HomeMy WebLinkAbout05-09-66 Council Meeting MinutesME REGULAR MEETING MAY 9, 1966 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of City Hall in Regular session, on Monday, May 9, 1966 at 8:56 P.M. All members were present. The meeting was called to order by President John L. Hunter, Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski. ABSENT: None REPORT OF COMMITTEE ON MINUTES I To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspectedll', the minutes of the previous meeting of the Council and found them correct. REPORT OF COMMITTEE OF THE WHOLE Your Committee of the Whole, to whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA" (Location: 3409 E. McKinley) Respectfully report that they have examined the matter and that in their opinion this Ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman There being no objections, the report was accepted as read. REPORT OF COMMITTEE OF THE WHOLE Your Committee of the Whole, to whom was referred "AN ORDINANCE APPROPRIATING $2,000.00 FROM THE GENERAL FUND FOR THE USE OF THE BOARD OF PUBLIC WORKS AND SAFETY IN CONNECTION WITH THE SESQUICENTENNIAL CELEBRATION OF THE STATEHOOD OF INDIANA." Respectfully report that they have examined the matter and that in their opinion this Ordinance go to the Council as favorable. There being no objections, the report was accepted as read. /s/ Edwin Thomas Smith, Chairman j� 1 ul REPORT OF CAPITAL IMPROVEMENT COMMITTEE Your Committee on Capital Improvements to whom was referred "AN ORDINANCE APPROPRIATING $233,000.00 OF THE CUMULATIVE CAPITAL IMPROVEMENT FUND OF THE CITY OF SOUTH BEND, INDIANA, FOR VARIOUS CAPITAL IMPROVEMENTS ". Respectfully report that they have examined the matter and that in their opinion the Ordinance go to the Council as favorable; with the recommendation that co- operation of the County be sought to alleviate the Clyde Creek drainage problem. /s/ Janet S. Allen, Chairman Councilman Palmer made a motion that the report be accepted as read. Councilman Geib seconded the motion. PETITION Motion carried. We, the undersigned, do hereby respectfully make application and petition the Common Council of the City of South Bend, Indiana to amend the zoning Ordinance of South Bend, Indiana, as hereinafter requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located -at the Northeast corner of Ironwood and Colfax Avenue 2. The property is owned by Jerome Claeys and Evadna Claeys, Husband and Wife 3. A legal description of the property is as follows: A tract or parcel of vacant ground at the Northeast corner of the intersection of Colfax Avenue and Ironwood Drive, which measures approltimately 307.57 feet by 290.5 feet.and described as follows: Lot 57 (except 123.59 feet af:?the entire South side thereof) in Jefferson Heights Addition to the City of South Bend, as recorded April 7, 1913 in Plat Book 9, pages 144 -9 in the Office of the Recorder of St. Joseph County, State of Indiana. 4. It is desired and requested that the foregoing property be rezoned: From A Residential Use and A Height and Area District To B Residential Use and A Height and Area District 5. It is proposed that the property will be put to the following use and the following building will be constructed. Erection of a single floor Rehabilitation and Extended Care facility for hospital patient recuperation, in accordance with the standards established under the Federal Medicare Program. 6. Jefferson Blvd, South Bend, Indiana Councilman Smith made a motion that the petition be referred to the Area Plan Commission. Councilman Muszynski seconded the motion. Motion carried. REPORT OF AREA PLAN COMMISSION May 2, 1966 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of The Light Company, Inc. was legally advertised under date of April 9, 1966 and given public hearing on April 19, 1966. The following action was taken: After due consideration it was moved by Mr. Sharp, seconded by Mr. Miller and unanimously carried that the petition and site development plan be recommended unfavorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. REGULAR MEETING MAY 9, 1966 REPORT OF AREA PLAN COMMISSION May 2, 1966 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of Mrs. Cary Roach, et al, was legally advertised under date of April 9, 1966 and given public hearing on April 19, 1966. The following action was taken: After due consideration it was moved by Mr. Taylor, seconded by Mr. Miller and unanimously carried that the petition and site development plan be recommended unfavorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. The following action was taken: After due consideration it was moved by Mr. Helvie, seconded by Mr. Bowers and carried that the rezoning ordinance and site development plan be recom- mended unfavorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. Main Street South Bend, Indiana Dear Mrs. Blough: Re: Petition to amend zoning ordinance as filed by Ora J. Stahl, Edward J. Sikora and Crest Manor Development Corp. On behalf of Ora J. Stahl, Edward J. Sikora and Crest Manor Development Corp., we previously filed with your office a petition to amend the South Bend, Indiana zoning ordinance concerning a parcel of realty located on the easterly side of York Road and commencing approximately 400 feet south of the south line of Jackson Road in South Bend, Indiana. We now desire to withdraw this petition. We respectfully request that the Common Council of the City of South Bend, Indiana and your office accept this letter as the..request of Ora J. Stahl, Edward J. Sikora and Crest Manor Development Corpr to withdraw said petition. If any additional acts are required in this regard, please telephone me accordingly. McKinley) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays, 0 absent. ORDINANCE NO. 4850 -66 AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS (Location: A tract of land on Edison Rd., between Woodland and Meadowview). The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays, 0 absent. ORDINANCES, FIRST AND SECOND READING ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED. (Location: South side of East McKinley - 3000 E. McKinley) The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that the Ordinance be set for public hearing May 23, 1966. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 9, SECTION 3, SUBSECTIONS (15) AND (16) OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962 (Fire Districts) The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be set for public hearing May 23, 1966. Councilman Szymkowiak seconded the motion. Motion carried. NEW BUSINESS Councilman Geib suggested that the Council enact an Ordinance prohibiting the re- submittal of a withdrawn petition within a period of six months. The suggestion was also made that an advertising fee be deposited with the City Clerk at the time -a petition for rezoning is presented. Councilman Geib then made a motion that the matter be referred to the Legislative Committee. Councilman Palmer seconded the motion.
