GAMMON Clerk ORDINANCE NO. 6388 -78 AN ORDINANCE AMENDING VARIOUS EXISTING SECTIONS OF CHAPTER 20 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND AND BY THE ADDITION OF ARTICLE 9 MOBILITY HANDICAPPED PARKING STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that many of the concerns of mobility handicapped persons have not been adequately addressed. The Council believes that the City should take all necessary steps to protect and ensure that mobility handicapped persons have the opportunity to live and work in a community which recognizes their difficulty in travel. The Council further believes that it is in the best in- terest of the community to provide a procedure through the Board of Public Works that authorizes it to designate parking spaces for the exclusive use of mobility handicapped persons. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20, Article 1, Section 20 -2 Defini- tions of the Municipal Code of the City of South Bend is hereby amended by the addition of the following subsections: (12a) or all restri Handicapped Parking. A person who has been issued Disabled Veteran Registration Plates, or Special Regis- tration Plates, or a South Bend Handicapped Parking Permit. SECTION II. Chapter 20, Article 1, Section 20 -3 of the Municipal Code of the City of South Bend is hereby amended to read as follows: 20 -3. Authority of the Board of Public Works and- Safety. (a) The Board of Public Works and - Safety shall have authority: (1) One Way Streets. To designate certain streets and alleys or parts thereof which are to be used by vehicles traveling in only one (1) direction; (2) Parking Restrictions. To designate certain streets and alleys, or parts thereof, where parking is prohibited at all times, where parking is restricted to a specified maximum time, during specified hours of the day and week, where parking is restricted to authorized emergency vehicles (to be known as "emergency zones "), where parking is restricted for mobility handicapped persons (to be known as "Handicapped Parking "), where parking is restricted to temporary stopping and standing for loading and unloading purposes only (to be known as "Loading zones "), where parking is prohibited during certain hours of the day, or days, or portions thereof, of the week, where parking is limited to taxicabs (to be known as "taxicab stands ") and where parking is limited to busses (to be known as "bus loading zones "); (3) Through Streets. To designate preferential or "through" streets; (4) Safety Zones. To designate safety zones; (5) Limited Parking. To prohibit or limit parking, stopping or standing by commercial vehicles in designated areas and /or at designated hours of days, or portions of days of the week; (6) Crosswalks. To designate crosswalks; (7) Traffic Control Devices. To place or erect, appropriate official traffic control devices at designated places so as to place in effect actions taken pursuant to the authority granted by this Section. (8) No Parking Zones. To designate portions of cer- tain streets and alleys at and near the approaches to intersections and other congested or dangerous areas where parking shall be prohibited for purposes of safety and the expediting of the flow of traffic; (9) Parking Meters. To enter into any contract for the rental, purchase, acquisition, installation, regulation, use, operation, maintenance, repair, servicing and supplying of parts and replacements of parking meters as may be necessary, and to provide payment therefore exclusively from the funds, receipts and revenues obtained by the City from the operations and use of parking meters without in any way obligating the City to pay for the equipment from funds derived from any other source. The Board of Public Works and-Safety is further authorized and empowered to enter into a contract for the carrying into effect the purposes and intent of this; (10) Parking Time Limits. To regulate and determine the parking time limits to be established for each parking metered zone; (11) Speed Regulations. To determine and declare certain speed regulations. SECTION III. Chapter 20 of the Municipal Code of the City of South Bend is hereby amended by the addition of Article 9 entitled Mobility Handicapped Parking; and shall read in its en- tirety as follows: ARTICLE 9. MOBILITY HANDICAPPED PARKING. SEC. 20 -110. A person who has been issued a Handicapped Parking Permit by the City bearing the Permit Number, Permit Holder's Name, signature of the'au- thorizing city official(s), and the official international wheel- chair symbol or a reasonable facsimile thereof, shall be entitled to all of the parking privileges authorized by this article. SEC. 20 -111. Application and Permit Process (a) Any person, for or on behalf of any mobility handicapped person who does not have DisabIled Veteran Registration Plate(s) or Special Registration Plate(s) may file an application for a South Bend Handicapped Parking Permit with the Board of Public Works. (b) Said application shall be provided by the City Con- troller's office and shall "request the following: (1) The legal name of the mobility handicapped person. (2) The present address and.telephone number of the mobility handicapped person. (3) Written certification from a licensed physician stating that (a) the mobility handicapped person has permanently lost the use of a.leg or both legs or an arm or both arms or any combination thereof; or (b) the mobility handicapped person presently suffers from a disability resulting in a physical con i- tion that precludes him from being able to walk more than two city blocks and that this condition shall last for the duration o the present calendar year. (4) The year(s), make(s), and license plate numbers) of the vehicle(s) which would displav the permit. (c) Within.thirty (30) days of filing a completed appli- cation form with the Board of Public Works, the Board shall in- struct the City Controller's Office to issue a South Bend handi.- capped Parking Permit to the applicant if it is found that the material facts of the application are true. (d) Upon the issuance of such permit, by the City Controller's office, the permit shall be displayed in the front windshield of the driver's side by the permit holder. (e) Any permit issued pursuant to this Article shall expire on December 31st of the vear issued. SEC. 20 -112. Designation of Handicapped Parking Spaces (a) Any person on behalf of any mobility handicapped person or authorized group organization representing the handicapped may request the Board of Public Works to designate a space or spaces for Handicapped Parking. In At Large this pursuit, however, it has become very apparent that parking is a problem for our mobility handicapped persons. There are state laws which address this problem to a degree. However, they only provide assistance in metered areas. As you are aware, by mid -summer most of our parking meters will be removed; thus giving no assistance whatsoever to the mobility handicapped persons. Consequently, I am introducing a bill which would enable the Board of Public Works to designate certain "blue curb" areas to be used exclusively for the mo- bility handicapped person. I believe the bill is another positive step to enable all of our citizens to participate freely in our community. I seek your support. Thank you.
