ET�NG Apr_ l 10, 1967 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of City Hall in Regular Session on Monday, April 10, 1967 at 8 :10 P.M., with all members present. The meeting was called to order by President John L. Hunter, Jr., who presided. Reverend Donald Guertin, Christ the King Church, gave the Invocation. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have examined the minutes of the preveious meeting of the Council and found them correct. Palmer Meeting of March 13, 1967 There being no objections; the report was accepted as read and placed on file. REPORT OF AREA PLAN COMMISSION March 22, 1967 The Honorable Common Council City of South Bend South Bend Indiana Gentlemen: The attached ordinance to zone "A" Residential Use and "A" Height and Area District approximately 40 acres located on the East side of York Road k mile South of Jackson Road was legally advertised under date of March 11 and 18 and given public hearing on March 21,, 1967. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the ordinance be recommended favorably to the Common Council. The deliberations of the Area Plan Commission are hereby attached and made a part of this report. Very truly yours, /s/ John K. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED (Location: East side of York Rd 1237.25 feet South of the center line of Jackson Rd. and commonly known as Southeast Estates. The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that the Ordinance be set for public hearing on April 24, 1967. Councilman Geib seconded the motion. Motion carried, 8 ayes, (Councilmen Hunter, Allen, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski) 1 nay,(Council- man Palmer). ORDINANCE, FIRST AND SECOND READING AN ORDINANCE REQUIRING THAT AGENCIES, ADMINISTRATIVE BODIES, AND COMMISSIONS OF THE CITY OF SOUTH BEND HOLD THEIR PUBLIC MEETINGS IN TAX SUPPORTED BUILDINGS OR IN BUILDING SPACE WHICH THE CITY OF SOUTH BEND HAS LEASED FOR CONDUCTING OF ITS OFFICIAL BUSINESS. The Ordinance was given first reading by title, President Hunter then recognized Councilman Allen who made_a mot that the Ordinance be withdrawn at this time with a letter to be directed to the Human Relations Fair Employment Practices Commission advising that they hold any future meetings'at their office, and that these meetings be publicly announced, giving the time and place. Councilman Geib seconded the motion.. Motion carried. ESE ORDINANCES, FIRST AND SECOND READING AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT XX 25, "REPAIRS OF EQUIPMENT" IN THE AMOUNT OF $5,000.00 AND THE TRANSFER IN THE SAME ACCOUNT XX72, "MOTOR EQUIPMENT" IN THE SANITATION DEPARTMENT ALL BEING IN THE GENERAL FUND. The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the Ordinance be set for public hearing on April 24, 1967. Councilman Allen seconded the motion. Motion carried. RESOLUTION RESOLUTION APPROVING PROGRESS REPORT UNDER THE WORKABLE PROGRAM FOR COMMUNITY IMPROVEMENT, AS AMENDED WHEREAS, a "Review of Progress Under the Workable Program for Community Improvement" was heretofore filed with the Common Council of the City of South Bend, which report is now before the Common Council, and WHEREAS, the approval of the Common Council to said progress report is required by the Department of Housing and Urban Development of the United Stated of America as a continuing requisite for the City of South Bend's eligibility to receive federal funds, and WHEREAS, the Common Council has examined said report and finds it to be a satisfactory report on the plans of the South Bend Redevelopment Department. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, that the report captioned "Review of Progress Under the Workable Program for Community Improvement be submitted for recertification. Dated and approved this 10th day of April, 1967. Js/ Walter M. Szymkowiak Member of the Common Council Speaking in favor of the Resolution was Howard J. Bellinger, Executive Director of the Urban Redevelopment Department. Questioning Mr. Bellinger about the Resolution were Councilmen Allen, Geib, Smith and Wise. They voiced their objections to the wording of the Workable Program, and to the fact that the report had been submitted to them at such a late date. Councilman Geib made a motion to recess. Councilman Laven seconded the motion. Motion carried. Time: 9:04 P.M. Reconvened: 9:09 P.M. Councilman Geib made a motion that the Resolution be amended in the second paragraph, line two; to read: "required ", instead of "acquired" ; Paragraph Three, line two: after the word "it" add the following words: "to be a satisfactory report on the plans of the South Bend Redevelopment Department "; Paragraph Four; line four: delete the following words: "and the same is hereby in all things ratified, approved and confirmed, and directed that it be ". Councilman Laven seconded the motion. Motion carried. Councilman Smith made a motion that the Resolution be adopted by a roll call vote. as amended. Councilman Laven seconded the motion Motion carried. The Resolution was adopted by a roll call vote of 9 ayes , (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays, 0 absent. NEW BUSINESS Councilman Muszynski inquired about damage done by snow plows to curbs in his district, during the snow storms this past winter. City Attorney, Robert J. DuComb answered that all claims for damages may be filed in the office of City Clerk. There being no further business before the Council, Councilman Geib made a motion to adjourn. Councilman Smith seconded the motion. Motion carried. Council adjourned at 9:15 P.M. ATTEST: I APPROVED: X11,
