Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in
City Hall on Tuesday, December 12, 1967 at 12:17 A.M., with all members present except Councilman Muszynski.
The meeting was called to order by President John L. Hunter, Jr., who presided.
ROLL CALL
PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak,
Laven and Smith
ABSENT: Councilman Muszynski
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend, Indiana:
Your Committee on the inspection and supervision of the minutes would respectfully report that they have
examined the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

PETITION
I, the undersigned, do hereby respectfully make application and petition the Common Council of the City of
South Bend to amend the Zoning Ordinance of the City of South Bend, Indiana as hereinafter requested, and in
support of this application, the following facts are shown:
1. The property sought to be rezoned is located at the Southwest corner of the intersection of Jefferson
Boulevard and Eddy Street being: 194.79 feet East and West along the South line of Jefferson Blvd.
and 185 feet North and South along the West line of Eddy Street.
2. The property is owned by 1149 Corporation, an Indiana corporation, 628 Sherland Building, South Bend, Indiana.
3. A legal description of the property is as follows:
A part of Large Lot 20 as shown on the recorded Plat of Samuel L. Cothell's First Addition to
the Town of Lowell, now the City of South Bend, which part is bounded as follows:
Beginning at the Northeast corner of said Lot No. 20; thence West on the South line of Jefferson
Boulevard a distance of One Hundred Ninety -four and Seventy -nine hundredths (194.79) feet; thence
South on a line parallel with the West line of Eddy Street a distance of One Hundred Eighty -five
(185) feet; thence East on aline parallel with the South line of Eddy Street a distance of One Hundred
Ninety -four and Fifty -three Hundredths (194.53) feet to the West line of Eddy Street; thence North along
the West line of Eddy street a distance of One Hundred Eighty -five (185) feet to the place of beginning.
4. It is desired and requested that the foregoing property be rezoned:
From B Residential Use and C Height and Area District.
To C Commercial Use and A Height and Area District.
5. It is proposed that the property will be put to the following use and the following buildings will be

7. Attached is a copy of: a.) an existing plot plan showing my property and other surrounding properties;
b.) names and addresses of all the individuals, firms or corporations owning property within 300
feet of the property sought to be rezoned; c.) site development plan.

Councilman Allen made a motion that the petition be referred to the Area Plan Commission. Councilman Szym-
kowiak seconded the motion. Motion carried.

KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Location: N. Line of first
alley N. of E. Jefferson at intersection with Logan). "
Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the
Council as unfavorable.

Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the
Council as unfavorable.

OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA (Location :S.V Corner Ironwood and Ridgedale).
Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the
Council as favorable.

U -21 "COMMUNICATION AND TRANSPORTATION" IN THE AMOUNT OF $2,500.00 AND TO ACCOUNT U -22, "HEAT, LIGHT,
SEWAGE AND WATER ", IN THE AMOUNT OF $6,200.00 AND THE TRANSFER OF SAID SUMS FROM ACCOUNT U -71 "BUILDINGS,
STRUCTURES AND IMPROVEMENTS" AND ACCOUNT U -72 "EQUIPMENT ", IN THE CENTRAL SERVICES BUILDING BUDGET, ALL
BEING IN THE GENERAL FUND ".
Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the
Council as favorable.

The Ordinance was given third reading and defeated by a roll call vote of 8 nays, (Councilmen Hunter, Allen,
Palmer, Wise, Geib, Szymkowiak, Laven and Smith), 0 ayes, 1 absent (Councilman Muszynski).

The Ordinance was given third reading and defeated by a roll call vote of 8 nays, (Councilmen Hunter, Allen,
Palmer, Wise, Geib, Szymkowiak, Laven and Smith), 0 ayes, 1 absent (Councilman Muszynski).
ORDINANCE NO. 4963 -67
AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40

The Ordinance was given third reading and passed by a roll call vote of 8 ayes, (Councilmen Hunter, Allen, Palmer
Wise, Geib, Szymkowiak, Laven and Smith), 0 nays, 1 absent (Councilman Muszynski).
ORDINANCE NO. 4964 -67
AN ORDINANCE FOX ADDITIONAL APPROPRIATIONS TO ACCOUNT U -21
"COMMUNICATION AND TRANSPORTATION" IN THE AMOUNT OF
$2,500.00 AND TO ACCOUNT U -22, "HEAT, LIGHT, SEWAGE AND
WATER ", IN THE AMOUNT OF $6,200.00 AND THE TRANSFER OF SAID
SUMS FROM ACCOUNT U -71 "BUILDINGS, STRUCTURES AND IMPROVE -
MENTS" AND ACCOUNT U -72, "EQUIPMENT ", IN THE CENTRAL SERVICES
BUILDING BUDGET, ALL BEING IN THE GENERAL FUND.
The Ordinance was given third reading and passed by a roll call vote of 8 ayes, (Councilmen Hunter, Allen,
Palmer, Wise, Geib, Szymkowiak, Laven and Smith) 0 nays, 1 absent (Councilman Muszynski).
NEW BUSINESS
Councilman Laven moved that the next meeting, which if held would fall on a legal holiday, be cancelled.
Councilman Geib seconded the motion. Motion carried.
Councilmen Hunter, Allen, Geib, Szymkowiak, Laven and Smith each expressed their pleasure at having been
associated with the other members of the Council, and having been given the opportunity to serve the
City in the capacity of Councilman, during the past four years.
There being no further business to come before the Council, Councilman Laven made a motion to adjourn.
Councilman Wise seconded the motion. Motion carried. Time: 12 :30 A.M.
