HomeMy WebLinkAbout01-10-66 Council Meeting Minutes1198 REGULAR MEETING; JANUARY 10 1966 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers of City Hall, on Monday, :lanua'ry 10, 1966, at 8 :00 P.M,, with all members present except Councilman Wise. The meeting was called to order by President John L. Hunter, Jr., who presided.. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Geib, Laven and Szymkowiak, Muszynski and Smith „ ABSENT: Councilman Wise REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF AREA PLAN COMMISSION January 4, 1966 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached rezoning petition of Jake Weingarten, et al, was legally advertised under date of November 6, 1965 and given public hearing on November 16, 1965, The following action was taken: After due consideration it was moved by Mr. Taylor, seconded by Mr. Fitterling and carried that the petition be recommended favorably to the Common Council. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. Also attached hereto are maps showing existing and proposed land uses for the property in question and the immediately surrounding area. These three maps visually show the prime factors considered by the Commission in arriving at the above decision. Very truly yours, /s/ John K. REPORT OF AREA PLAN COMMISSION January 4, 1966 The Honorable Common Council City of South Bend, Indiana South Bend,Indiana Gentlemen: The attached rezoning petition of A. Harold Weber, Inc, was legally advertised under date of December 11, 1965 and given public hearing on December 21, 1965. The following action was taken: After due consideration it was moved by Mr. Lehman, seconded by Mr. Sharp and carried that the petition be recommended favorably to the Common Council with the further recommendation that the petitioner keep the number of proposed units at 24. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the excerpts of the minutes attached hereto and made a part of this report. REGUTAR MEETING JANUARY 10, 1966 ORDINANCE, THIRD READING ORDINANCE NO. 4825 -66 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 AS HERETOFORE AMENDED AND SUPPLEMENTED Location: South Side Western Avenue between Lombardy and Gladstone The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA (Location: 21 acre tract at Northwest Corner of McKinley Highway and Hickory Road) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be given public hearing on January 24, 1966. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCES, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ON THE 14th DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (Location: East side of Twyckenham between Corby and Campeau) The Ordinance was given first reading by title and second reading in full. Councilman Palmer made a motion that the ordinance be given public hearing on January 24, 1966. Councilman Allen seconded the motion. Motion carried. ORDINANCES- FIRST AND SECOND READING AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS FOR THE YEAR 1966 TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THERE- IN, IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 19 =51. The Ordinance was given first reading by title and second reading in full. The ordinance was given public hearing at this time. Speaking in favor of the ordinance was Mr. James Bickel, Controller. The ordinance was given third reading and passed by suspension of rules, 8 ayes, 0 nays, 1 absent. RESOLUTION NO. 126 -66 TO AMEND RESOLUTION NO. 106 -65 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE UNDERTAKING OF SURVEYS AND PLANS FOR AN URBAN RENEWAL PROJECT AND THE FILING OF AN APPLICATION. WHEREAS, under Title I of the Housing Act of 1949, as amended (Herein referred to as "Title I "). the Housing and Home Finance Administrator is authorized to extend financial assistance to local public agencies in the elimination and prevention of the spread of their slums and urban blight through the planning and undertaking of urbao renewal projects; and WHEREAS, it is desireable and in the public interest that the City of South Bend, Department of Redevelopment make surveys and prepare plans, presently estimated to cost approximately Two Hundred Seventy Four Thousand, Three Hundred and Fifty Eight Do7_lars ($274,358), in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of Title I in the proposed Urban Renewal Area, situated in the City of South Bend, County of St. Joseph and State of Indiana, which is described as follows: Beginning at a point which is the intersection of the North line of LaSalle Street and the west line of Main Street; thence easterly along the north line of LaSalle Street to the west bank of the St. Joseph River; thence southeasterly along the west bank of the St. Joseph River to the south line of Jefferson Boulevard: thence westerly along the south line of Jefferson Boulevard to the east line of St. Joseph Street; thence southerly along the east line of St. Joseph Street to the south line of Monroe Street extended; thence westerly along the south line of Monroe Street to the west line of Main Street extended: thence northerly along the west line of Main Street to the south line of Western Avenue; thence westerly along the south line of Western Avenue to the west alley line of the first alley west of Lafayette Boulevard; thence northerly along said alley extended to the north line of Washington Street; thence easterly along the north line of Washington Street to the west line of Main Street; and thence northerly along the west line of Main Street to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: 1. That the proposed Urban Renewal Area described above is a slum, blighted, deteriorated, or deteriorating area appropriate for an urban renewal project and that the undertaking by the City of South Bend, Department of Redevelopment surveys and plans for an urban renewal project of the character contemplated by Section 110(c) of Title I in the proposed Urban Renewal Area is hereby approved. 2. That the financial assistance available under Title I is needed to enable the City of South Bend, Department of Redevelopment to finance the planning and undertaking of the proposed Project. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including those relating to (a) the reloca- tion of site occupants,. (b) the provision of local grants -in -aid, (c) the prohibition of discrimination because of race, color, creed, or national origin, and (d) the requirement that the locality present to the Housing and Home Finance Administrator as a prerequisite to approval of the application described below, a workable program for community improvement, as set forth in Section 101(e) of Title I, for utilizing appropriate public and private resources to eliminate and prevent the development or spread of slums and urban blight. 4. That it is the sense of this body(a) that a feasible method for the relocation of individuals and families displaced from the Urban Renewal Area, in conformity with Title I, can be prepared, and (b) that the local grants -in -aid can and will be provided in an amount which will be not less than one -third of the Net Project Cost of the Project and which together with the Federal capital grant, will be generally equal to the difference between Gross Project Cost and the proceeds or value of project land sold, leased, or retained for use in accordance with the urban renewal plan. 5. That the filing of an application by the City of South Bend, Department of Redevelopment for an advance of funds from the United States of America to enable it to defray the cost of the surveys and plans for an urban renewal project in the proposed Urban Renewal Area described above is hereby approved. /s/ John L. Jan Chong, Executive Director of the Urban Redevelopment Commission. Councilman Muszynski made a motion for suspension of rules. Councilman Laven seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, i absent. The resolution was passed by a roll call vote of 8 ayes, 0 nays, 1 absent. There being no further business before the Council, Councilman Smith made a motion that the meeting be adjourned. Councilman Muszynski seconded the motion. Motion carried.
