Be it remembered that the Common Council of the City of South Bend, Indiana met in Regular Session
in the Council Chambers in the City Hall on Monday, August 23, 1965, at 8 :00 P.M. with all members
present except Councilman Glass, and Councilman Wise.
ROLL CALL PRESENT: Councilmen Hunter, Allen. Palmer, and Geib
Szymkowiak. Smith and Muszynski.
ABSENT: Councilman Glass, and Wise
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they
have inspected the minutes of the previous meeting of the Council and found them correct. They therefore
recommend that the same be approved.

Petition of Herbert and Verona M. Mielke Jr, to rezone property at 1121 North Hickory Road to 1°B"
Residential Zoning. Councilman Allen made a motion that the petition be referred to the City
Planning Commission. Councilman Palmer seconded the motion. Motion carried.
REPORT OF CITY PLANNING COMMISSION
August 17, 1965
The Honorable Common Council

South Bend, Indiana
Gentlemen:
The attached Central Business District Plan was legally advertised for public hearing under date
of July 26 1965. The following resolution was unanimously adopted:
WHEREAS it is necessary to adopt a Central Business District Plan as an addition
to the Comprehensive Plan of the City of South Bend, Indiana, and
WHEREAS the South Bend City Plan Commission has participated in the development
of a Central Business District Plan and
WHEREAS the completed Central Business District Plan has been reviewed by the South
Bend City Plan Commission
NOW THEREFORE be it resolved that the South Bend City Plan Commission:
1. Hereby adopt the Central Business District Plan in principal as an
outline to guide proper land use, circulation, and off street
parking for private and public development in Downtown South Bend, and
2. Recommend that the South Bend City Council enact an ordinance approving in
principal the Central Business District Plan as part of the South Bend
Comprehensive Plan.

The attached petition of the Crest Manor Development Corporation to annex to the City of South Bend
Indiana 4.47 acres of land in the North one--half of Section 31.. T37N R3E which tract is situated
approximately one - fourth of a mile south of Jackson Road in the vicinity of York Road as the same will
be extended southward from Jackson Road was Legally advertised under date of July 26. 1965 and given
public hearing on August 5, 1965.. The following action was taken:
After due consideration the Commission found that. in their opinion, the six determinates
of annexation apply to the area at issue. It was therefore duly moved seconded
and unanimously carried that the petition be recommended favorably to the Council.

Gentlemen:
The attached petition of the Common Council to annex to the City of South Bend, Indiana approximately
54 acres on the west side of Miami Road and Jackson Road, commonly known as the Jackson School property
was considered at the August 5, 1965 meeting of the Commission. The f ollowing action was z ken:
After due consideration the Commission found that, in their opinion, the six
determinates of annexation apply to the area at issue. It was therefore, duly moved,
seconded, and unanimously carried that the petition be recommended favorably to
the Council.

a motion that the ordinance be set for a public hearing on September 27th, 1965. Councilman Palmer

AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WATER WORKS OF THE CITY OF
SOUTH BEND AND JORDAN MOTORS, INC. FOR THE PURCHASE OF ONE 1966 FORD 22'
TON DUMP TRUCK IN THE SUM OF $3243.35
The ordinance was given first reading by title and second reading in full, Councilman Geib
made a motion that the ordinance be set for public hearing on September 27th, 1965. Councilman
Palmer seconded the motion. Motion carried.

OF THE CITY CEMETERIES DEPARTMENT IN THE AMOUNT OF #300.00 AND THE TRANSFER
OF THE SAME FROM THE TREE TRIMMING ACCOUNT OF THE CITY CEMETERIES DEPARTMENT,
ALL IN THE GENERAL FUND.
The ordinance was given first reading by title and second reading in full. Councilman Smith made
a motion that the ordinance be set for public hearing on September 27th, 1965. Councilman
Muszynski seconded the motion. Motion carried.

ELECTRICAL DEPARTMENT IN THE AMOUNT OF $1:335.00 AND THE TRANSFER OF THE
SAME FROM THE SERVICES - PERSONAL ACCOUNT OF THE ELECTRICAL DEPARTMENT, ALL IN
THEGENERAL FUND.

