Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers
in City Hall on Monday, September 25, 1967, with all members present. The meeting was called to order
by John L. Hunter, Jr., President. Time: 8:00 P.M. President Hunter introduced Reverend Harley Dale
Collier, Westminster Presbytarian Church.
ROLL CALL
PRESENT Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven,
Smith and Muszynski
ABSENT None
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes would respectfully report that they have
examined the minutes of the previous meeting of the Council and found them correct. They therefore
recommend that the same be approved.

REPORT OF AREA PLAN COMMISSION
September 21, 1967

Gentlemen:
The attached rezoning petition of Rosbro Realty Corporation was legally advertised
under date of September 9 and 16 and given public hearing on September 19, 1967.
The following action was taken:
After due consideration it was moved, seconded, and unanimously
carried that the ordinance and site development plan be
recommended favorably to the Common Council.
Excerpts from the minutes of the Area Plan Commission hearing are hereby attached
and made a part of this report.

AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA (Location: 3220 E. Jefferson).
The Ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion •
that the Ordinance be set for public hearing on October 9, 1967. Councilman Geib seconded the motion. Motion j

The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that
the Ordinance be set for public hearing on October 23, 1967. Councilman Wise seconded the motion. Motion

ORDINANCE'
AN ORDINANCE AMENDING CHAPTER 40, SECTION 40 -14 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIAN$, 1962,
ALSO KNOWN AS ORDINANCE NUMBER 3702, ADOPTED BY THE COMMON
COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ON THE 14th
DAY OF OCTOBER, 1963, AND KNOWN AS THE ZONING ORDINANCE
IN THE CITY OF SOUTH BEND. (Location: LaSalle Park Area)
The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion
that the Ordinance be set for public hearing on October 9, 1967. Councilman Muszynski seconded the motion.
Motion carried.
RESOLUTION NO. 169 -67
A RESOLUTION FOR AN ADDITIONAL APPROPRIATION IN THE
"COMMUNICATION AND TRANSPORTATION" ACCOUNT OF THE
MORRIS CIVIC AUDITORIUM DEPARTMENT IN THE AMOUNT
OF $300.00 AND THE TRANSFER OF THE SAME FROM THE
"REPAIRS" ACCOUNT IN THE SAME CATEGORY, TO -WIT:
"SERVICES CONTRACTUAL ", AND ALL BEING IN THE
GENERAL FUND.
WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing
annual budget, so that it is now necessary to appropriate more money than was appropriated in the
annual budget for the various functions of City Government to meet such extraordinary contingencies; and,
WHEREAS, Additional funds for travel expenses are urgently needed by the Morris Civic Auditorium
to assure its ability to properly perform its function and the sum of $300.00 is needed forthwith; and
WHEREAS, A surplus exists in another account where it is not presently needed; and more specifically
as follows, to =wit:
1. Three Hundred Dollars ($300.00) in ACCOUNT K -25 designated as "Repairs ".
NOW, THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of
$300.00 be transferred from ACCOUNT K -25 designated as "Repairs ", by transferring it to the following
account, to -wit:
Three Hundred Dollars ($300.00) bo Account K -21 designated as "Communication and Transportation ",
both of said accounts being in the same category, to -wit: "Services Contractual" of the Morris Civic
Auditorium Department.

Speaking in favor of the Resolution was A. E. Tovey, Manager of the Morris Civic Auditorium. Councilman
Smith made a motion that the Resolution be adopted by a roll call vote. Councilman Laven seconded the
motion. Motion carried. The Resolution was adopted by a roll call vote of 9 ayes, (Councilmen Hunter,
Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski), 0 nays, 0 absent.
There being no further business before the Committee of the Whole, Councilman Wise made a motion to adjourn.
Councilman Geib seconded the motion. Motion carried. Time: 8:23 P.M.
