Home My WebLink About10-10-66 Council Committee of the Whole Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in the City Hall on Monday, October 10, 1966 at 8:00 P.M. The meeting was called to order by Chairman Edwin Thomas Smith, who presided. All members were present. Chairman Smith introduced Reverend J. Robert Clark, Associate Pastor of Grace Methodist Church, who gave the invocation. ORDINANCE AN ORDINANCE AMENDING SECTIONS 40 -1 AND 40 -17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO 3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED. Public hearing on the above Ordinance was continued from the meeting of September 26, 1966. Councilman Hunter reported that the Ordinance Committee recommended that the Ordinance be sent back to the Area Plan Committee for further study, and that an unfavorable report be given it in its present form. The following report was read by Councilman Hunter: Report of Ordinance Committee: "The Ordinance Committee, following a meeting, recom- mends that the above Ordinance goes to Council unfavorably, It also recommends that the Ordinance be defeated bas on John Wilson's recommendations. Our recommendations are based on the need for changes in the Ordinance partic- ularly in the area sizes of certain height and area districts. Consideration should also be given to other facts in the ordinance that were not fully considered ". Councilman Hunter made a motion that the Ordinance go to the Council as unfavorable. Councilman Geib seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA OF 1962, MORE SPECIFICALLY KNOWN AS ORDINANCE NO. 4608-63-ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON OCTOBER 14, 1963, AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Location: 3004 Edison Rd.) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Joseph Ettl, attorney for the petitioner. Speaking in remonstrance were: David Good, 2923 McArthur Dr., who submitted the names of 100 neighbors in the surrounding area who are opposed to the Ordinance. Also, James Wright, 2911 McArthur, Lee Patterson, 2919 McArthur, and James Widner, 3112 Kettering Drive. Councilman Hunter made a motion that the Ordinance go to the Council as unffavorable. Councilman Wise seconded the motion. The motion failed, 7 nays, 2 ayes (Councilmen Hunter and Wise). Councilman Geib then made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried, 7'ayes, 2'nays (Councilmen Hunter and Wise). ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND AND HERSEY - SPARLING METER COMPANY FOR THE FURNISHING OF A 12 INCH TURBINE TYPE WATER METER. IN THE SUM OF $3,057.95. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Howard Goodhew, Water Works Super- intendent. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Geib seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND AND E. J. WHITE, INCORPORATED FOR INSTALLATION OF FLUORIDATION FACILITIES AT NORTH STATION, OLIVER. STATION, SOUTH STATION AND AIRPORT STATION IN THE SUM OF $32,845.00. ORDINANCE ORDINANCE AN ORDINANCE APPROVING A CHANGE ORDER IN A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND AND C & C CONSTRUCTION COMPANY, INCORPORATED FOR THE INSTALLATION`OF FLUORIDATION FACILITIES AT EDISON PARK PUMPING STATION IN THE SUM OF $11,506.00. AN ORDINANCE APPROVING A CHANGE ORDER IN A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND AND B & G CONSTRUCTION COMPANY, INCORPORATED FOR THE INSTALLATION OF FLUORIDATION FACILITIES AT PINHOOK PARK PUMPING STATION IN THE SUM OF $11,385.00. This being the time heretofore set for public hearing on the above Ordinances, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinances were Dr. Herbert A. Schiller, 1813 E. Cedar, Dr. Richard Holdeman, 615 W. Colfax, Dr. William S Shriber, 1512 E. Madison, Dr. John Reuthe, 302 E. Pokagon, Professor Morris Wagner, Notre Dame University, Dr. Julian Pleasants, Notre Dame University, Dr. Louis How, St. Joseph County Health Officer, Dr. Charles W. Gish, State Board of Health, Edward J. Molenda, D.D.S., 312 N. Taylor, Professor Joseph Muhler, Indiana University, Mrs. Charles Gray, 1625 N. Huey,E. N. Shoan, 2909 Hilltop Drive, representing John Marshall School P.T.A., Charles Maternowski, 726 Beale Street, Ralph Painter, 1346 Byron Drive, representing South Bend Junior Chamber of Commerce, Michael Krabol, 119 N. Taylor, Mrs. Charles Seal, 1244 Sunnymede Ave and Wilford Barnhart, 729 W. LaSalle, who read a communication from the St. Joseph County Chapter of Michiana Watershed, Inc., supporting the use, of fluoride in the water. Councilman Szymkowiak spoke against the Ordinances, and Councilman Allen speaking against the Ordinances,' read several reports to support her opposition to the use of fluoride in the water supply. Councilman Hunter and Smith spoke in favor of the Ordinances. Councilman Wise made a motion that "AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF SOUTH BEND AND E.J. Councilman Hunter seconded the motion. Motion carried, 6 ayes (Councilman Hunter, Wise, Geib, Laven, Smith and Muszynski), 3 nays (Councilmen Allen, Palmer and Szymkowiak). Councilman Laven seconded the motion. Motion carried, 6 ayes (Councilmen Hunter, Wise, Geib, Laven, Smith and Muszynski. 3 nays (Councilmen Allen, Palmer and Szymkowiak). There being no further business before the Committee of the Whole, Chairman Smith instructed the members to rise and report to the Council. Time: 2:50 A.M., October 11, 1966.
