HomeMy WebLinkAbout06-14-65 Council Meeting MinutesCOMMITTEE OF THE WHOLE MEETING JUNE 14 1965 ORDINANCE REGULAR MEETING JUNE 14, 1965 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers in the City Hall on Monday, June 14, 1965, at 9:57 P.M., with all members present except Councilmen Geib and Glass. The Meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, - Szymkowiak, Smith and Muszynski, ABSENT: Councilmen Geib and Glass. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of May 24, 1965 /s/ John L. Hunter Jr. ) Committee " Janet S. Allen ) Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Palmer seconded the motion. Motion carried. COMMUNICATION Communication from Councilman Geib that due to business reasons he would be in Washington the week of June 14th, therefore unable to attend the Council meeting. There being no objections,the communication was accepted and placed on file. REGULAR ME ETING JUNE 14, 1965 COMMUNICATION Communication from W. E. Voor, Attorney for petitioner, to withdraw petition to rezone Southeast corner of ! Portage and Kinyon. !I There being no objections, the communication was accepted and placed on file. PETITION Petition of Community Teleception, Inc., for a license and exclusive franchise for the purpose of operating a Community Antenna television system in the City of South Bend. Councilman Smith made a motion that the petition be referred to the Board of Public Works. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of William E. Dvorak, et al, to rezone Use District and "B" Height and Area District to Wise made a motion that the petition be referred motion. Motion carried. PETITION Southeast corner of Portage and Kinyon from "B" Residential "C" Use District and "B" Height and Area District. Councilman to the City Planning Commission. Councilman Smith seconded the Petition of Robert A. Kober, et al, to change Height and Area District classification on a triangular strip of property located to the Southeast of the intersection of Lincoln Way East and Miami St. Councilman Smith made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. (Location: Property at 2104 Edison Road (total of 3 lots). These lots are the first three lots immediately west of the "Capri" Restaurant). Use and F & A Height and Area District to A Residential Use and A �� Height and Area District the property generally being bounded on the East by McPherson Street, on the West by Walnut Street, on the North by,the South Bend, St. Joseph and Southern Railroad and on the south by Indiana Avenue was legally advertised under date of May 24, 1965 and given public hearing on June 3, 1965. The following action was taken: After due consideration the Commission found that of an apparent 81 lots, 76 appear to be used residentially (72 for single family dwellings, 2 for apartment buildings and two residential - commercial uses). The following action was taken: After due consideration the Commission found that the predominant use in the subject area is single family residential and that the proposed zoning would be in the best interest of the subject area. Gunn Jr, to rezone from "A" Residential Use to "B" Residential Use 305 Manchester Drive was legally advertised under date of May 24, 1965 and given public hearing under date of June 3, 1965. The following action was taken: After due consideration the Commission found that the proposed zoning would provide a buffer between the highway and commercial uses and the dwellings to the north of the subject property. The following action was taken: After due consideration the Commission found that the six determinants of annexation apply to the area at issue. REGULAR MEETING JUNE 14 1965 REPORT OF CITY PLANNING COMMISSION May 11, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend approximately 138 acres bounded on the North by Darden Road, on the West by the St. Joseph River, on the South by the Northern Indiana Toll Road, and on the East by the West boundary line of Brooktrails Subdivision was legally advertised under date of April 26, 1965 and given public hearing on May 6, 1965. The following action was taken: After due consideration the Commission found that in their considered opinion the six determinants of annexation apply to the area at issue. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Geib and Glass). The ordinance, as amended, was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmet Geib and Glass). RESOLUTION NO. 100 - -65 RESOLUTION OF THE CITY COUNCIL CITY OF SOUTH BEND WHEREAS, the Chicago South Shore and South Bend Railroad is now and has been an integral and important part of this community, and WHEREAS, the Chicago South Shore and South Bend Railroad has been most cooperative in civic improvements such as the airport industrial park, and WHEREAS, the services of the Chicago South Shore and South Bend Railroad to the City of South Bend are most important indeed, and , WHEREAS, this Council has been informed of negotiations between the Chicago South Shore and South Bend Rail- road and the Chesapeake and Ohio Railway for a merger, and WHEREAS, this Council is of the considered opinion that such merger would be most beneficial to the City of South Bend; , NOW, THEREFORE, BE IT RESOLVED, That this Council does hereby publicly express its opinion that such merger is in the best possible interests and does hereby request the Interstate Commerce Commission to take favorable and prompt action on Finance Docket No. 23566, which is the application of the Chesapeake and Ohio Railway to control the Chicago South Shore and South Bend Railroad. REGULAR MEETING JUNE 14 1965 UNFINISHED BUSINESS President'Hunter announced that the Clerk address a communication to the City Planning Commission that the Common Council in its entirety requests that petitions, reports and ordinances for first and second reading will not be accepted during the same evening. Petition must be submitted first, followed thereafter with report and ordinance and there will be no deviation from this rule. The Clerk was instructed to ask Richard J. Duck, Clerk of the Board of Public Works and Safety, to get an estimate of the cost of repairing the public address system in the Council Chambers and report back before the next Council meeting. The regular meeting of the Council scheduled for June 28th will be cancelled until July 12th. NEW BUSINESS President Hunter announced the appointment of Councilman Allen to serve as the Council's representative on the City Planning Commission during the illness of Councilman Glass.
