Councilman Hull were referred to the Committee on the Inspection and Superlision of Minutes.

COMMUNICATIONG
TO THE MAYOR AND THE COMMON.COUXCIL OF THE CITY*OF SOUTH BEND:
We, the undersigned, officers of the Western Avenue Improvement Association, of South
Bend, Indiana, do hereby respectfully urge upon you to accelerate activities with reference
to the elevation project on Western Avenue and-use every means within the power and purview of
your honorable body to-force the railroads to carry through the plan as agreed upon*
The owners of property along and near Western Avenue have already been heavily damaged
by the postponements and delays and can neither rent nor sell their properties because of the
indefiniteness surrounding the project
It is the sense of thts Association that an excellent and effective first step on the
part of the City of South Bend would-be strict enforcement of Section 272., Ordinance No' 966,
adopted May 13,18,95, regulating the_speed of trains withim the limits-of the City to not more

To the Common Council of the City of --8ii •.�.. - Your Committee of the Whole to whom was ref erred An Ordinance Ratifying, confirming and
appro wing a certain contract and agreement made and entered into by and between the City of
Soutly Bend, Indiana, by and-through its Board of Public Works, and the Pennsylvania Railroad
Company, which contract relates to the construction and maintenance and operation of a single "
track sidingmacross West Tutt Street in the City of South Bend, Indiana.` Respectfully report
that they have examined the matter, and that in their opinion the said Ordinance should be

of Taxicabs. Respectfully report that they have examined th4 matter, and that in their opinion

The Ordinance was given its third reading by title and was placed upon its passage and
passed by the following vote: Nelson, Whiteman, Rokop, Goetz, Hull, Jaworski, Altfeld, Hiss,
Oakley, Grzeskowiak,,SX42 and Gustin, Ayes ll, Nays 0" Ordinance adopted.'
ORDINANCE NO. 2980.1
An Ordinance Ratifying, Confirming and approving a certain contract and agreement made
and entered into by and between the City of South Bend, Indiana, by and through its Board of
Public Works, and the Pennsylvania Railroad Company, which contract relates to -the construction
and maintenance and operation of a single track siding across west Tutt Street in the City of
South Bend, Indiana"
The Ordinance was given its third reading by title, and was placed upon its passage
and passed by the following vote: Nelson, Whiteman, Rokop, Goetz, Hull, Jaworski, Altfeld,
Hiss, Oakley, Grzeskowiak and Gustin, Ayes ll, Nays 00` Ordinance adopted.'

An Ordinance appropriating the sum of Eleven Hundred Fifty -Two (41152.75) Dollars and
Seventy -five cents from the General Fund of the_City of South Bend, to the Finance Department
of said City Sub -Head B-&a for Payment of Legal advertising.`
The Ordinance was given its first reading by title, its second reading in full and on
Motion of Councilman Jaworski was referred to the Committee of the Whole, also that a Public
Hearing be held April 11th, 1932 at 7 :30 o'clock P: M. Motion carried:

An Ordinance providing for the Disbursement of the Monies Received by the City of South
Bend from the State of Indiana forthe Gasoline Tax:
The Ordinance was given its first reading by title, its second reading in full and on
Motion of Councilman Hiss was referred to the Committee of the Whole. Motion carried.

The Polish - American Central Civic Committee, representing 63 duly organized societies in
the West,City Community of this city, assembled in a special plenary session Tuesday evening,
March 15, in the Falcon hall, 1105 Western:Avenue, has adopted without a dissenting vote the.
following resolution:
WHEREAS: The New York Central ra -11road has wilfully broken its may prftises and
assurances and a duly signed and ratified contract with the City of South °Bend and broken faith
with the people of thesaid city with regard.to the extension of its track elevation on the West
Side,'to be started March 1st, pleading inability to obtain funds for financing the project
without making an honest attempt to seek such loan; and ( See page 132)

WHEREAS, this` new delay, which is ohly another in a series of may other previous
dilatory moves, comes after the city, acting in good faith and according to the letter of
the contract, has already expended almost $200,000 and issued bonds for $400,000 to cover
the costs of improvements necessary to faciliate the removal of the Western Avenve— Walnut.

in the entire proceeding, after the txxcity has exhausted all pacific means of meeting the
New York Central officials on common ground

effectall such ordinancea� and such police power at its`disposa� for regulating the speed.of
