HomeMy WebLinkAbout11-22-65 Council Meeting MinutesREGULAR MEETING NOVEMBER 22 1965 REGULAR MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers at City Hall, on Monday, November 22, 1965 at 8:13 P.M. , with all members present. The meeting was called to order by President John L. Hunter, Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Laven, Smith and Muszynski. President Hunter welcomed Rovert 0. Laven, flew councilman from the third district. Mr. Chtis Overgaard introduced Dr. Gehring;: instructor, of the Indiana University Speech class. Dr. Gehring introduced the members of his class who were present. REPORT OF COMMITTEE -ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PROGRESS REPORT A PROGRESS REPORT FOR THE WORKABLE PROGRAM FOR COMMUNITY IMPROVEMENT, Councilman Allen made a motion that the report be accepted. Councilman Palmer seconded the motion. Motion carried, 8 ayes, 1 nay (Councilman Geib). PETITION We, the undersigned, do :hereby respectfully make application and petition the Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance of=the_City of South Bend as hereinafter requested, and in support of this application, the following facts are shown: 1. The property sought to be rezoned is located on the North side of Corby Street at the junction of Woodcliff Drive and Corby Street in the City of South Bend. 2. The property is owned by Frank J. and Gaylene A. Coussens, Charles F. and Dorothy A. Coussens, Pail C. and Virginia I. Coussens and Henry J. and Mary Lou Coussens. 3. A legal description of the property is as follows: From "A" and "A" to "B" and "B" A part of the South half (2) of the North East One- quarter (4) of Section Five (5), Township Thirty- seven(37) North, Range at South west corner of the North East Quarter (4) of Section Five(5), Township Thirty = seven (37) North, Range Three(3) East, thence running East along the East and West center line of Section Five(5) 344.76 feet; thence North?I298':95 "feet;thence West 344.1 feet to the North and South center line of Section Five (5);_ thence South along said North and South center line 1296.8 feet to the place of beginning, containing 10.262 acres and being Tract No.8 on a Plat of Partition of South Half (2) of North East Quarter (4) of Section Five (5) Township and Range - aforesaid. and Also A part of the North East Quarter (4) of-Section Number Five(5), Township Number Thirty- seven(37) North, Range Number Three(3) East, which part is bounded by a line running as follows. viz: Beginning on the East and West center line of said Section, at a point Two Thousand Sixteen (2016) feet West of the South East corner of the North East Quarter (4) of said Section Number Five (5), thence running North Thirteen Hundred One and Ten Hundredths (1301.10) feet; thence West Three Hundred Thirty -six (336) feet; feet; thence South Twelve Hundred Ninety-eight-and Ninety Five Hundredths (1298.95).feet to the said center line; thence East along said center line Three Hundred Thirty -six (336) feet to the place of beginning, containing Ten and Twenty -seven Thousandths (10.027) acres, more or less, and being known as Tract Number Seven (7) on a plat of a partition of the South half (z) of the Northeast Quarter (4) of said Section Number Five (5), Township and Range aforesaid, located on the North side of Corby Boulevard between Simon Court and Harbor Drive, at the North end of Woodcliff Drive. 5. It is proposed that the property will be put to the following use and the following buildings will be constructed . "It is proposed that 260 multi family units, commonly known-As Town Houses of the same type recently erected by Petitioner on Hickory Road in the City of Mishawaka, Indiana, and other cities throughout the State will be erected on the property." 6. Two(2) off street parking spaces per residential unit will be provided. 7. Attached is a copy of: a) the plot plan showing my property and other surrounding properties; b) names and addresses of all the individuals, firms or corporations owning property within 300 feet of the property sought to be rezoned. Your Committee of the Whole to whom .was referred, "AN ORDINANCE AMENDING _AND SUPPLEMENTING ORDINANCE NO. 3702, AS HERETOFORE AMENDED AND SUPPLEMENTED (Location: South side of Western Avenue between Lombardy and Gladstone)." Respectfully report that they have examined the matter and that in their opinion the Ordinance be set over for Public Hearing on December 13, 1965. /s /:Edwin Thomas Smith, Chairman The report was accepted and placed on file. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to,whom was referred "AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 3702 (Location: Bounded on the north by Darden-Road, on the east by Riverside Dr.)