HomeMy WebLinkAbout04-11-66 Council Committee of the Whole Meeting MinutesV12 COMMITTEE OF THE WHOLE MEETING APRIL 11, 1966 Be it remembered that the Common Council of the City of South Bend, Indiana,met in the Committee of the Whole in the Council Chambers in the City Hall on Monday, April 11, 1966 at 8:10 P.M., with all members present. The meeting was called to order by Chairman Edwin T. Smith, who presided. ORDINANCE AN ORDINANCE REPEALING SUB- SECTION (b) OF SECTION ONE (1) OF ORDINANCE NO. 3964 BEING AN ORDINANCE FIXING THE SCHEDULE OR RATES AND CHARGES TO BE COLLECTED BY THE CITY OF SOUTH BEND FROM THE OWNERS OF PROPERTY SERVED BY THE SEWAGE DISPOSAL WORKS OF SAID CITY AND OTHER MATTERS CONNECTED THEREWITH: AND SUBSTITUTING A NEW SUBPARAGRAPH (b) IN SAID SECTION ONE (1) IN LIEU THEREOF. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Dick Biscomb of the Area Chamber of Commerce spoke against passage of the Ordinance at this time, asking that voting be delayed until further studies have been made. Also speaking against the Ordinance was Don Carter, speaking in behalf of the Bendix Corporation. Mr. Howard Goodhew, Water Works Superintendent spoke in favor of the Ordinance. Councilman Geib made a motion that public hearing on this Ordinance be continued April 25, 1966, and that third reading be given at that time. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING A COMMUNITY ANTENNA TELEVISION FRANCHISE AGREEMENT BETWEEN THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND AND VALLEY CABLEVISION CORPORATION. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. Louis Chapleau, attorney for Valley Cablevision Corporation. Speaking against the Ordinance was Tom Laughlin, who appeared in behalf of Community Television. Also speaking in favor of the Ordinance, was Jerry Kunkle, Program Director of W A T V, of Indianapolis, Indiana. Mr. Chapleau then spoke in rebuttal. Mr. Laven made a motion that the Ordinance be tabled , and a communication be sent the Board of Public Works asking that the franchise be amended to provide for a rate review procedure. Councilman Szymkowiak seconded the motion. Motion lost 4 nays,(Geib, Hunter, Allen and Muszynski), Z5 ayes, (Laven, Szymkowiak, Palmer, Smith and Wise). Councilman Geib made a motion that the Ordinance be sent to the Council as unfavorable. Councilman Hunter seconded the motion. Motion defeated, 3 ayes (Councilmen Hunter, Allen and Geib) 6 nays (Councilmen Palmer, Wise, Szymkowiak, Laven, Smith and Muszynski). Councilman Wise made a motion that the public hearing be continued until April 25, 1966. Motion died.for lack of a second. Councilman Wise made a motion for recess. Councilman Allen seconded the motion. Motion carried. Time: 9:50 P.M. Reconvened 10:10 P.M. Councilman La #en made a motion that the Ordinance go to the Council as unfavorable, and that a statement would be made at the end of the meeting under New Business. Motion carried, 8 ayes, 1 nay (Councilman Szymkowiak). ORDINANCE AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 4563, THE SUBDIVISION ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. Martin Kleva of the Area Plan Commission. Councilman Hunter made a motion that the Ordinance be amended in Section 1, Part 5, line 2, to read 1 year instead of 30 days. Councilman Palmer seconded the motion. Motion carried. Councilman Muszynski made a motion that the Ordinance go to the Council favorable, as amended. Councilman Hunter seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING SECTION 40 -19 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon.Speaking in favor of the Ordinance was Mr. Martin Kleva of the Area Plan Commission. Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING $80,974.23 FROM THE SOUTH BEND -ST. JOSEPH COUNTY BUILDING AUTHORITY FUND TO THE GENERAL FUND OF SOUTH BEND AND APPROPRIATING $80,974.23 TO ACCOUNT L- 71- BUILDINGS, STRUCTURES AND IMPROVEMENTS, SAID ACCOUNT BEING IN THE GENERAL FUND. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Hunter made a motion that the Ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING $1,600.00 FROM THE SURPLUS IN THE MOTOR VEHICLE HIGHWAY FUND TO ACCT. MVH 726 -OTHER EQUIPMENT APRIL 11, 1966 This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Miss Virginia Guthrie Executive Secretary of the Civic Planning Association inquired as to the -wuseuofither , fuids -:_ Councilman Allen explained that there was a need for trash receptacles in the downtown area. Councilman Laven made a motion that the Ordinance go to the Council as favorable. Councilman Hunter seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REPEALING SECTION II OF CHAPTER 26 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO ALCOHOLIC BEVERAGES BEING PROHIBITED IN CERTAIN PLACES, AND SUBSTITUTING NEW SECTIONS IN LIEU OF THOSEREPEALED. This being the time heretofore set for public hearing on the above ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen explained the need for the Ordinance. Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Chairman Smith instructed members of the Committee of the Whole, to rise and report to the Council. Time: 10:25 P.M.
