HomeMy WebLinkAbout11-13-67 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THE wunyE t FTING NOVEMBER 13, 1967 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in City Hall, on Monday, November 13, 1967, at 8:00 P.M., with all members present except Councilmen Palmer and Muszynski. The meeting was called to order by Chairman Edwin T. Smith, who presided. Chairman Smith introduced Reverend Gary Hesser, First Christian Church, who gave the invocation. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63. (Location: N.W. Corner of Bendix and Elwood). This being the time heretofore set for public hearing on the above Ordinance, proponents and ® oponents were given an opportunity to be heard thereon. Public hearing had been continued from the meeting of October 9, 1967. The following report from the Capital Improvement Committee was read by Councilman Janet S. Allen: To the Common Council of the City of South Bend: Your Committee on Capital Improvements to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND-ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63 (Location: N.W. Corner of Bendix and Elwood). Respectfully report that they have examined the matter and that in their opinion the Ordinance is hereby recommended unfavorably by a 3 to 2 vote of the Committee. The following points were reviewed: 1. South Shore Railroad delivery of lumber: No set time could be established for delivery. 2. Status of FHA financing of houses in the area: Probably only 40% on houses, as against the normal. 90% 3. South Bend Code on treatment of stored lumber: Non - combustion treatment is required in #1 Fire Zone, once a year. There is always a fire hazard. No written report, as requested, was received from Mr. Dillon. 4. Check out Real Estate values: "Doubt as to whether it would either help or hurt ". 5. Possibility of rats and vermin: No more infestation than in any other industrial operation. js/ Janet S. Allen, Chairman The report was accepted, as read, and placed on file. Councilman Hunter then read a communication from Mr. Robert Craft, Executive Director of the Indiana Building and Supply, in which Mr. Craft expressed doubt as to whether any rats would infest an area such as that proposed in the ordinance. Speaking in favor of the Ordinance was Gerald Feeney, attorney for the petitioner. Speaking against the Ordinance were: Edward Kalamaros, Attorney, representing nearby property owners who are not in favor of the Ordinance; George Flake, 1508 N. Iowa St; Elaine Flake, 1508 N. Iowa St.; Stanley Klabor, 1609 N. Iowa St.; and Joseph Meyer, 1512 N. Iowa St. Councilman Geib made a motion to recess. Councilman Laven seconded the motion. Motion carried. Time: 8:30 P.M. Reconvened: 8:40 P.M. Councilman Hunter made a motion that public hearing be continued until November 27, 1967, at which third reading would be given the Ordinance. Councilman Arlen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE DETERMINING THAT IT IS NECESSARY FOR THE CITY OF SOUTH BEND TO CONDEMN CERTAIN REAL ESTATE FOR THE USE AND BENEFIT OF "MEMORIAL HOSPITAL OF SOUTH BEND ", AND THAT THE ACQUISITION OF SAID REAL ESTATE IS NECESSARY FOR THE EXPANSION OF SAID HOSPITAL. 4 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance were: Bruce Hammerschmidt, attorney, and member of the Board of Directors of Memorial Hospital and Richard Trenkner, Memorial Hospital Administrator. Speaking against the Ordinance was Joseph V. Simeri, Attorney, representing the owners of the property in question. Councilman Laven made a motion to recess. Time: 9 :45PM.Reconvened 10:15 P.M. Councilman Geib made a motion that a special session of the Council be called for Monday, November 20, 1967, at 8:00 A.M., at which time public hearing would be continued and third reading given the Ordinance. Councilman Hunter seconded the motion. Motion carried. I� COMMITTEE OF THE WHOLE MEETING — NOVEMBER 13, 1967 ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATION TO ACCOUNT Q -26, "OTHER CONTRACTUAL SERVICES ", IN THE AMOUNT OF $2,500.00 AND THE TRANSFER OF THE SAME FROM ACCOUNT Q -11, "SERVICES PERSONAL ", ALL BEING IN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Cecil McHenry, Fire Chief. Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATION TO ACCOUNT E -21, "COMMUNICATION AND TRANSPORTATION" IN THE AMOUNT OF $150.00 AND THE TRANSFER OF THE SAME FROM ACCOUNT E -55 "SUBSCRIPTIONS AND DUES ", ALL BEING IN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance proponents and opponents were given an opportunity to be heard thereon. Explaining the need for the Ordinance, was James Bickel, City Controller. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried, (Councilmen Hunter, Wise,,:Geib , Szymkowiak, Laven and Smith), 1 nay (Councilman Allen), 2 absent, (Councilmen Palmer and Muszynski). There being no further business to come before the Committee of the Whole, Councilman Geib made a motion to rise and report to the Council. Councilman Laven seconded the motion. Motion carried.
