Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers of
City Hall, in Regular Session, on Monday, March 14, 1966 at 8:51 P.M.. All members were present, except
Councilman Palmer. The,meeting was called to order by President John L. Hunter, Jr., who presided.

PRESENT: Councilman Hunter, Allen, Wise, Geib, Szymkowiak,
Laven, Smith and Muszynski
ABSENT: Councilman Palmer
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they
have inspected the minutes of the previous meeting of the Council and found them correct. They therefore
recommend that the same be approved.

PETITION
To: The Honorable Common Council:
We, the undersigned do hereby respectfully make application and petition the Common Council of the
City of South Bend, Indiana to amend the Zoning Ordinance of said City of South Bend, Indiana as here-
inafter requested, and in support of this application, the following facts are shown:
1. The property sought to be rezoned is located at 3409 East McKinley Avenue, South Bend, Indiana,
on the North side of McKinley Avenue West of its intersection with Hickory Road.
2.. The property is owned by R. M. Jones and Mrs. Robert M. Jones, tenants by the entireties.
3. A Legal description of the property is as follows:
Part of the Southeast Quarter of Section 5, Township 37 North, Range
3 East, beginning at a point on the south line of said Section ( being
the center line of the right of way for McKinley Avenue) 838.25 feet
west of the southeast corner of said Section; thence North a distance
of 726 feet; thence West 75 feet; thence South a distance of 726 feet;
thence East 75 feet to the place of beginning; the south 40 feet of
said property being subject to the right of way for McKinley Avenue.
4. It is desired and requested that the foregoing property be rezoned:
From A Residential Use and A Height and Area District
To C Commercial Use and E Height and Area District
5. It is proposed that the property will be put to the following use:
To be used for a driveway entrance to the proposed "Ayr -Way store to be
built on a tract of land lying North of the subject parcel; and to erect
thereon a sign advertising such entrance. A site development plan is attached.
6. Number of off street parking spaces to be provided: Not Applicable.
7. Attached is a copy of: a.) the plot plan showing my property and other surrounding properties:
b.) names and addresses of all the individuals, firms or corporations owning property within
300 feet of the property sought to be rezoned.

Councilman Smith made a motion that the petition be referred to the Area Plan Commission. Councilman Allen
seconded the motion. Motion carried.

PETITION
PETITION TO ANNEX A TRACT OF LAND TO THE
CORPORATE LIMITS OF THE CITY OF SOUTH BEND, INDIANA.
TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
DAVID W. HADAWAY and REBECCA F. HADAWAY, husband and wife would.respectfully represent and show to the
Common Council of'the City of South Bend, Indiana.
I. That they are owners in fee simple of the following described real estate situated in St. Joseph
County, Indiana to -wit:
A lot or parcel of land in the Southwest Quarter (k) of the Southwest
Quarter (k) of Section 33, Township 38 North, Range 2 East described
as beginning on the South line of Section 33 at a point 1105 feet East
of the Southwest corner of said Section 33; thence North on a line
parallel with the west line of said Section 33 a distance of 428.31
feet; thence East 198.45 feet; thence South on a line parallel with
the West line of said Section 33, a distance of 428.31 feet, more or
less to the South line of said Section; thence West 198.45 feet to the
place of beginning.
II. That said real estate is located on Edison Road and is contiguous to the northern corporate limits
of the City of South Bend, Indiana.
III.. That your petitioners herein are desirous. of having said tract of land annexed to said City
of South Bend, Indiana and that the corporate limits of said city be so extended to include said tract of land.
WHEREFORE, your petitioners respectfully pray and petition your honorable body:
1. That the Common Council refer this petition to the Area Plan Commission for its consideration.
2. That upon favorable recommendation by the Area Plan Commission to the Common Council that this
Common Council adopt an appropriate form of ordinance for the annexation of said described real
estate to the corporate limits of the City of South Bend, Indiana.

Councilman Geib made a motion that the petition be referred to the Area Plan Commission. Councilman Muszynski
seconded the motion. Motion carried.

Southeast Corner of McKinley Ave. and Eddy St.) "
Respectfully report that they have examined the matter and that in their opinion this Ordinance go to the
Council as unfavorable.
There being no objections, the report was accepted and placed on file.

The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman
Palmer).

AN ORDINANCE APPROVING, RATIFYING AND CONFIRMING
A COMMUNITY ANTENNA TELEVISION FRANCHISE AGREEMENT
BETWEEN THE BOARD OF PUBLIC WORKS AND SAFETY OF
THE CITY OF SOUTH BEND AND VALLEY CABLEVISION
CORPORATION.
The Ordinance was given first reading by title and second reading in full. Councilman Smith made a
motion that the Ordinance be set for public hearing on April 11, 1966. Councilman Wise seconded the
motion. Motion carried.
ORDINANCES, FIRST AND SECOND READING
AN ORDINANCE REPEALING SUB - SECTION (b) OF SECTION
ONE (1) OF ORDINANCE NO. 3964BEING AN ORDINANCE
FIXING THE SCHEDULE OR RATES AND CHARGES TO BE
COLLECTED BY THE CITY OF SOUTH BEND FROM THE
OWNERS OF PROPERTY SERVED BY THE SEWAGE DISPOSAL
WORKS OF SAID CITY AND OTHER MATTERS CONNECTED
THEREWITH; AND SUBSTITUTING A NEW SUB - PARAGRAPH
(b) IN SAID SECTION ONE (1) IN LIEU THEREOF.
The.Ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made
a motion that the Ordinance be set for public hearing on April 11, 1966. Councilman Geib seconded the
motion. Motion carried.
Councilman Allen expressed thanks to the Area Plan Commission, and to Mr. Ernest Rosa,, for their
cooperation and help in installing a new directory in the lobby of City Hall; and requested that
the Clerk send a letter to the Area Plan Commission expressing the thanks of the entire Council.
Councilman Szymkowiak inquired if a rostrum could be placed in the Council Chambers for use of speakers
during meetings. President Hunter directed the Clerk to communicate with the Board of Public Works and
Safety regarding the matter.
President Hunter advised the Clerk to include an ordinance regarding taxicabs, which is now in the
Ordinance Committee, on the agenda for third reading for the next meeting.
There being no further business before the Council, Councilman Muszynski made a motion that the meeting
be adjourned. Councilman Wise seconded the motion. Motion carried and Council adjourned at 9:12 P.M.
