JUNE 13, 1966
Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of
City Hall in Regular session, on Monday, June 13, 1966 at 9:30 P.M. All members were present except Councilmen
Hunter and Allen. The meeting was called to order by Vice- President John V. Wise, who presided. Vice - President
Wise called attention to the fact that Councilman Hunter was on vacation and Councilman Allen was attending
the Mayor's Convention in Dallas, Texas.

REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

PETITION
We, the undersigned, do hereby respectfully make application and petition the Common Council of the City of
South Bend, Indiana to amend the zoning Ordinance of South Bend, Indiana and in support of this application,
the following facts are shown:
1. The property is owned by
First Baptist Church of South Bend, Indiana with the option to purchase given to the St. Joseph
Valley Nursing Home Inc.
3. A legal description of the property is as follows:
Beginning at the Northwest corner of the North East Quarter of Section 5, Township 37 North,
Range 3 East; thence South along the West line of said North East Quarter a distance of 1294.62
feet (19.621-chaiins) to the South west corner of the North One -half (2) of said North East Quarter;
thence easterly along the South line of the North One -half (Z) of said North East Quarter a_- ;distance
of 267.30 feet (4.05 chains); thence Northerly along a line paralleling the West line of said North
East Quarter a distance of 1086.06 feet, thence Westerly along a line paralleling the North line of

REPORT OF AREA PLAN COMMISSION

Gentlemen:
The attached rezoning petition of Belleville Lumber and Supply Company, et al, was legally advertised under
the date of May 7 and 14 and given public hearing on May 17, 1966. The following action was taken at a
special meeting on June 7, 1966:
After due consideration it was moved, seconded and carried that the ordinance
and site development plan be recommended favorably-to the Common Council.
The deliberations of the Area Plan Commission and points considered in arriving at the above decision are
shown in the excerpts of the minutes attached hereto and made a part of this report.

RESOLUTION
A RESOLUTION APPROVING A SECOND AMENDMENT TO
A CONTRACT BETWEEN THE SOUTH BEND CITY WATER
WORKS AND SEWAGE DISPOSAL PLANT AND CLAY
UTILITIES, INC., FOR FURNISHING OF WATER AND
SEWAGE TREATMENT TO THE CLAY TOWNSHIP AREA IN
ST. JOSEPH COUNTY, INDIANA.
WHEREAS, the Board of Water Works Commissioners and the Board of Sewage Commissioners deem
it to be in the best interests of their respective facilities and to the City of South Bend to amend
an Agreement to furnish water and sewage services in Clay Township to Clay Utilities, Inc,, which
Agreement was entered into on the 22nd day.of March, 1965 and approved by Resolution No. 96 -65 of
the Common Council of the City of South Bend on the 10th day of May, 1965.
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that the
contract entered into between the South Bend City Water Works and the sewage disposal plant of the City of
South Bend and Clay Utilities, Inc, dated the 22nd day of March, 1965 for the furnishing of water and
sewage treatment to Clay Township, St. Joseph County, Indiana as amended is hereby approved and confirmed;
said amendment being attached hereto as an exhibit and made a part of this Resolution.

City Attorney, Mr. Robert J. DuComb asked Chief Irvin C. Hampton of the Police Departm,
speed of the trains by radar.
There being no further business before the Council, Councilman Geib made a motion to a,
seconded the motion. Motion carried and Council adjourned at 10:55 P.M.
