AN ORDINANCE AMENDING CHAPTER 2,
ARTICLE 5, SECTION 2 -57 COMMISSION
ON STATUS OF WOMEN OF THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND
STATEMENT OF PURPOSE AND INTENT
Members of South Bend Commission on the Status of Women have
recommended that certain amendments be made to their existing ordi-
nance. The Commission believes that such amendment would facilitate
its overall working operation.
Therefore, in the interest of improving the governing law
of the Commission on the Status of Women, the following bill is
introduced:
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana; as follows:
SECTION I. Chapter 2, Article 5, Section 2 -57 (c) of the
Municipal Code of the City of South Bend, Indiana, is hereby amended
to read in its entirety as follows:
(c) Filling Vacancies. Successors to all members of
the Commission shall be appointed for terms of three (3)
years except when appointed to fill a vacancy in which
case such appointment shall be for the unexpired term.
SECTION II. Chapter 2, Article 5, Section 2 -57(e) of the
Municipal Code of the City of South Bend, Indiana, is hereby amended
to read as follows:
(e) Compensation; quorum. All members of the Commission
shall serve without compensation and ely- tee - X19 } -ees
a majority of the membership shall constitute a quorum.
SECTION III. Chapter 2, Article 5, Section 2 -57(g) of the
Municipal Code of the City of South Bend, Indiana, is hereby amended
to read as follows:
(g) Concurrence of majority required for action. It shall
take the concurrence of a majority of the Commission
membership eight (8) to take official action.
SECTION IV. Severability. If any provisions of this ordinance
are held invalid, such invalidity shall not affect other provisions
or applications which can be given effect without the invalid pro-
vision or application, and to that end, the provisions of this
ordinance are declared to be severable.
SECTION V. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the
Mavor, and legal publication.

Dear Roger,
The South Bend Commission on the Status of Women
would like to request a review of Ordinance = 5690 -74,
passed June 24, 1.974, to be amended in order to facilitate
the work of the Commission.
Section I, subsection (e) reads: "All members of the
Commission shall serve without compensation and any ten
members shall constitute a quorum ". In review, this quorum
requirement seems to be presenting an unnecessary hardship.
For a number of months over the past couple of years the
Commission has operated with less than the full complement
of members, one or two vacancies being not uncommon. For
this and other reasons, we request the. following change to
bring our quorum requirements more in line with other city
commissions: Section I, subsection (e) be amended to read
"All members of the Commission shall serve without
compensation and a majority of the members shall constitute
a quorum".
Section I, subsection (g) reads: "It shall take the
concurrance of a majority of the Commission membership
to take offical action ". For the same reason as cited
above, we request that this subsection -be amended to read:
"It shall take the concurrence of a majority of the
Commission members present to take official action ".
In addition we would like to add subsection (h) to
Section I to read as follows: "No individual shall be
appointed for more than three consecutive terms."

SECTION I. Delete - However, no individual shall be
appointed for more than three (3) con-
secutive terms.
SECTION III. After membership add eight (8) to take official
action.
