AN ORDINANCE AMENDING ORDINANCE NO. 4990, -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which
ordinance is commonly known as the Zoning Ordinance of the City
of South. Bend, Indiana, be and the same hereby is amended in order
that the zoning classification of the following described real estate
in the City of South Bend, St. Joseph County, State of Indiana:
LOT "At'
A part of Lot 2 of Chippewa Minor Subdivision, City of South Bend,
St. Joseph County, Indiana, more particularly described as follows:
Beginning at. the NE corner of said Lot 2; thence S 06 011100" W along
the East line thereof 117.69 feet; thence S 90 000'00" W 337.86 feet
to the West line of said Lot; thence N 04046140" E along said West
line 117.41 feet to the North line of said lot; thence N 90 000100" E
along said North line 340.75 feet to the place of beginning.
LOT "B"
A part of Lot 2 of Chippewa Minor Subdivision, City of South Bend,
St. Joseph County, Indiana, more particularly described as follows:
Beginning at a point on the East line of said Lot 2, 117.69 feet
South of the NE corner thereof; thence S 06 011100" W along said East
line 181.06 feet; thence S 90 000'00" W 333.40 feet to the West line
of said Lot; thence N 04 046'40" E along said West line 180.63 feet;
thence N 90000100" E 337.86 feet to the place of beginning.
LOT "C"
A part of Lot 2 of Chippewa Minor Subdivision, City of South Bend,
St. Joseph County, Indiana, more particularly described as follows:
Beginning at a point on the East line of said Lot 2, 298.75 feet
South of the NE corner thereof; thence S 06 011100" W along said
East line 231.09 feet to the SE corner of said Lot 2; thence
N 89 030143" W along said South line 327.49 feet to the SW corner
of said Lot; thence N 04 046140" E along the West line thereof
227.76 feet; thence N 90 000100" E 333.40 feet to the place of
beginning.
All of the above three parcels are situated between South Main Street
and South Michigan Street in South Bend, Indiana. The northeast
corner of Lot No. 2 of Chippewa Minor Subdivision is located 295 feet
South of the southeast corner of the intersection of Chippewa Avenue
and South Main Street in South Bend, Indiana.

We,: the undersigned, make application and petition the
Common Council of the City of South Bend, Indiana, and the Area Plan
Commission of St. Joseph County, Indiana, to amend the Zoning Ordinance
of the City of South Bend, Indiana, as herein requested.
(1) The property sought to be rezoned is located between
South Main Street and South. Michigan Street in South Bend, Indiana,
and commences at the Southend of the Lucky Steer property being
approximately two hundred ninety -five (295) feet South of the
Southeast corner of the intersection of Chippewa Avenue and
South Main Street, and extending Southerly for a distance of
approximately five hundred twenty -five and 80/100(525.80) feet.
(2) Name of property owners:
J. Frank Hartwig, Shirley M. Hartwig, James
P. Locker and Margaret Locker

(3) It is desired and requested that this property be
rezoned from a B- Residence District to a C- Commercial District.
(4) This rezoning is requested so as to allow the

District, such as a fast food restaurant operation.
(5) Attached is a copy of (a) legal description of the
property; (b) a list of names and addresses of all property owners
within 300 feet of the petition property; (c) a site plan; and
(d) self - addressed, stamped envelopes of all property owners within
300 feet of the petition property.
