Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole
in the Council Chambers in the City Hall on Monday, January 9, 1967 at 8 :00 P.M. All members were present
except Councilman Wise. The meeting was called to order by Chairman Edwin T. Smith, who presided.
Chairman Smith introduced Reverend Harry 0. Huffman, pastor of Lydick Bethel Church, who gave the invocation.
ORDINANCE
AN ORDINANCE AMENDING SECTION 40 -17 OF THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962 AS
AMENDED, ALSO KNOWN AS SECTION 4 OF ORDINANCE NO.
3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
INDIANA, AS AMENDED.
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be heard thereon. Chairman Smith read the following communication:

Gentlemen:
The attached ordinance which was referred back to the Area Plan Commission for clarification has now been
discussed with the Area Plan Attorney. n order to clarify this proposed amendment,it is suggested
that the last sentence read as follows:
"In the event the Board does approve the petition, the approval
shall be subject to the development plan approved by the Board
of Zoning Appeals and such plan shall constitute a limitation
on the use of the property ".

Councilman Allen made a motion that the Ordinance be amended as suggested by the Area Plan Commission. Council-
man Muszynski seconded the motion. Motion carried. Councilman Laven made a motion that the Ordinance go
to the Council favorable, as amended. Councilman Muszynski seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
APPROPRIATING THE SUM OF ONE MILLION FIVE HUNDRED
THOUSAND DOLLARS ($1,500,000) FOR THE ACQUISITION
OF LAND, EASEMENTS AND RIGHTS -OF -WAY AND THE CON-
STRUCTION THEREON OF MAJOR ARTERIAL STREETS TO
EXTEND THE INNER BELT SYSTEM; FOR THE CON-
STRUCTION AND EQUIPPING OR THE REMODELING AND
EQUIPPING OF A BUILDING FOR USE AS A FIRE
STATION AND THE ACQUISITION, IMPROVEMENT AND
LANDSCAPING OF ANY LAND NECESSARY AS A SITE THERE-
FOR; CONSTRUCTION OF SEWERS; CONSTRUCTION,
RECONSTRUCTION AND IMPROVING OF STREETS; AND
THE ENGINEERING, ARCHITECTURAL, APPRAISAL,
ABSTRACTING, TITLE INSURANCE AND LEGAL FEES
AND EXPENSES INCIDENTAL THERETO AND THE
EXPENSES AND LEGAL FEES ON ACCOUNT OF THE
ISSUANCE OF BONDS THEREFOR AND DECLARING
THAT AN EXTRAORDINARY EMERGENCY EXISTS FOR THE
EXPENDITURE OF SAID FUNDS.
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were
given an opportunity to be to be heard thereon. Speaking in favor of the Ordinance was Mr. Lloyd Taylor,
City Engineer. Speaking against the Ordinance was Councilman Janet S. Allen. Councilman Hunter made a
motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion
carried.

AN ORDINANCE REPEALING SECTION 5 OF CHAPTER 24
OF THE MUNICIPAL CODE OF THE CITY OF SOUTH
BEND, INDIANA, 1962, COMMONLY KNOWN AS THE
MILK ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents
were given an opportunity to be heard thereon. Dr. Louis How, St. Joseph County Health Officer introduced
Mr. John Schlagel, State Board of Health, who explained the need for the Ordinance and spoke in favor of
passage. Also speaking in favor of the Ordinance was Mr. Glen Schaffer, Lakeville, Indiana. Councilman
Geib made a motion that the Ordinance go to the Council as favorable. Councilman Hunter seconded the motion.
Motion carried.
There being no further business to come before the Committee,Councilman Geib made.a.motion to- rise :and.report
to the Council. Councilman Palmer seconded the motion. Motion carried. Time: 8:59
