HomeMy WebLinkAbout02-13-67 Council Meeting MinutesREGULAR MEETING Be it rememebered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of City Hall in Regular Session, Monday, February 13, 1967 at 8:21 P.M., with all members present. The meeting was called to order by President John L. Hunter, who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have examined the minutes of the previous meeting of the Council and found them correct. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63 (North side of Jefferson Blvd, more commonly known as 3000 E. Jefferson Blvd.) " Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as favorable. /a/ Edwin Thomas Smith, Chairman There being no objections, the report was accepted as read and placed on file. ;:ice .RE_�ULA�MEENG FEBRAURY 13 1967 REPORT OF AREA PLAN COMMISSION February 7, 1967 The Honorable Common Council City of South Bend, South Bend, Indiana Gentlemen: The attached rezoning petition of American Realty of South Bend, Inc. was legally advertised under date of Jan- uary 7 and 14, 1967 and given public hearing on January 17, 1967. The following action was taken: After due consideration it was moved, seconded and carried that the proposed ordinance and site development plan be recommended favorably to the Common Council subject to the review and approval of the site development plan by the City Traffic Engineer. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. ORDINANCE, THIRD READING ORDINANCE NO. 4909 -67 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63 (North side of Jefferson Blvd more commonly known as 3000 East Jefferson Blvd., South Bend, Indiana) The Ordinance was given third reading and passed by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Wise Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays, 0 absent. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 as HERETOFORE AMENDED AND SUPPLEMENTED AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63 (Location: Southwest corner of U.S. 31 and Angela Blvd) The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Palmer seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA CERTAIN LANDS AND PROVIDING, AFTER ANNEXATION SHALL TAKE EFFECT, THAT FOR A PERIOD OF THREE YEARS ONE -HALF (2) OF THE MUNICIPAL PROPERTY TAXES TO BE IMPOSED UPON THE ANNEXED TERRITORY SHALL BE IMPOUNDED AND PLACED IN A SPECIAL FUND SOLELY FOR THE BENEFIT OF THE ANNEXED TERRITORY. (Location: A tract of land bounded on the North by Ireland Road,on the West by U.S. 31 (South Michigan St.) on the South by U.S. 31 interchange and the Jackson High School property, on the East by Miami Road) The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE NO. 4910 -67 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAKING OF A TEMPORARY LOAN FOR THE GENERAL FUND AND THE ISSUANCE AND SALE OF WARRANTS OF THE CITY FOR SUCH PURPOSE. The Ordinance was given first reading by title and second reading in full. Councilman. Smith made a motion for suspension of rules. Councilman Wise seconded the motion. Motion carried by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski), 0 nays. City Controller, James A. Bickel spoke in favor of the Ordinance. The Ordinance was given third reading and passed by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Geib, Szymkowiak, Smith, Wise, Laven and Muszynski) 0 nays. i li li ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AUTHORIZING THE EXPENDITURE OF $44,017.90 BY THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA FOR PURCHASE OF WATER METERS FROM THE NEPTUNE METER COMPANY DURING THE CALENDAR YEAR 1967. The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion for suspension of rules. Councilman Wise seconded the motion. Motion defeated by a roll call vote of 7 ayes (Councilmen Hunter, Palmer, Wise, Geib, Szymkowiak, Smith and Muszynski) 2 nays (Councilmen Allen and Laven). Councilman Geib made a motion that the Ordinance be set for public hearing'on February 27,1967. Councilman Palmer seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AUTHORIZING THE EXPENDITURE OF $19,239.62 BY THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA FOR THE PURCHASE OF WATER METERS FROM THE HERSEY - SPARLING METER COMPANY DURING THE CALENDAR YEAR 1967. The Ordinance was given first reading by title and second reading in full. Councilman Laven made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Szymkowiak seconded the motion. Motion carried 8 ayes,(Councilmen Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski), 1 nay (Councilman Hunter). ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AUTHORIZING THE EXPENDITURE OF $20,194.80 BY THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA FOR THE PURCHASE OF WATER METERS FROM THE BADGER METER MANUFACTURING COMPANY DURING THE CALENDAR YEAR 1967. The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Szymkowiak seconded the motion. Motion carried, 7 ayes (Councilmen Allen, Palmer, Wise, Geib, Szymkowiak, Laven and Muszynski) 2 nays (Councilmen Hunter and Smith). ORDINANCES, FIRST AND SECOND READING ORDINANCE NO. 4911 -67 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND STEVENS CO. - DIVISION OF ASHLAND OIL AND REFINING CO. FOR PURCHASE OF A SUPPLY OF LIQUID CHLORINE FOR USE FROM FEBRUARY 7, 1967 . TO FEBRUARY 7, 1968 IN THE AMOUNT OF $12,859.00 The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion for suspension of rules. Councilman Smith seconded the motion. Motion carried. Howard Goodhew, Water Works Superintendent spoke in favor of the Ordinance. The Ordinance was given third reading and passed by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays. Mr. Goodhew called attention to the fact that the title of the Ordinance should have been worded "March 7, 1967 to March 7, 1968" instead of "February 7, 1967 and February 7, 1968" ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE (1) MUNICIPAL BONDS OF 1962 -- $148,983.79 AND (2) MUNICIPAL BONDS OF 1965 -- $62,506.94. The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Palmer seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SEWAGE DISPOSAL FUND IN THE AMOUNT OF $63,514.25 The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the Ordinance be set for public hearing on February 27, 1967. Councilman Laven seconded the motion. Motion carried. 2 ;E�I13Ai�_I�ERTING FEBRUARY _ 13, 1967 RESOLUTION NO. 150 -67 A RESOLUTION FOR AN ADDITIONAL APPROPRIATION IN THE "BUILDINGS, STRUCTURES & IMPROVEMENT" ACCOUNT OF THE CITY CEMETERIES DEPARTMENT IN THE AMOUNT OF $300.00 AND THE TRANSFER OF THE SAME FROM THE "LAND ACCOUNT" IN THE SAME CATEGORY, TO -WIT: PROPERTIES, AND ALL BEING IN THE GENERAL FUND. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so',' that it is now necessary to appropriate more money than was appropriated in the:.annual budget for the various functions of-City Government to meet such extraordinary contingencies; and WHEREAS, Additional funds for building construction are urgently needed by the City Cemeteries Department to assure its ability to properly perform its function and the sum of $300.00 is needed forthwith; and WHEREAS, A surplus exists in another account where it is not presently needed; and more specifically as follows, to -wit: 1. Three Hundred Dollars ($300.00) in ACCOUNT N -73 designated as "Land ". NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $300.00 be transferred from ACCOUNT N -73 designated as "Land" by transferring it to the following account, to -wit: 2. Three Hundred Dollars ($300.00) to ACCOUNT N -71 designated as "Buildings, Structures & Improvement ", both of said accounts being in the same capegory, to -wit: "Properties" of the City Cemeteries Department. /s/ Edwin Thomas Smith Member of the Common Council Speaking in favor of the Resolution was Mr. Clifton P.
