HomeMy WebLinkAbout01-23-67 Council Meeting MinutesREGULAR MEETING JANUARY 23, 1967 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Council Chambers of City Hall in Regular Session, Monday, January 23, 1967 at 8:00 P.M. The meeting was called.to order by President John L. Hunter, Jr., who presided. All of the members were present. President Hunter introduced Reverend Kenneth Folk, All Saints Evangelical United Bretheren Church, who gave the invocation. Councilman Geib made a motion that the agenda be amended to include another ordinance titled "AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL FUND, FOR OFFICERS OF THE CITY OF SOUTH BEND TO BE ELECTED FOR THE TERM COMMENCING JANUARY 1, 1968 AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT ". (This was in addition to another ordinance pertaining to salaries already appearing on the agenda. ). Councilman Palmer seconded the motion. Motion carried, 6 ayes ( Councilmen Hunter, Palmer, Wise, Geib, Laven, and Muszynski) 3 nays (Councilmen Allen, Smith and Szymkowiak),,O absent. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski ABSENT: None REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have examined the minutes of the previous meeting of the Council and found them correct. REPORT OF AREA PLAN COMMISSION January 18, 1967 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of the Light Company, Inc. was legally advertised under date of January 7, 1967 and January 14, 1967 and given public hearing on January 17, 1967. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the ordinance and site development plan be recommended favorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. PETITION REQUEST AND APPLICATION OF NORTHERN INDIANA TRANSIT, INC. TO THE COMMON COUNCIL OF SOUTH BEND, INDIANA TO THE HONORABLE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: WHEREAS, the Acts of the Indiana General Assembly, 1965, authorizes and permits cities having a population of less than 350,000 to render assistance to existing transit systems or in the alternative to acquire such systems under the conditions contained in said Act and, (Continued) PETITION (Continued) WHEREAS, the only mass transportation facility serving the City of SOUTH BEND, INDIANA is owned and operated by NORTHERN INDIANA TRANSIT, INC., an Indiana corporation, under exclusive franchise with the City of SOUTH BEND, INDIANA.. WHEREAS, said Act further provides that in any such city the Common Council in order to maintain and provide adequate mass transportation facilities within-the city, may make a determination as to whether the public is to acquire the system or render assistance to such system. WHEREAS, the undersigned,acting by.and through the authority of The Board of Directors of NORTHERN INDIANA TRANSIT, INC., are of the opinion that the present mass transportation system is, within the foreseeable future, in imminent danger of being unable to continue to render adequate service within the City of SOUTH BEND, INDIANA NOW, THEREFORE, pursuant to a resolution of the Board of Directors of NORTHERN INDIANA TRANSIT, INC., a copy of which is attached hereto and made a part hereof, the undersigned applies to and requests the COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA to make or cause to be made a study or studies of the existing system for the purpose of determining whether the financial position of the system is such that the system is unable to continue to render adequate service within the City or is in imminent danger of being unable to continue to render such service; and to determine from such study whether the COMMON COUNCIL should furnish assistance to the system for the purpose of providing the system with a financial position I� as will enable it to continue to render adequate service within the City or determine whether it is in i the public interest that the public acquire the system. Councilman Smith made a motion that the Request be referred to the Transportation Committee. Councilman Geib seconded the motion. Motion carried. Councilman Smith inquired whether there would be a meeting on February 13, since it is a legal holiday and City Hall offices would be closed on that day. After a brief discussion, Councilman Allen made a motion that,regardless of the holiday, the next meeting be held on February 13, 1967. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 HERETOFORE AMENDED AND SUPPLEMENTED BY THE MUNICIPAL j CODE OF SOUTH BEND, INDIANA, CHAPTER 40, ET SEQ., AS AMENDED AND SUPPLEMENTED AND ADOPTED BY THE COMMON COUNCIL BY ORDINANCE NO. 4608 -63 (Location: 3000 E. Jefferson Boulevard) The Ordinance was given first reading by title and-second reading in full. Councilman Allen made a motion that the Ordinance be set for public hearing on February 13, 1967. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE NO. 4908 -67 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA AND OFFICE ENGINEERS, INCORPORATEDyFOR THE PURCHASE OF AN OZALID DRY PRINTING AND DEVELOP - ING MACHINE IN THE AMOUNT OF $3,227.50 �i The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion for suspension of rules. Councilman Palmer seconded the motion. Motion carried by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays, 0 absent. Mr. Howard Goodhew, Water Works Supierintendent, spoke in favor of the Ordinance. The Ordinance was given third reading and passed by a roll call vote of 9 ayes (Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski) 0 nays, 0 absent. MEMO FROM FEES AND SALARIES COMMITTEE January 23, 1967 RE: Salary Ordinance for Elected Officials The committee recommends the following salaries: Mayor $25,000.00 Judge 12,000.00 City Clerk 12,000.00 Members of Common Council 2,400.00 I /s/ Janet S. Allen, Chairman The report was accepted as read, and placed on file. $E�I�L�R MEETT�IG JANUARY ZJ, 1'101 ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE FIXING THE ANNUAL SALARIES, PAYABLE FROM THE GENERAL FUND, FOR OFFICERS OF THE CITY OF SOUTH BEND TO BE ELECTED FOR THE TERM COMMENCING JANUARY 1, 1968 AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion to amend the Ordinance in the line for the Common Council salary to show an amount of $3,600.00. Councilman Palmer seconded the motion. The motion was defeated by a roll call vote of 4 ayes (Councilmen Hunter, Palmer, Geib and Muszynski), 5 nays (Councilmen Allen, Wise, Szymkowiak, Laven and Smith) 0 absent. Councilman Geib then made a motion to amend the Ordinance to show an amount of $3,000.00 as the salary for the councilmen. Councilman Palmer seconded the motion. Motion carried by a roll call vote of 5 ayes (Councilmen Hunter, Palmer, Wise, Geib and Muszynski), 4 nays (Councilmen Allen, Szymkowiak, Laven and Smith) 0 absent. Councilman Geib made a motion that the Ordinance, as amended, be set for public hearing on March 13, 1967. Councilman Palmer seconded the motion. Motion carried. Councilman Geib moved that an Ordinance added to the agenda during the early part of the meeting, which also dealt with fees and salaries,now be withdrawn. Councilman Allen seconded the motion. Motion carried. RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA WHEREAS, the County of St. Joseph acting by and through the Board of County Commissioners of St. Joseph County will construct a new County -City Building, a new County Jail, and will remodel the existing St. Joseph County Courthouse; and, Whereas the City of South Bend has executed a certain Lease for portions of said County -City Building and it is to the advantage to the City of South Bend to minimize costs of said construction and remodeling. BE IT THEREFORE RESOLVED that the Building Commissioner of the City of South Bend is hereby authorized and directed to issue the necessary building permits for the construction of the new County -City Building and the construction of the new St. Joseph County Jail and for the remodeling of the existing St. Joseph County Courthouse without payment of fees as set forth in the Municipal Code of the City of South Bend, Indiana, 1962, which fees are hereby expressly waived. This resolution shall be in full force and effect upon the adoption of the Common Council and approval of the Mayor. /s/ John L.
