Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of City
Hall in Regular Session on Monday, March 13, 1967 at 10:11 P.M., with all members present. The meeting was
called to order by President John L. Hunter, Jr., who presided.

PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib,
Szymkowiak, Laven, Smith and Muszynski
ABSENT: None
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have examined
the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the
same be approved.

REPORT OF COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole to whom was referred "AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL
FUND, FOR OFFICERS OF THE CITY OF SOUTH BEND TO BE ELECTED FOR THE TERM COMMENCING JANUARY 1, 1968 AND FIXING THE
TIME WHEN THE SAME SHALL TAKE EFFECT, AS AMENDED ".
Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as
favorable.

JANUARY 1, 1968 AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT, AS AMENDED

The Ordinance was given third reading and passed by a roll call vote of 5 ayes, .(Councilmen Hunter, Palmer,
Geib, Laven and Smith), 4 nays, (Councilmen Allen, Wise, Szymkowiak and Muszynski), 0 absent.

RESOLUTION NO. 153 -67
• RESOLUTION APPROVING A THIRD AMENDMENT TO
• CONTRACT BETWEEN THE SOUTH BEND CITY WATER
WORKS AND SEWAGE DISPOSAL PLANT AND CLAY
UTILITIES, INC. FOR FURNISHING OF WATER AND
SEWAGE TREATMENT TO THE CLAY TOWNSHIP AREA IN
ST. JOSPEH COUNTY, INDIANA
WHEREAS, the Board of Water Works Commissioners and the Board of Sewage Commissioners deem
it to be in the best interests of their respective facilities and to the City of South Bend to
amend an Agreement to furnish water and sewage services in Clay Township to Clay Utilities, Inc.
which Agreement was entered into on the 22nd day of March, 1965, and approved by Resolution No. 96 -65
of the Common Council of the City of South Bend on the 10th day of May, 1965.
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
that the contract entered into between the South Bend City Water Works and the sewage disposal
plant of the City of South Bend and Clay Utilities, Inc. dated the 22nd day of March, 1965
for the furnishing of water and sewage treatment to Clay Township, St. Joseph County, Indiana,
as three times amended, is hereby approved and confirmed; said third amendment being attached
hereto as an exhibit and made a part of this Resolution.

Speaking in favor of the Resolution was Robert Miller, Attorney. Councilman Wise made a motion
that the Resolution be adopted by a roll call vote. Councilman Geib seconded the motion. Motion
carried. The Resolution was adopted by a roll call vote of 9 ayes, (Councilmen Hunter, Allen, Palmer
Geib, Wise, Szymkowiak, Laven, Smith and Muszynski), 0 nays, 0 absent.
NEW BUSINESS
Councilman Szymkowiak called attention to the fact that a number of dogs have been seen running
at large, and expressed the hope that some future action would serve to alleviate the situation.
Councilman Muszynski recommended a survey of the railroad crossings, especially the one at Olive
and Sample St. City Engineer Lloyd Taylor stated that the Railroads had been notified of the
situations existing at the crossings, and asked to make temporary repairs. He further stated that
as soon as warmer weather prevails, the Engineering Department would make surveys and submit recommendations
to the railroads for improvements.
There being no further business before the Council, Councilman Wise made a motion to adjourn. Councilman
Allen seconded the motion. Motion carried. Timet 10:28 P.M.
