11 COMMITTEE OF THE WHOLE MEETING March 13, 1967
Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the
Whole in the Council Chambers in City Hall on Monday, March 13, 1967 at 8:00 P.M., with all members present.
The meeting was called to order by Chairman Edwhin T. Smith, who presided. Chairman Smith introduced Reverend
James J. Greer, Holy Trinity Episcopal Church /gaove the invocation.
ORDINANCE
AN ORDINANCE FIXING THE ANNUAL SALARIES,
PAYABLE FROM THE GENERAL FUND, FOR
OFFICERS OF THE CITY OF SOUTH BEND TO
BE ELECTED FOR THE TERM COMMENCING
JANUARY 1, 1968 AND FIXING THE -TIME
WHEN THE SAME SHALL TAKE EFFECT, AS AMENDED
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents
were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Lawrence De Freese,
818 E. Chippewa; Who:represented: the South Bend Chamber of Commerce. Don Carter, 918 S. Twyckenham Dr.,
representing the South Bend Civic Planning Association presented a letter to the Clerk recommending the
following salary proposals: Mayor, $20,500; Clerk, $10,800; Judge $12,000 and Councilman $3,000. Speaking
in remonstrance were Mussel Bairn, 3524 S. St. Joseph; Ray Mohlman, 132 E. Fox; Robert Silver, 1029 N.
Cleveland; Fanny Grunwald, 227 S. -francis;• Frank L. Kinyon, 418 E. Eckman; William Garrin, 631 W. Angela;
Steven McTeigue, 1113 Fairfax and Ruby McMahon, 406 E. South. Councilman Hunter made a motion to recess.
Councilman Geib seconded the motion. Motion carried. Time: 8:34 P.M. Reconvened: 8:54 P.M. Councilmen
Geib, Laven, Hunter and Palmer spoke in favor of the Ordinance. Councilman Szymkowiak spoke against the
Ordinance, and offered reduced amounts in each of the categories. Councilman Allen proposed a $20,500
figure for the salary of Mayor and was not in favor of the Clerk and Judge salaries being the same. Council-
man Allen did not support a raise for Councilman, either. Councilman Wise spoke against the $25,000 figure
for Mayor and proposed a $20,000 figure. Councilman Smith spoke in favor of the proposed amount for Mayor
but spoke against a raise for Councilman.
Councilman Szymkowiak made a motion to amend the Ordinance to reduce the amount of the proposed Mayor's salary
to $18,500.00. The motion was not seconded. Motion failed.
Councilman Allen made a motion to amend the Ordinance to provide $20,500.00 for the Mayor's salary. Councilman
Muszynski seconded the motion. Motion failed, 2 ayes, (Councilmen Allen and Muszynski), 7 nays, (Councilmen
Hunter, Palmer, Wise, Geib, Szymkowiak, Laven and Smith).
Councilman Wise made a motion to amend the Ordinance to read $20,000.00 for Mayor's salary. Councilman
Allen seconded the motion. Motion failed, 3 ayes,(Councilmen Allen, Wise and Muszynski) 6 nays, (Councilmen
Hunter, Palmer, Geib, Szymkowiak, Laven and Smith).
Councilman Geib then made a motion that the salary figure for Mayor remain as proposed in the Ordinance.
Councilman Hunter seconded the motion. Motion carried, 5 ayes, (Councilmen Hunter, Palmer, Geib, Laven and .Smith).
4 nays, (Councilmen Allen,, Wise, Szymkowiak and Muszynski).
Councilman Szymkowiak:. made a motion to set the salary for City Clerk at $9,500. There was no second to the
motion. Motion failed.
Councilman Laven made a motion to set the Clerk's salary at $10,800. Councilman Allen seconded the motion.
Motion failed 4 ayes, (Councilmen Wise, Allen, Laven and Smith), 4 nays.(Councilmen Hunter, Palmer, Szymkowiak
and Geib). Councilman Muszynski did not vote.
Councilman Muszynski made a motion that the salary figure for City Clerk remain the same as proposed in the
Ordinance. Councilman Hunter seconded the motion. Motion carried 6 ayes, (Councilmen Muszynski, Hunter,
Wise, Palmer, Allen and Geib), 3 nays,(Councilmen Laven, Szymkowiak and Smith)
Councilman Szymkowiak made a motion to set the salary for City Judge at $9,075. There was no second to the
motion. Motion failed.
Councilman Allen made a motion that the salary for Judge remain as proposed in the Ordinance. Councilman
Laven seconded the motion. Motion carried, 8 ayes, (Councilmen Hunter, Allen, Palmer, Wise, Geib, Laven, Smith
and Muszynski), 1 nay (Councilman Szymkowiak).
Councilman Szymkowiak made a motion that the salary for Councilman remain the same, with no raise. Councilman
Allen seconded the motion. Motion failed, 6 ne.ys, (Councilmen Hunter, Palmer, Wise, Geib, Laven and Muszynski).
3 ayes, (Councilmen Allen, Smith and Szymkowiak).
Councilman Geib made a motion that the salary for Councilman remain as proposed in the Ordinance. Councilman
Muszynski seconded the motion. Motion carried, 6 ayes, (Councilmen Hunter, Palmer, Wise, Geib, Laven and
Muszynski). 3 nays,:(Councilmen Allen, Laven and Szymkowiak)
Councilman Hunter made a motion that a line be added to the Ordinance, providing for an additional $480.00
in salary to be paid the President of the Council. Councilman Geib seconded the motion. Councilman Hunter
then made a motion for a recess. Councilman Geib seconded the motion. Motion carried. Time 9:50 P.M.
Reconvened: 10:05 P.M. City Attorney Robert J. Ducomb advised against the additional amount being added to
the Ordinance, because it had not been advertised previous to the public hearing. Councilman Geib then
withdrew his second to the motion and Councilman Hunter withdrew his motion.

Councilman Geib made a motion that the Ordinance go to the Council favorable, as amended. Councilman Hunter
seconded the motion. Motion carried, 5 ayes, (Councilmen Hunter, Palmer, Geib, Smith and Laven), 4 nays,
(Councilmen Allen, Wise, Szymkowiak and Muszynski).
There being no further business before the Committee of the Whole, Councilman Allen made a motion to rise and
report to the Council. Councilman Palmer seconded the motion. Motion carried. Time: 10 :10 P.M.