Szymkowiak made a motion that the ordinance be set for public hearing on September 27th 1965.
Councilman Geib seconded the motion. Motion carried,

ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $2 500.00 AND THE
TRANSFER OF THE SAME FROM THE SUPPLIES ACCOUNT OF THE SANITATION DEPARTMENT
ALL IN THE GENERAL FUND.
The ordinance was given first reading by title and second reading in full.
Councilman Geib called for a recess.

AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO THE SERVICES- CONTRACTURAL
ACCOUNT OF THE SANITATION DEPARTMENT IN THE AMOUNT OF $2,500.00 AND THE
TRANSFER OF THE SAME FROM SUPPLIES ACCOUNT OF THE SANITIATION DEPARTMENT
ALL IN Tim GENERAL FUND.
Councilman Geib made a motion to amend the ordinance deleting the words, "ORKIAE FOR
ADDITIONAL APPROPRIATIONS TO THE SERVICES- CONTRACTURAL ACCOUNT OF THE SANITATION DEPARTMENT IN "'
and inserting "TO TRANSFER FROM ACCOUNT XX -321 DESIGNATED AS SUPPLIES, GASOLINE, TO ACCOUNT
XX -252 SERVICES CONTRACTURAL, REPAIRS OF EQUIPMENT".
ALSO:
In paragraph (first WHEREAS) - to delete "APPROPRIATE MORE MONEY THAN WAS APPROPRIATED"
and insert - "TRANSFER OF FUNDS"
ALSO:
In paragraph 2 under NOW, THEREFORE - after ($2,500.00) insert "TO ACCOUNT XX -252"
Motion seconded by Councilman Smith. Motion carried.

DEPARTMENT, ALL IN THE GENERAL FUND.
The ordinance was given first reading by title and second reading in full.
Councilman Geib made a motion to amend the ordinance deleting the words, "ORDIIME FOR
ADDITIONAL APPROPRIATIONS TO THE SERVICES CONTRACTURAL ACCOUNT OF THE SANITATION DEPARTMENT IN ",
and inserting, "ORDINANCE TO TRANSFER FROM ACCOUNT XX -722, PROPERTIES, MOTOR EQUIPMENT,
TO ACCOUNT XX -252 SERVICES CONTRACTURAL, REPAIRS OF EQUIPMENT."
ALSO:
In paragraph ( first WHEREAS) delete, "APPROPRIATE MORE MONEY THAN WAS APPROPRIATED" , and
insert, "TRANSFER.-.FUNDS".
Motion seconded by Councilman Smith. Motion carried.
Councilman Geib made a motion to suspend rules for third reading of the ordinance. Councilman Palmer
seconded the motion. Motion carried, by a roll call vote of 7 ayes and 0 nays. Councilman Wise and
Glass absent.

Councilman Geib made a motion that, AN ORDINANCE REPEALING CHAPTER 12 OF THE MUNICIPAL CODE OF THE
CITY OF SOUTH BEND, INDIANA, 1962, BEING ORDINANCE NO. 4091 RELATING TO FAIR EMPLOYMENT PRACTICES,
be set over for consideration at the September 27th meeting. Councilman Palmer seconded the
motion. Motion carried.
BNFINISHED BUSINESS
Councilman Muszynski made a motion fbr' first and second reading of a tabled Ordinance to re -zone the
South East corner of Portage and Kinyon Streets. Motion lost for want of a second.
Councilman Smith made a motion that since there would be no meeting on September 13th, AN ORDINANCE
AMENDING CHAPTER 16, SECTION 28 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF
SOUTH BEND, INDIANA, 1962, REVOKING ANY AND ALL PROVISIONS IN CONFLICT THEREOF, SECTIONS 16 -28,
TRANSPORTING MATERIALS FROM OUTSIDE TO WITHIN THE CITY, be re- scheduled for public hearing on
September 27th, 1965. Councilman Allen seconded the motion. Motion carried.
There being no further business to come before the Council, Councilman Geib made a motion to adjourn.
Councilman Smith seconded the motion. Notion carried and Council adjourned at.8:50 P.M.
