(,3(0S -)S AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 5, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND BY THE ADDITION OF SECTION 2 -60 ENERGY CONSERVATION COMMISSION STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes the need to devise and implement a comprehensive energy conservation program. The Council believes that local governments should play an important role in pioneering energy efficient procedures in the hope of conserving our dwindling natural resources. The Council believes that the creation of an Energy Conser- vation Commission would be able to effectively coordinate energy conservation programs and policies which would serve the public interest and act as a model to other governmental units. Therefore, in the interest of using our natural resources in a more efficient manner and in furthering the health, safety and welfare of our community, the following bill is introduced. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 5 of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the addition of Section 2 -60 which shall read in its entirety as follows: SEC. 2 -60, ENERGY CONSERVATION COMMISSION (a) Legislative Findings. The South Bend Common Council hereby finds that a strong energy conservation program is needed to meet the present and future energy needs of our community. (b) Establishment. It is hereby declared that the estab- lishment of an Energy Conservation Commission is in the public in- terest of the City of South Bend. (c) Composition. The Commission shall be composed of fif- teen (15) members, nine (9) of whom shall be appointed by the Coun- cil, and six (6) of whom shall be appointed by the Mayor. The Commission shall be broadly representative of the community. Each member shall have either a professional interest or background in the area; or have a sincere interest in the goals and objectives of energy conservation. (d) Terms of Members. The members of the Commission shall serve three -year terms as members; however the first commission shall have one -third of its membership appointed for a three -year term, one -third for a two -year term, and one -third appointed for a one -year term. The first commission shall have two (2) members selected by the Mayor for each of the one, two, and three year terms; and the Council shall select three (3) members for each of the one, two and three year terms. (e) Compensation; quorum. All members of the Commission shall serve without compensation and any eight (8) members shall constitute a quorum. (f) Organization. Within two (2) weeks after the effec- tive date of this ordinance, all members shall be appointed. Within forty -five (45) days after all of the members have been appointed as herein provided, they shall hold a meeting to se- lect a chairman, vice - chairman, and secretary. At the first meeting of every calendar year thereafter, such officer shall be selected in the same manner. (g) Meetings. The Commission shall meet not less than four (4) times per year at the call of the Chairman. (h) Purpose and specific powers. The purpose of the Com- mission shall be to develop and encourage energy conservation programs and policies. In carrying out this purpose, the Com- mission may exercise the following powers: (1) To advise the City Administration and the Common Council on efficient uses of present and future sources of energy by developing: (a) long - range energy conservation plans, and (b) emergency energy plans. (2) To review the energy plans in each department, bureau, and other sub - divisions of the City. (3) To make information available on energy con- servation to the industrial, commercial, residential, business, governmental, recreational, and transpor- tation areas of our community. (4) To act as a clearing house for activities and information related to energy conservation. (5) To develop and recommend legislation which would foster the conservation of energy. (6) To stimulate awareness and promote public par- ticipation in energy conservation programs. (7) To obtain necessary data and information from the various departments, bureaus, and other sub -divi- sions of the City in order to exercise its powers. SECTION II. Severability. If any provisions of this ordi- nance are held invalid, such invalidity shall not affect other pro- visions or applications which can be given effect without the in- valid provision or application and to that end, the provisions of this ordinance are declared to be severable. SECTION III. This Ordinance shall be in full force and ef- fect from and after its passage by the Common Council, approval by the Mayor, and legal publication. FRANK HORVATH At Large We have found that although local governments are only a small part of the energy picture, they can play a major role in pioneering energy efficient procedures. Furthermore, through general leadership and technical assistance to smaller energy users, local government can become a significant force in helping the community conserve its scarce energy. In order to make our City's operations more energy efficient and to provide continuing local leadership in energy conservation, I am introducing the attached bill. This bill would create an Energy Conservation Commission made up of fifteen members. It would create the vehicle which is necessary to begin making positive efforts to- ward energy conservation.
