M. All Members present except Councilman Palicki. Council_,�nian • Hull presided. Councilman James moved that the minutes of the last meeting be dispensed withi Councilman Rasmussen, seconded the motion. Motion carried. NOTICE OF CITY CLERK'S CERTIFICATE OF PROOF OF PU71ICATI --N OF NOTICE TO TAXPAYERS. In the matter determining additional appropriations for extra Clerk in Controllers office and to pay for the examination for Electrical Inspector. To employ a stenographer in the Board of Public Works. Also to defray traveling expenses for Police officers and Fire Chief on trips in behalf of the City. To the Common Council of the City of South Bend: Your Committee of the Thole to whoa; was referred an Ordinance amending Sections 6, 11, 172 24, %9, 42 and 46 of an Ordinance Numbered 2652, being an Ordinance regulating the production, grading, labeling, handling, pasteurization, distribution and sale of milk, cream and certain milk products and providing for issuing permits and licenses therefor. Respectfully report that they have examined the :matter and that in their opinion the said Ordinance should be re- ported Favorable by adding "b" to Section I, 'Any person living within the corporation liits df the (City of South Bend, Indiana. - By order of Doctors perscription can have delivered to their home, hotel or hospital certified raw goats milk. Copy of perscription to be filed with Board of Health for their records.' Striking out Sectioni II. Writing the word "Bottled" before milk in (m) of Section III. Striking out (a) in Section V. Striking out (b) in Section VI. Striking out Section VII and amending Section 42 or ori�4.inal Ordnance read as follows: The Board of Health shall appoint qualified persons as Milk Inspectors who shall hold office at their tleasure. They shall receive such compensation as may be fixed by the Board of Health, the same to be paid out of the annual Board of Health appropriation. Theyshall be the Board of Health's representatives in all matters pertaining to milk and dairy inspection and they shall perform such duties and shall have such powers and authority in making of inspections under this Ordinance as may from time to time be prescribed by the Board of Health. The Ordinance was given its third reading by title,and placed upon its passage and. passed by the following vote: Hull, Goetz, Bierwagen, J9.mes, Kerner, Fish, Rasmussen and Chambers. Ayes 5 Nays 0. Ordinance adopted.- Ordinance No • 13 09 An Ordinance transferring the sum of $577.50 from the Police Salaries Fund P -1 to the Salaries and Wages Regular F-.and 0-4 for the emplayment of a stenographer in the Board of Public Works and Safety Office and appropriating the sum of $577.50 from said. Fund 0 -4 for said pur- pose. Also transferring the sum of $300.00 from the Police Salaries rund Account P -1 to the Police Travelling Expenses Account P -7 for the purpose of defraying expenses of Police Officers trips on behalf of said city, and appropriating the sum of $300:00 from "said account P -7 for said purpose. Also transferring the'sum of $200.00 from the Fire Department Fund for other equipment, account Q -17 to account for Travelling, in the Fire Department Q -15 -A, and Appropriat- ing the sum,of $200.00 from said account"Q -15 -A for said purpose. The Ordinance was given its third reading by title and was placed upon its passage and passed by the following vote: Hull, Goetz, Eierwagen, Kerner, Fish, Rasiussen, Cumbers and James, Ayes S Nays 0. Ordinance No. An Ordnance appropriating the sum. of $50,000 from the General Fund of the City of South Bend for the purpose of acquiring the land taken from property owners, and the damages sustained in the opening of North Michigan Street from North. Shore Drive to the City Limits of said City of South Bend, Indiana. The Ordinance was given its first reading by title, its second reading in full and on Motion of Councilman Goetz was referred to the Committee of the Whole, also that a Public Hear- ing be held June 10th, 1935 at 7 :30 P. M. Motion carried. Ordinance No. 13 14 An Ordinance ratifying and approving the action of the Board of Public Works of the City of South Bend, acting as the Board of Water Trustees for said City, under date of May 17th, 1935 in making grants to-the City of South Bend, and authorizing the acceptance of.said grant, and the controller to take such steps as may be-necessary to complete the terms of the grant. The Ordinance was given its first reading by, title, its second reading in full and on Motion of Councilman Chambers, the Rules were suspended by the following vote: Hull, Goets, Bierwagen, Kerner, Fish, Rasmussen, Chambers and James, Ayes 8 Nays 0. Rules suspended and Ordinance goes to third reading. The Ordinance was given its third reading by title and was placed upon its passage and passed by the following vote: Hull, Goetz, Bierwagen, Kerner, Fish, Rasmussen, Chambers and James, Ayes 8 Nays 0. Ordinance adopted. Ordinance No. An Ordinance appropriating the sum of $500.00 from the General Fund of the City of South Bend to the Electrical Department, repair of Buildings Account No. S -5 -A, for the purpose of laying a new roof on the fire alar;n station in the City of South Bend, also transferring the sum of $500.00 from the regular salaries of Police f and P -1 to the General F1::nd of the City of South Bend. The Ordinance was given its first reading by title, its second reading in full and on Motion of Councilman Bierwagen was referred to the Committee of the Whole, also-that a Public Hearing bo held June 10th, 1935, at 7 :30 P. M. Motion carried. Ordinance No. An Ordinance transferring the sum of $10,000.00 from the Delinquent and Deficit account of the City of South Bend, to the General Fund of the City of South Bend, and appropriating from said General Fund the sun of ;7,000.00 to the Salaries Fund for Barrett Law help Account D -3, and also appropriating the sum of '93,000.00 from the General Fund to the Re- cord and Supplies Account for Barrett Law Equipment which Account is No. D -7 -A. The Ordinance was given its first reading by title, its second reading in full and on Motion of Councilman -Goetz was referred to-the Committee of the Whole, also that a Public Hear- ing by held June 10th, 1935 at 7 :30 P. M. Motion carried. Councilman Goetz moved that Mr. De- Haven'be present at the Committee of.the Whole meeting June 3rd, 1935- Councilman Chambers seconded the Uot icon. RESOLUTION: WHEREAS$ our sister republic of Poland assurned its statiDn among the nations of the world but a few years ago. Almost from the beginning of its independent status in Polish governement has been a great influence in world politics and has wielded its power to maintain the democratic principles that,government derives its just powers from the consent of the governed and that every person within its jurisdiction is entitled to equal protection under its laws. WHEREAS, the colorful thread of life of late Joseph Pilsudski is woven into the fabric of the new republic of Poland. The place of the late Joseph Pilsudski, Marshal of Poland is in the hearts of his countrymen and in the halls of world famous men is assured, but his country and the civilized world have Lost a hero and champion of liberty and justice in the death of this great soldier and statesman. RESOLVED BY THE COMMON O'UNCIL OF. THE CITY OF SOUTH BEND, and the STATE OF INDIANA in session assembled - SECTION I. That the Mayor and the city council of the city of South Bend, and the state,of Indiana, join with all the world in paying tribute to the-indomitable will, the force, the courage and the patriotism of Joseph Pilsudski. SECTION II. That certified copies of this resolution, properly authenticated, bq sent forthwith to the Consul General of Poland, 1444 Lake Shore Drive, Chicago, Illinois, for transmission of same to the family of the late Joseph Pilsudski. Councilman Goetz, moved that the Resolution be adopted. Motion carried. On Motion of Councilman Goetz the council adjourned at 9 :00 o'cloc P. M. Motion carried. ATTEST APPROV� CLERK
