HomeMy WebLinkAbout04-13-36 Council Meeting MinutesMINUTES MEETING Be it remembered that the Common Ccrincil of the--City of South Bend, Indiana, met in the Regul,r Session in the Council Chambers. of the City Hall, Monday evening April 13th, 1836, at. the hour of 7:40 P. M. All members were present. President Fish presided. Councilman Goetz moved that the readinz of the minutes of the last meeting be dispensed with. Councilmen James seconded the motion. 'Votion carried. 0OMMUNIC4TION: A letter from Mayor William Timmers of Grand Rapids, Michigan ,.on Eastern Standard Time was read. Councilman Goetz moved that it be filed. Councilman Rasmussen seconded the motion. Motion_ carried. A'letter from M -r. Moomaw in rep-?rd to a petition from Mr. Shively was read. Councilmen Ch bers moved that it be placed on file. Councilman Kerner seconded the motion. Motion carried. A letter from Mr. Bohn of the Clevel:pnd Council wzs read,on the Cleveland Housing and Slum Clearance. Councilman Chambers moved it be referred to the Committee of the Whole for next week and th?t the City Clerk furnish a copy of said letter to each councilman. Councilman Rasmussen seconded the motion. Motion carried. REMONSTRANCE: REMONSTRANCE Tb the Members of the City Council of South Bend, Indiana-. Honorable Sirs We the undersigned property owners of the Portage Park Addition to the City of South Bend, hereby desire to register a strenous protest against- any effort on the part of any person, firm or corporation usir,r2- eny part of said addition for ,e gasoline Filling Station site. We further protest any effort- that -may be made to zone the particular addition for other than a First Class Residentsl District. (15 signers) Councilman Chambers moved it be referred to the City Plan Commission.. Councilman James seconded the motion..- Motion carried. An Ordinance amending Ordinance No. 2243 as amended by Ordinance No. 2929, the same being en Ordinance regulating all matters concerning ` or -pertaining to the construction, alteration, repair or additions to, remodeling, use or occupancy of buildings or their parts and structures of every nature in the city of South Bend, '3ndfana,. providing; for the condemnation and stoppage of the use thereof, and the wrecking of the same, creating-the office of Building Commissioners, Assistant Building Commissioner and City Electrician and providing for the office of the Build- ing Department, repealing all former Ordinances or- parts- thereof conflicting therewith adopted. by the Common Council of the City of South Bend, March -27, 1922 and approved by the Mayor March 30, 1922 and published April 6th, of the some year, commonly known as the Building "ode of the City of South Bend, Indiana; and adopting the 1935 National Electrical Code and its amendments as a part of this Ordinance, excepting such parts of which are less restrictive-of in conflict rith this Ordinance. Councilman Hull moved said report be referred to the Committee of the Whole, so that it may be studied along with the other reports given to the Councilman. ORDINANCES: Ordinance___ 3153 An Ordinance appropriating - the sum of Four Hundred €nd Ninety Dollars from the Aviation Fund of the City of South Bend to-certain accounts in said Aviation Fund set up under the Board of Aviation Pursuent to Statute. The Ordinance was given- its first rending by title, its second reading in full and on Motion of Councilman Goetz rps referred to -the Committee of the Whole, also thet a public hearing be held on the 27th day of April, 1936. Councilman Rasmussen seconded the motion. Motion carried. Ordinance` 3154 An Ordinance amending section 22 of an Ordinance Numbered 2652, being an Ordinance regulat- ing the production, grading, labeling, handling, pasteurization, distribution and sale of milk, cream and- certain milk products and providing for Issuing licenses therefor. The Ordinance was given its first reading by title, its second reading in full and on Motion of Councilman Hull was-tef erred to the Committee of the thole, also that the Secretary of the Board of Health be present and also Mr. Grant, for consideration. Councilman Rasmussen seconded the motion. Motion carried. Orlin nnce 315 . An Ordinance appropriating the sum of Three Hundred and Sixty Dollars from the General Fund of the City of South -Bend to the Board of Public Safety Account No. F -2, for the payment of the City's Sronsor Share in the WPA Traffic Survey for the City of South Bend. The Ordinance was given its first reading by title, its second. reading in full and on Motion of __Caa -lman James vas referred to the Committee of the Whole, for consideration, and also that a public hearing be held on the 27th day of April, 1936. Co-.jncilman Bierwegen seconded