AN ORDINANCE APPENDING CHAPTER 20, ARTICLE 3,
COMMONLY KNOWN AS THE ABANDONED VEHICLE
ORDINANCE
STATEMENT OF PURPOSE AND INTENT
The Common Council of South Bend recognizes that abandoned
vehicles on private property are a scenic blight and hereby declares
them to be a public nuisance. The purpose and intent of this
Amendment is to extend the City's authority to remove and dispose
of such vehicles.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. Chapter 20, Article 3 of the "1unicipal Code of
the City of South Bend, Indiana, is hereby amended as follows:
ARTICLE 3. ABANDONED VEHICLES.
Sec. 20 -27 Legislative Findings; Nuisance Declared; Public
Agency Designated; Revolving Fund Established.
(c) The Board of Public Wevke Safety is hereby designated the
public agency responsible for the removal, storage, and disposal of
abandoned and junk vehicles. Said Board may enter into contracts
with private towing firms, scrap processors, or auto wreckers to
provide the equipment and facilities for removal and disposal.
Sec. 20 -23 Definitions.
(5) Any vehicle from which there has been removed the engine or
transmission or differential or which is otherwise partially dis-
mantled or inoperable and left on public property, or left unattended
on private property in a location visible from public property.
( 7) Any vehicle that is over five (5) .years old and mechanically
inoperable, and is left unattended on private property in a location
which is visible from public property for more than thirty 30 days.
SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the
Mayor, and le gal publication.

Dear Members:
As you may recall, in April of this year I had
introduced a bill to amend the Municipal Code
for the purpose of enacting a more effective
means of disposing of abandoned vehicles in the
City. Your favorable action on this measure is
greatly appreciated.
I am now proposing an amendment to that ordinance
which will even further strengthen the City's
authority to dispose of abandoned vehicles left
on private property. It is my understanding
that "junk" vehicles left on private property
in residential areas present a general nuisance
to our citizens. This bill would help eliminate
the "scenic blight" caused by such vehicles in
our neighborhoods.
For this reason, your approval of this measure
is most greatly appreciated.
