HomeMy WebLinkAbout08-09-65 Council Committee of the Whole Meeting MinutesREGULAR- MEETING-- MEETING -- -- JULY _29__1965___ COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City in the Council Chambers in the City Hall on Monday, except Councilmen Palmer and Glass. The Meeting was who presided. AUGUST 9, 1965 of South Bend, Indiana, met in the Committee of the Whole August 9, 1965, at 8:02 P.M., with all members present called to order by Councilman Edwin Thomas Smith, Chairman, Councilman Hunter asked the Clerk to notify the City Planning Commission to have a representative attend the next meeting of the Council on August 23rd, 1965 to advise the Council on zoning matters. ORDINANCE AN ORDINANCE AMENDING ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING CLASSIFICATION OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA, FROM "A" HEIGHT AND AREA DISTRICT TO "E" HEIGHT AND AREA DISTRICT. (Southeast corner of intersection of Miami and Lincoln Way East covering 1114 through 1134 Lincoln WayEast and 1232 through 1240 Miami). This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. Charle6 Roemer, Attorney for the i petitioners, who informed the Council of an error in legal description of ordinance. Councilman Allen made a i motion to amend the legal description of the ordinance. Councilman Wise seconded the motion. Motion carried. Councilman Allen then made a motion that the ordinance go to the Council as unfavorable. Councilman Geib seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702. (North by Calvert, East by Grant St., South by Ewing Ave. and alley between Ewing and Highland Aves.) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Allen seconded the motion. Motion carried. 4Q COMMITTEE OF THE WHOLE MEETING AUGUST 9, 1965 ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (North by Western, East by alley East of Walnut, South by first alley South of Western, West by first alley West of Harris St.) This being the time heretofore set for public hearing, proponents and opponents were given an opportunity to be heard thereon. Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Between Westem Ave., Grand Trunk RR right -of -way, alley East of Walnut, and alley West of Harris St.). This being the time heretofore set for public hearing, proponents and opponents were given an opportunity to be heard thereon. Councilman Muszynski made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. ORnTNANC R AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (North by the N.Y. Central RR, East by Robinson and Sampson Sts.., South by Calvert and West by Twyckenham Drive). This being the time heretofore set for public hearing, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen made a motion that the ordinance go to the Council as favorable. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE PROVIDING FOR THE REMOVAL OF WEEDS AND ESTABLISHING PENALTIES FOR FAILURE TO DO SO AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND SPECIFICALLY SECTIONS 16 -36, OF CHAPTER 16 OF THE MUNICIPAL CODE. This being the time heretofore set for public hearing, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen made a motion that the ordinance be withdrawn and a new ordinance be drafted and placed for first and second reading at the next regular meeting of the Council on August 23rd. Councilman Geib seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING $5,000.00 FOR THE USE BY THE STREET DEPARTMENT FOR EXPENSES IN CONNECTION WITH WEED REMOVAL; SAID $5,000.00 BEING PROCEEDS OF THE 1961 MUNICIPAL BOND ISSUE. Councilman Hunter made a motion to withdraw the above ordinance. Councilman Geib seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING CHAPTER 16, SECTION 28 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, REVOKING ANY AND ALL PROVISIONS-IN CONFLICT THEREOF. Councilman Hunter made a motion that the ordinance be set for public hearing on September 13, 1965. Councilman Szymkowiak seconded the motion. Motion carried. There being no further business to come before the Committee of the Whole, the Chair will entertain a motion to rise and report to the Council.