the motion. Motion`-carried. Ordinance was not signed by Mr. Woodward. Ordinance 3156 An Ordinance approving the purchase of a caterpillar Diesel Auto Patrol bythe Board of Publi Works of the City of SouthBend in the sum of thirty seven hundred and eight Dollars. The Ordinance was given its first reading by title, Councilman Chanb ers moved that P of said Ordinance be sent to each Councilman, and that the 2nd reading be dispensed with. Council man Goetz -moved to amend Councilmen Chambers motion, that one copy of said ordinance be sent to the Streets & Alleys Committee, and that they reort bsck,to the Council. Councilman Hull second- ed the motion. Motion carried. RESOLUTION: WHEREAS, it is the belief of this Council that the establishment of a merit system of civil service for the appointment, rdvencement and retirement of all employees, below the rank of chief, of the Police and Fire Departments in this City woud greatly improve the morels and. in- crease the efficiency of such Departmen s by removing the same from the sphere of partisan politi and influence. and S, '385 WHEREAS, it is the belief of this Council that the same result would foTlow the establish - ment of such a civil service system for other municipal erhployees, and WHEREAS, this Council desires to record itself as favoring the est?blishment of such a civil service system,first, for the Police and ! "ire Departments, and eventually for other Departments of the City government, and WHEREAS, this Council desires to set in motion the machinery necessary to make the establish. ment of such a civil service system possible. THEREFORE, BE IT RESOLVED that this Common Council now records its belief that an adequate merit system of civil service for the appointment, advancement and retirement of all employees below the rank (bf chief of the Police and Fire Departments of this city should be established p s soon Ps mpy be done consistently-with-the laws of this state, and to that end, there is now and hereby created,- special committee of this Council, cons; sting of - three members tc Jse known a.s the Civil Service Committee. Such Committee shall be appointed by the President -of the Council and not more thpn two members thereof shall be of the same political faith. It shall be the duty of such Committee to thoroughly investigete the metter, confer *ith interested persons 2nd to prepare a Bill for presentation to the next regulpr session of the Indiana Stete Lezislp- ture, providing for or permitting the est ^blishment of a merit system of civil service for the appointment, advancement end retirement of all employees, below the rank of chef, of the Police 2nd Fire Departments in cities of the second class end providing or permitting th?t such civil service system mpy be extended to apply to employees of such other Departments of the City Rovers ment as the Common Council of epch City shall from time to time determine. It shall further be the duty of such Committee to correspond with the Common Councils or Committees thereof of the several cities of the second class in the state of Indiana and to endeavor to procure their cooperation in the preparation and passage of such legislation. Said Committee shall select its own chp:irmen and shall within one month from the date of the adoption of this resolution 2nd at lepst monthly thereafter, report to this Council its do- ings under this resolution. - BE IT FURTHER RESOLVED the t- each second class city in the state of Indiana is hereby invite( and earnestly solicited: to cooperate with the Common Conncil of this city in thera.doption of the civil service plan suggested by this resolution and to that end the Common Council of each such city is invited to appoint a similar Committee to meet with PTd cooperate v- th the Committee of this Council in formulating the proposed Bill and procuring its introduction in the passage by the State Legislature. BE IT FURTHER RESOLVED that a copy of this resolution duly certified by the City Clerk be sent to the Common Council of each second class city in Indian--. Councilman James read said resolution. Councilman Chambers moved it be referred to the Commits of the Whole for further consideration and study, and a copy of` resolution be sent to each Council- men. Councilman Rasmussen seconded the motion. Motion carried. Councilman_ Chambers moved that the Board of Public Works and the Water Works Board consider and adjust the cost of milking repairs in the streets after water mains have been repaired, and make a report to the Council in three weeks. Couneilma.n James seconded the motion. Motion carried. `here being no further business, Councilman Kerner made a, motion to adjourn. Councilman Rasmussen seconded the motion. Motion carried.
