HomeMy WebLinkAbout08-09-65 Council Meeting MinutesREGULAR MEETING AUGUST 9, 1965 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, August 9, 1965, at 8:31 P.M., with all members present except Councilmen Palmer and Glass. President Hunter announced that Councilman Palmer is out of the City. ROLL CALL PRESENT: Councilmen Hunter, Allen, Wise, Geib, Szymkowiak, S.mith'.and Muszynski. ABSENT: Councilmen Palmer and Glass. REGULAR ME=—G AUGUST 9, 1965 REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION August 6, 1965 The Honorable Common Council City of South Bend, Indiana Gentlemen: In view of the attached letter from the Salay's attorney, the City Planning Commission did not hold a public hearing on said petition. PETITION August 3, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The undersigned hereby petitions your honorable body to change the Height and Area District of the following described lots from "E" and "C" Height and Area District to "G" Height and Area District: Lots 10, 11 and 12 of Rockstroh Bros. Addition, being generally described as the Southeast corner of Bartlett and Michigan Streets. /s/ Thomas L. Hickey Thomas L. PETITION Petition of Charles and Pauline Menyhart to rezone 1,022 and 1024 -North Olive Street from "B" Residence District and "A" Height and Area District to "C" Commercial District and "B" Height and Area District. Councilman Allen made a motion that the petition be referred to the City Planning Commission. Councilman Smith seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: August 9, 1965 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING CLASSIFICATION OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA, FROM "A" HEIGHT AND AREA DISTRICT TO "E" HEIGHT AND AREA DISTRICT ". (Location: Southeast corner of intersection of Miami and Lincoln Way East covering 1114 through 1134 Lincoln Way East and 1232 through 1240 Miami). - Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as unfavorable. /s/ Edwin Thomas Smith, Chairman Councilman Allen made a motion that the report be accepted and placed on file. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: August 9, 1965 Your Committee of the Whole to whom was referred "AN ORDINANCE PROVIDING FOR THE REMOVAL OF WEEDS AND ESTABLISHING PENALTIES FOR FAILURE TO DO SO AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND SPECIFICALLY SECTIONS 16 -36, OF CHAPTER 16 OF THE MUNICIPAL CODE ". Respectfully report that they have examined the matter and that in their opinion the ordinance be withdrawn and a new ordinance be drafted and placed for first and second reading at the next regular meeting of the Council !� on August 23rd. Motion carried, i REPORT OF CITY PLANNING COMMISSION August 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: ■ The attached petition of Riverside North 1600, Inc., et al, to rezone from "D" Light Industrial Use and "D" and "E" Height and Area District to "B" Residential Use and "B" Height and Area District 9.2 acres, more or less, fronting on Riverside Drive and bounded on the West by Sherman Avenue and on the north by the rear lot line of those lots fronting on the south side of Rose Street was legally advertised under date of 3uly 26, 1965 and given • public hearing on August 5, 1965. The following action was taken: After due consideration the Commission found that the proposed zoning would be in the best interest of the subject area and of the City. Councilmen The ordinance was given third reading and lost by a roll call vote of 4 ayes (Hunter, Geib, Szymkowiak and lulus 3 nays (Councilmen Allen, Wise and Smith), 2 absent (Councilmen Palmer and Glass). ORDINANCE, FIRST & SECOND READING AN ORDINANCE REPEALING SECTION II OF CHAPTER 26 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO ALCOHOLIC BEVERAGES BEING PROHIBITED IN CERTAIN PLACES, AND SUBSTITUTING NEW SECTIONS IN LIEU OF THOSE REPEALED. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be set for public hearing on September 13, 1965. Councilman Smith seconded the motion. Motion carried. ORDINANCE NO. 4787 - -65 AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNO14N AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (9.2 acres of land on Riverside Drive between Sherman, Kinyon and Queen Sts.) The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion for suspension of rules. Councilman Smith- sdd6nded- therm6tion. Motion carried by a roll call vote of 7 ayes - 0 nays - 2 absent (Councilmen Palmer and Glass). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 2 absent (Councilmen Palmer and Glass). +38 REGULAR MEETING AUGUST 9, 1965 NEW BUSINESS Councilman Geib made a motion that the Urban Redevelopment indicate to the Council by September 13th what immediate steps can be taken to clear the vacant houses in blighted condition in the LaSalle Park area. Councilman Allen seconded the motion. Motion carried. There being no further business to come before the Council, Councilman Smith made a motion to adjourn. Councilman Muszynski seconded the motion.
