The Meeting was called to order President John L. Hunter, who presided. ROLL CALL PRESENT: Councilmen Hunter, Allen, Palmer, Wise, Geib, Szymkowiak, Smith and Muszynski. ABSENT: Councilman Glass. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Gunn to rezone property at 305 Manchester Drive from zoning classification of "A" Residential to "B" Residential. Councilman Geib made a motion that the petition be referred to the City Planning Commission. Councilman Allen seconded the motion. Motion carried. COMMUNICATION R E S O L U T I O N CITIZENS' COMMITTEE AGAINST FLUORIDATION OF SOUTH BEND, INC. May 5, 1965 WHEREAS, Citizens' Committee Against Fluoridation of South Bend, Ind. and its individual members accept as true and valid the following facts and principles: 1. The principle of fluoridation of community water supplies is radically different from chlorination; the latter is justified as a proper exercise of the police power and as a public health function, as chlorine is added to counteract bacteria; fluoride is added, not to purify the water, but to affect the user. 2. Tooth decay is neither infectious nor contagious. The use of the city water system for the application of fluoride means that the fluoride treatment becomes compulsory for all persons who have to rely upon the city water supply. A resident would thus be deprived of the right to decide of his own free will whether he desires to use fluoride for his children's teeth or to use it himself. The right of a citizen to make this determination is a personal liberty which falls within the constitutional protection of due process under the Constitution of the United States and the Constitution of the State of Indiana. 3. The cumulative, long term effects of fluoridated water on the human body, other than the teeth, have not, to date, been made the subject of any thorough, scientifically supervised, long range research or study by the medical profession or any scientific group. Until such research or study is made, it cannot be stated with conclusive medical certainty that fluoridated water is not harmful to human health. An editorial opinion was voiced by the South Bend Tribune in its issue of May 2, 1965, implying that the lack of a fluoridated public water supply in South Bend would be a factor against the selection of South Bend as a site for a new medical center. On the contrary, the status of fluoride in the water would and should have no effect, pro or con, upon such an important policy decision. Such a needed research program of the effects of fluoridated water on all aspects of human health might well serve as an initial and attractive research project for any medical school which might be located in this area. 4. Fluoride should be administered in prescribed, controlled dosage with such precautions as are customarily employed in the administering of any other potentially dangerous drugs. 5. Fluoride can be provided with greater economy to the individual by voluntary, controlled methods rather than when handled through a government agency, such as the water supply. BE IT THEREFORE RESOLVED, that the Citizens' Committee Against Fluoridation of South Bend, Inc, and its individual' members go on record as condemning the principle of the fluoridation of our pulS is water supply and respectfully suggest that the Council can take some convenient and adequate alternate action instead of fluoridating the general water supply. Councilman Allen made a motion that the communication be referred to the Public Improvement Committee of the Council. Councilman Smith seconded the motion. Motion carried. REPORT OF SEWAGE TREATMENT PLANT Councilman Geib made a motion that the Financial and Operational Report for year ended December-31, 1964 of Sewage Treatment Plant be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: May 24, -1965 Your Committee of the Whole to whom was referred "AN ORDINANCE REPEALING SECTIONS 16 TO 36, INCLUSIVE, OF CHAPTER 35 OF ORDINANCE NO. 4608 -63, BEING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, RELATING TO EXCAVATIONS AND OBSTRUCTIONS IN STREETS,'ALLEYS, AND PUBLIC PLACES AND SUBSTITUTING NEW SECTIONS IN LIEU OF THOSE REPEALED, AS AMENDED ". REGULAR MEETING MAY 24 1965 REPORT OF CITY PLANNING COMMISSION May 10, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the city of South Bend, Indiana an irregular tract of land situated East of Miami Road near Jackson Road and abutting the city limits on its southern boundary was legally advertised under date of April 26, 1965 and given public hearing on May 6, 1965. The following action was taken: After due consideration the Commission found that in their opinion the six determinants of. annexation apply to the area at issue. The following action was taken: After due consideration the Commission found that the proposed zone change would not be in the best interest of the surrounding area; would not constitute the best use of subject land, and would impair proper d"evelgpmerit of surrounding vacant land to the north and to the south. My clients have requested that the matter not be presented to the Common Council, hence no zoning ordinance will be submitted. REGULAR MEETING MAY 24 1965 REPORT OF CITY PLANNING COMMISSION May 13, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Joseph and Tina Zappia was legally advertised on March 22, 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found the commercial use of subject property would be an unwarranted extension into a residential neighborhood; that ample commercial property exists; that the property is not necessarily commercial in nature; that residential uses exist to the north and to the west; that there is no demonstrated need for additional commercial land in the vicinity; that, in fact, there exists approximately 1800 feet of unused commercial zoning between Edison and South Bend Avenue on Ironwood and that therefore sufficient commercial, sufficient vacant commercial as well as commercially zoned land not used for commercial purposes exists in the area. REGULAR MEETING MAY 24 19-65 RESOLUTION NO. 97 - -65 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OTHER EQUIPMENT ACCOUNT OF THE FIRE DEPARTMENT IN THE AMOUNT OF SEVEN HUNDRED FIFTY DOLLARS $750.00 AND THE TRANSFER OF THE SAME FROM THE MOTOR EQUIPMENT ACCOUNT IN THE SAME CATEGORY, TO -WIT: PROPERTIES, AND ALL IN THE GENERAL FUND. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated in the annual .budget for the various functions of City Government to meet such extraordinary contingencies; and WHEREAS, Additional funds for other equipment are urgently needed by the Fire Department to assure its ability to propertly perform its function and the sum of $750.00 is needed forthwith; and WHEREAS, A surplus exists in: another account where it is not presently needed at this time; and more specifical as follows, to -wit: 1. Seven Hundred Fifty Dollars in Account Q -722 designated as Properties, Motor Equipment. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, That the sum of $750.00 be transferred to Account No. Q -726 designated as Properties, Other Equipment, by transferring it from the following account, to -wit: 2. Seven Hundred Fifty Dollars ($750.00) from Account Q -722, both of said accounts being in the same category, to -wit: Properties of the Fire Department. /s/ Richard G. RESOLUTION NO. 98 - -65 RESOLUTION FOR ADDITIONAL APPROPRIATIONS IN THE OTHER OFFICE SUPPLIES ACCOUNT OF THE ENGINEERING DEPARTMENT IN THE AMOUNT OF $200.00 AND THE TRANSFER OF THE SAME FROM THE STATIONERY AND PRINTING AND GASOLINE ACCOUNTS IN THE SAME CATEGORY, ALL IN THE GENERAL FUND. WHEREAS, Certain extraordinary conditions have developed since the adoption of the existing annual budget, so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various functions of City Government to meet such extraordinary contingencies; and, WHEREAS, Other office supplies are urgently needed by the Engineering Department to assure its ability to properly perform its function and the sum of $200.00 is needed forthwith; and WHEREAS, A surplus exists in other accounts where it is not presently needed at this time; and more specifically as follows, to,"wit: , 1. UNFINISHED BUSINESS Councilman Muszynski asked that the City take action to protect motorists at the Olive and Sample Street railroad crossing and to solve a "sandstorm" problem in the 1900 block of Sample Street.