." Respectfully report that they have examined the matter and that in their opinion the petitioner respectfully asks leave to withdraw its petition. /s/ Edwin Thomas Smith, Chairman Councilman Smith made a motion that the report be accepted and placed on file. Councilman Wise seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "AN ORDINANCE -`MORE COMMONLY KNOWN AS THE HUMAN RELATIONS AND FAIR EMPLOYMENT PRACTICES ORDINANCE" Respectfully report that they have examined the matter and that in their opinion the Ordinance be reset for Public Hearing on December 13, 1965, at which time the necessary amendments will be completed. /s/ Edwin Thomas Smith, Chairman Councilman Allen made a motion that the report be accepted and placed on file. REPORT OF AREA PLAN COMMISSION November 17, 1965 The Honorable Common Council City of South Bend,: South Bend, Indiana Gentlemen: The attached ordinance to amend Ordinance No. 3702, by the addition thereto of Section 17 -B, Off Street Parking and Loading Factilities was legally advertised under date of November,6, 1965 and given public hearing on November 16, 1965. The folloiaing action was taken: After due consideration it was moved by Mr. Lehman, seconded by Mr. Sharp and unanimously carried that the ordinance be recommended favorably to the Common Council. The deliberations of the Area Plan Commission in arriving at the hbove decision are shown in the excerpts of the minutes attached hereto and made a part of this report. ORDINANCES, FIRST AND SECOND READING ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA" (By the addition thereto of Section 17 -B, Off Street Parking and Loading Facilities) The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the Ordinance be set for Public Hearing on December 13, 1965. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING CHAPTER I. SECTION 12, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA -- 1962, AS ADOPTED AND CODIFIED ON OCTOBER 14, 1963, COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT ORDINANCE OF THE CITY OF SOUTH BEND: BY DIVIDING THE CITY OF SOUTH BEND, INDIANA INTO SIX COUNCILMANIC DISTRICTS AND FIXING THEIR BOUNDARIES: AND PROVIDING FOR THE USE OF VOTING MACHINES IN- ELECTIONS FOR NOMINATING AND ELECTING OFFICERS OF THE CITY OF SOUTH BEND, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT` THEREWITH. The Ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the Ordinance be set for Public Hearing on December 13, 1965. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE AMENDING ORDINANCE NO. 3232, ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THEREAFTER AMENDED AND AS ADOPTED AND CODIFIED OCTOBER 14, 19639 COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT ORDINANCE OF THE CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that the Ordinance be set for Public Hearing on December 13, 1965. Councilman Geib seconded the motion. Motion carried. ORDINANCE, FIRST AND SECOND READING AN ORDINANCE REGULATING THE SPEED OF TRAINS WITHIN THE MUNICIPAL CITY AND FORBIDDING THE SOUNDING OF A RAILROAD LOCOMOTIVE WHISTLE OR RAILROAD LOCOMOTIVE HORN WITHIN THE MUNICIPAL CITY AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. The Ordinance was given first reading by title and second reading in full. Councilman Allen made a motion that the Ordinance be set for Public Hearing on December 13, 1965. Councilman Laven seconded the motion. Motion carried. RESOLUTION NO. 125 -65 A RESOLUTION FOR AN ADDITIONAL APPROPRIATION IN THE TRAVELING EXPENSES ACCOUNT OF THE BUILDING DEPARTMENT IN THE AMOUNT OF $500.00 AND THE TRANSFER OF THE SAME FROM THE TRANSPORTATION ALLOWANCE ACCOUNT IN THE SAME CATEGORY, TO -WIT: SERVICES CONTRACTUAL, AND ALL BEING IN THE GEN- ERAL FUND. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was approp- riated in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and WHEREAS, Additional funds for travel expenses are urgently needed by the Building Department to assure its ability to properly perform its function and the sum of $500.00 is needed forthwith; and WHEREAS, A surplus exists in another account where it is not presently needed; and more specifically as follows, to -wit: 1. Five Hundred Dollars ($500.00) in Account MB -215 designated as Transportation Allowance. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $500.00 be transferred from Account MB -215 designated as Transportation Allowance, by transferring it to the following account, to -wit: 2. Five Hundred Dollars ($500.00) to Account MBA -213 designated as Traveling Expenses, both of said accounts being in the same category, to -wit: Services Contractual of the Building Department. John V. Wise Member of the Common Council Public Hearing was held on the above Resolution at this time. The Resolution was adopted by a roll call vote of 9 ayes, 0 nays. REGUIAR MEETING NOVEMBER 22 1965 there being no further business before the Council, Councilman Geib made a motion that the meeting be adjourned. Councilman Wise seconded the motion.
