AN ORDINANCE OF DETERMINATION FOR SALE OF
CERTAIN REAL ESTATE OWNED BY THE CITY OF
SOUTH BEND FOR PARK PURPOSES
STATEMENT OF PURPOSE AND INTENT:
After due consideration and deliberation, the Board of Park Commissioners of
the City of South Bend, Indiana does determine that the real estate hereinafter
described is no longer suitable or required for park purposes and is an excess
of real property and available for disposition.
The Board of Park Commissioners of said city deems advisable that the real
estate hereinafter described be sold and disposed of to the advantage and best
interest of the City of South Bend, Indiana and the proceeds of such sale shall
be credited to the Department of Public Parks pursuant to State Statute.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. That the City of South Bend, Indiana sell and convey
the following real estate in Saint Joseph County,
Indiana, to wit:
A parcel of land being a part of the West Half of the Northwest Quarter
of Section 14, Township 38 North, Range One East, Warren Township, St.
Joseph County, Indiana and being more particularly described as follows,
viz:
Beginning at a point on the West line of said Section 14, a distance of
665.12 feet South 0 °- 00' -00" West (Bearing Assumed) of the Northwest
corner of said Section 14; thence North 90 °- 00' -00" East, a distance of
250.00 feet; thence South 0 °- 00' -00" West, parallel with said West line
of Section 14, a distance of 160.00 feet; thence South 90 °- 00' -00" West,
a distance of 250.00 feet to said West line of Section 14; thence North
0 °- 00' -00" East, along said West line, a distance of 160.00 feet to the
place of beginning containing 0.918 acres, more or less.
Subject to the legal rights of a public highway and any easements, cov-
enants or restrictions of record.
Section 2. That after passage of said ordinance by the Common Council
the Board of Public Works, City of South Bend, Indiana shall

Dear Mr. Parent:
After some confusion, in our first attempt to sell city owned property, at Elbel
Golf Course, I believe now we have the correct procedures in disposing of park
real estate.
In conferring with the Park Board Attorney and the attorney for the Board of Public
Works, it was determined that the Park Board must submit an ordinance to the Common
Council for its approval. If approved by the Common Council, the land would be
sold by the Board of Public Works as other city land is sold.
The tract we are requesting to sell at Elbel Golf Course was purchased in 1961 to
be used for the Elbel Golf Course construction. Only the back portion of the tract
of land was needed for the golf course construction, thus, leaving a story and one -
half frame house and approximately an acre of land not needed for the golf course.
During the last sixteen years, the home has been rented and the money deposited in
the Park General Fund. Because of high maintenance costs, budget limitations and
the fact the Park Department does not want to be in the housing business, we are
requesting the land be sold. Funds from the sale will be deposited in the Park
General Fund and cannot be spent until appropriated by the Common Council.
