HomeMy WebLinkAbout09-26-66 Council Committee of the Whole Meeting Minutesj86 COMMITTEE OF THE WHOLE MEETING SEPTEMBER 26 1966 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in the City Hall on Monday,Beptember 26, 1966. The meeting was called to order by Chairman Edwin Thomas Smith, who presided. All members were present. Time: 8:00 P.M. Chairman Smith introduced Reverend Charles Ellinwood, St. Pauls Methodist Church, who gave the Invocation. ORDINANCE AN ORDINANCE AMENDING SECTIONS 40 -1 AND 40 -17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED. Douglas Seely, Attorney spoke in favor of the Ordinance, but requested that the Council continue public hearing in two weeks, after those persons concerned with it, have had more time to study it. John K. Wilson, Executive- Director of the Area Plan Commission concurred with Mr. Seeley that the public hearing should be continued so that it will receive more publicity. Councilman Hunter made a motion that the Ordinance be referred to the Ordinance Committee, and that the public hearing be continued until October 10, 1966. Councilman Palmer seconded the motion. Motion carried. COMMUNICATION Hahn, Nafe & Fisher 231 South Eddy St. South Bend, Indiana September 23, 1966 South Bend Common Council City Hall South Bend, Indiana Gentlemen: Request is hereby respectfully made to the Honorable Common Council of the City of South Bend, Indiana, for permission to withdraw the petition filed June 29, 1966, by Gladys I. Batey, Lynndon E. Scheid, Sylvia Pence and Lottie Torzewski to rezone a tract of land located south of Lincoln Way East, West of Twyckenham Drive, East of Hilde's Court and North of an east and west alleyway bisecting the block in an east west direction, in the City of South Bend, Indiana Respectfully submitted /s/ Russell H.Fisher Attorney for petitioners Councilman Allen made a motion that the letter be accepted and placed on file. Councilman Szymkowiak seconded the motion. Motion carried. Councilman Hunter made a motion to recess. Councilman Wise seconded the motion. Motion carried. Time: 8 :15 Reconvened 8:25. Upon advice of Robert J. DuComb, City Attorney, it was decided that although the letter was accepted, as read, the Ordinance would not be withdrawn. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Location: South of.L.W.E., West of Twyckenham) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Hunter made a motion that the Ordinance go to the Council as unfavorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 3702, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED. (Location: 3900 block S. Michigan) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS. Location: East side of York Rd., south of the center line of Jackson Road.). This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Geib reported that the Annexation Committee recommended the annexation favorable. Lloyd Taylor, City Engineer spoke in favor of the Ordinance. Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE SEWAGE DISPOSAL FUND IN THE AMOUNT OF $62,717.55 This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was James A. Bickel, City Controller. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Hunter seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN THE AMOUNT OF $10,500.00 TO VARIOUS ACCOUNTS WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon . Councilman Palmer made a motion that the Ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE FAIR EMPLOYMENT PRACTICES COMMISSION FUND IN THE AMOUNT OF $150.00 TO ACCOUNT 214 TELEPHONE AND TELEGRAPH, IN SAID FUND. This being the time heretofore set for public hearing on the above Ordinance proponents and opponents were given an opportunity to be heard thereon. George Neagu, Executive Director of the Fair Employment Practices Commission. Councilman Laven made a motion that the Ordinance be amended to read $65.00, instead of $150.00.. Motion died for lack of a second. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion failed, 4 ayes, (Councilmen Allen, Geib, Szymkowiak and Smith), 5 nay (Councilmen Laven, Hunter, Wise, Muszynski and Palmer). Councilman Geib spoke in favor of the Ordinance and asked that a second vote be taken. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Geib seconded the motion. Motion carried, 8 ayes, Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Smith and Muszynski), 1 nay, (Councilman Laven). ORDINANCE AN ORDINANCE AUTHORIZING THE TRANSFER.OF $29,268.36 FROM THE SOUTH BEND APW INDIANA 1G FUND AND $7,639.72 FROM THE SOUTH BEND APW INDIANA 3G FUND TO THE GENERAL FUND OF THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. James A. Bickel, City Controller spoke in favor of the Ordinance. Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AUTHORIZING THE TRANSFER OF $31,394.36 FROM THE STREET AND TRAFFIC FUND AND $23,042.60 FROM THE CITY PLAN FUND TO THE GENERAL FUND AND APPROPRIATING FROM THE GENERAL FUND THE SUM OF $48,000.00 TO ACCOUNT B -53 "REFUND, AWARDS AND INDEMNITIES" IN THE OFFICE OF CONTROLLER This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AUTHORIZING THE TRANSFER OF $1,523.63 FROM THE 1960 GENERAL STREET IMPROVEMENT FUND AND $6,469.48 FROM THE MUNICIPAL BONDS OF 1961 FUND TO THE GENERAL SINKING FUND OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was James A. Bickel, City Controller. Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT V -44 "MATERIALS ", IN THE AMOUNT OF $13,600.00 AND THE TRANSFER OF THE SAME FROM ACCOUNT V -11, "SERVICES PERSONAL ", ALL BEING IN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Palmer made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO ACCOUNT Q -451, "PARTS OF EQUIPMENT ", IN THE AMOUNT OF $2,000.00 AND THE TRANSFER OF THE SAME FROM ACCOUNT Q -251, "REPAIRS TO BUILDINGS AND STRUCTURES ", ALL BEING IN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Fire Chief Cecil McHenry spoke in faw r of the Ordinance. Councilman Palmer made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING AND CONFIRMING A COMMUNITY ANTENNA TELEVISION FRANCHISE CONTRACT BETWEEN THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, AND VALLEY CABLEVISION CORPORATION. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance, was Louis Chapleau, Attorney. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Laven seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Geib made a motion to rise and report to the Council. Councilman Wise seconded the motion.
