Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in
City Hall in Regular Session, Monday, June 12, 1967 at 8:46 P.M. All members were present except Councilmen
Hunter and Geib. The meeting was called to order by Vice- President John V. Wise, who presided.

To the Common Council of the City of South Bend:
Your Committee on Ordinances, to whom was referred "An Ordinance Regulating Solicitation of funds from Residents
of the City of South Bend and Providing Penalties Where Such Solicitation Has Been Fraudulently Conducted
or Represented ", caused a meeting to occur on the lst day of June, 1967 with Councilmen Laven and Allen in
attendance with Councilmen Geib, Hunter and Smith, of your committee plus Mrs. Sessler, Mr. Ledy and Attorneys
Noell and Wiseman present;

7. Page 3, Line 70, add the following paragraphs numbered 12 and 13, as shown:
12. Political Parties, as defined by Indiana law, their subdivisions,
and their bona fide candidates for public office are specifically
exempted from and shall not be subject to the provisions of this'
ordinance as the intent of the ordinance is to regulate the soli-
citation of charitable contributions.
13. Charitable Solicitations which raise less:than.$500.00 in total contributions
shall not be subject to the provisions of this ordinance.
8. Page 4, Line 5, strike the period which presently appears following the word appointment and
insert the following:
except that the first commission shall be appointed as follows: Three
of the members shall be appointed for a term of one (1) year; two shall
be appointed for a term of two (2) years; and two shall be appointed for
a term of three (3) years. Thereafter, all terms shall be for a period
of four (4) years as hereinabove provided.

Councilman Smith made a motion that the report be accepted, and the changes be made on the proposed
Ordinance before June 26, at which time the public hearing will be continued. Councilman Muszynski
seconded the motion. Motion carried.
REPORT OF COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole to whom was referred "AN ORDINANCE DETERMINING THAT IT IS IN THE PUBLIC INTEREST
TO ACQUIRE THE MASS TRANSPORTATION SYSTEM OF NORTHERN INDIANA TRANSIT, INC., WHICH SHALL BE A DISTINCT.MUNICIPAL
CORPORATION AND WHICH SHALL BE KNOWN AS "THE SOUTH BEND PUBLIC TRANSPORTATION CORPORATION" AND DEFINING
THE CORPORATE LIMITS OF SAID CORPORATION."
Respectfully report that they have examined the matter and that in their opinion the Ordinance go to I the Council
as favorable.
There being no objections, the report was accepted and placed on file.

ORDINANCE
AN ORDINANCE APPROPRIATING $8,000.00 FROM THE
GENERAL FUND TO ACCOUNT B -53, "REFUNDS, AWARDS
AND INDEMNITIES" IN THE OFFICE OF THE CITY
CONTROLLER.
The Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion
that the Ordinance be set for public hearing on June 26, 1967. Councilman Palmer seconded the motion. Motion
carried.

ORDINANCE
AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO
ACCOUNT P -265, CONTRACTUAL SERVICES IN THE AMOUNT
OF $389.00 AND THE TRANSFER OF THE SAME FROM
ACCOUNT P -11, "SERVICES PERSONAL" IN THE POLICE
DEPARTMENT ALL BEING IN THE GENERAL FUND.
The Ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion that
the Ordinance be set for public hearing June 26, 1967. Councilman Szymkowiak seconded the motion. Motion carried.
ORDINANCES, FIRST AND SECOND READING
ORDINANCE
AN ORDINANCE APPROPRIATING THE SUM OF $15,000 FROM
THE GENERAL FUND TO THE BUILDING, DEMOLITION, REPAIR
AND CONTINGENT ACCOUNT.
The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that
the Ordinance be set for public hearing June 26, 1967. Councilman Laven seconded the motion. Motion carried.
RESOLUTION NO. 156 -67
RESOLUTION AUTHORIZING THE FILING OF APPLICATION
WITH THE APPROPRIATE AGENCY FOR A GRANT UNDER THE
TERMS OF PUBLIC LAW 660.
WHEREAS, the City of South Bend is considering the construction of certain sewage works improvements; and,
WHEREAS, pursuant to public law 660 federal funds are available in the form of an outright grant for certain
stream pollution abatement projects; and,
WHEREAS, It is believed that the major portion of the sewage works improvements proposed by the City of
South Bend, Indiana, qualify for a federal grant.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
1. That an application for a federal grant for sewage treatment works construction be filed with the proper
agency to aid in financing the construction of the following improvements to the sewage treatment plant of the
City of South Bend, Indiana:
Sludge lagoon, improvements to existing chlorine contact tank, chlorination equipment, final chlorine .tank
and outfall, two new final tanks and improvements to three existing final tanks, aeration tanks and equipment,
gallery building and equipment, degritting and sludge thickening, improvements to digestors, miscellaneous items
such as sludge preheaters, drainage improvements to existing final tanks, finish effluent pumping.station, main
for plant cooling water and other uses, extension to existing grit building, new metering equipment in raw and
digested sludge lines, improvements to sludge drying beds, mechanized trash racks, enclosure of structures over
scum burner.
2. That the Mayor of-the City of South Bend, Indiana, be authorized to sign said application and such other
documents as may be necessary, including the offer and acceptance form.

Mr. Howard Goodhew, Water Works Superintendent spoke in favor of the Resolution. The Resolution was adopted
by a roll call vote of 6 ayes (Councilmen Palmer, Wise, Szymkowiak, Laven, Smith and Muszynski), 1 nay, (Councilman
Allen) 2 absent (Councilmen Hunter and Gelb.)

WHEREAS, God in his infinite wisdom, has called from this life,
WILLIAM E. MILLS, former attorney for the Area Plan
Commission,
WHEREAS, his untimely death has brought much grief and sorrow
to his bereaved family and many friends,
I NOW, THEREFORE, BE IT RESOLVED 'that we, the members of the
Common Council, hereby extend to Mrs. Mills,
and to the other members of the family our sincere
sympathy in this their deepest hour of sorrow; and
BE IT FURTHER RESOLVED that a page be set aside in the Council
Records in the City of South Bend and this Resolution
be copied thereon and a copy duly certified by the
Clerk be sent to Mrs. Mills and family.
