o'clock P. M. All members present. President Nelson presided.
STATE OF INDIANA CALL FOR SPECIAL MEETING OF THE COMMON
ST. JOSEPH COUNTY SS: COUNCIL.
CITY OF SOUTH BEND
TO THE MEMBERS OF THE COMMON COUNCIL OF.THE CITY OF SOUTH BEND, INDIANA.
You are hereby notified that under and by virtue of the authority by law vested in me
as Mayor•of the City of South Bend, of the State of Indiana, a Special Meeting of the
Common Council of said City is hereby called to meet at the hour of 7:30 o'clock P. M., or as
soon thereafter as convenient, on Thursday evening December 27th, 1934 for the purpose of rece
a Report and taking aetiorx on the following Ordinance, which title is as follows:
" An Ordinance Prohibiting the scattering -of advertising matter on Public and Private
Grounds and buildings of the City of South Bend,.Indiana, Providing for a License Fee for the
Delivery and Distribution of advertising Matter and otherfArticles within the City, Providing.
a Penalty and repealing Ordinance No. 1056 adopted it July 8, 1901 also being known as Sections
150 and 151 of Ordinance No. 1827 Printed in Book Form and adopted February 14, 19ml6".
ALSO Fdr the introduction of the following Ordinance, which Title is as follows:
" An Ordinance authorizing the Mayor of the City of South Bend to petition and request tb
State Highway Commission of.Indiana to improve certain streets in said City with Federal Funds
and to enter into an Agreement binding said City to maintain suchstreets, providing for the
future, maintenance of said streets and for the enactment of Ordinances for protection -of said
streets and the regulation of traffic thereon and matters connected therewith ".
ALSO For the Introduction and approval of Surety Bonds of the following:
"Official Bond of Mary B. L. Naylor, City Clerk.
Offioial Bond of Thomas Atkin Brandon, Chief Deputy City Clerk.
Official Bond of Irene Vargo, Deputy City ClerkV
ALSO " For donsideration of the question of appeal from the Public Service Oommission finding
and order on the Case of'City of South Bend, Indiana VS from-the
Indiana Public Service
Company".

REPORT OF THE COMMITTEE OF THE WHOLE.
To the Common Council of the City of South Bend
Your Committee of the Whole to whom was referred An Ordinance Prohibiting the scattering
Advertising Matter on Public and Private Grounds and buildings of the City of South Bend, Indi:
providing for a License fee for the Delivery and Distrimbution of advertising- matter-and other
articles within the City, providing a Penalty and repealing Ordinance No. 1056 adopted July 8,
1901 also being known as Sections 150 and 151 of Ordinance. No. 1827 printed in Book Form and
adopted February 14, 1916.
Respectfully report that they have examined the matter and that.in their opinion the said
Ordinance should be reported Unfavorable. Grover D. Whiteman, Chairman. The report was accepter
by the Council.

The Ordinance was given its third reading by title, and was placed upon its passage and
was Lost by the following vote: Nelson., Whiteman, Rokop, Goetz, Hull, Jaworski,,Altfeld, Breni
Oakley, Fiwek, Cripe and Gustin voting AX Nay, Ayes 0, Nays 12. Ordinance Lost.

Motion of Councilman Cripe the Rules were suspended by the following
Rokop, Goetz, Hull,.Jaworski, Altfeld, Brennan, Oakley, Fiwek, Cripe
Naps 0._b Rules suspended and Ordinance goes to third reading.
THE Ordinance was given its third reading by title, and was pla

On Motion of Councilman Hull the Bond was accepted and approved by the Council. Motion carried

On Motion of Councilman Altfeld the Bond was accepted and approved. Motion carried._
Mr. Romig, City Attorney s explained to the-Council the question of appeal fro& the
Public Service Commission, finding and order on tfie Case of City of South Bend, Indiana
2 VS Northern Indiana Public Service Company, when the last date that was necessary in order,
to file their Appeal , which should be on or bmfoas before January 5th3, 1935. Xx.Counoilman
Cripe stated that as he has worked as a Member of the Utility Committee of the Council that
he felt that it would no good to file -an appeal at this time as itbwould involved more money
to be expended and .a, lot of time might be wasted, but if the City eared. to that.it could be
taken up at a latter time. Asbthere has not been anything in a legal way before the Council,
the question of appeal was: in no way answered, but Councilman Cripe thought it better that
the new Council should know the feeling the outgoing Council felt on this matter.
Remarks were next made by the 8n4cilmen and officials whose terms of office will expire
January let, 1935, also by the new Members of the Council,.CityClerk, Mayor and City Attorney.
On Motio# of Councilman Altfeld, the Council adjourned at 9;00 o'clock P. M.
