Councilman Hull was referred to the Zoning Board* Councilmen Goetz seconded the motion Motion carried.• There being no further business, Councilmen Hull made a motion to adjourn.
