HomeMy WebLinkAbout05-10-65 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THEW OL MAY 10s 15165 _ Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in the City Hall on Monday, May 10, 1965, at 8:00 P.M., with all members present except Councilmen Allen and Glass. The meeting was called to order by Councilman Edwin Thomas Smith, Chairman, who presided. Chairman Smith introduced the Reverend Orla Bradford of Broadway Evangelical United Brethren Church, who gave the invocation. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE (3401 Lincoln Way West) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance were F. Jay Nimtz, Attorney, representing petitioners, Oden R. and Martha E. Robertson, and Glen Huston of 3635 Lincolnway West. Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND ON THE 14TH DAY OF JUNE, 1949, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (RQrthwest corner of Lincoln Way West and Iowa Street) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Russell Fisher, Attorney, who represented John T. Hartman and Virginia Pearl HArtmati. Councilman Palmer made a motion that the ordinance go to the Council as favorable. Councilman Hunter seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ZONING ORDINANCE N0, 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA. (Southeast corner of intersection of Miami and Lincolnway East covering 1114 through 1134 Lincolnway East and 1232 through 1240 Miami) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Thomas Roemer, Attorney, who appeared in behalf of his brother, Charles Roemer, Attorney for petitioners. Speaking against the proposed ordinance were Mr. and Mrs. C. F. Setterland of 1221 Miami St. and Charles Conrad of 1207 Miami St. Councilman Hahn made a motion that the ordinance go to the Council as favorable, but withdrew his motion when Mr. Setterland asked to be heard again.Counczlman Hunter: made a motion that the ordinance go to the Council as favorable. Councilman Geib seconded the motion. Motion carried. ORDINANCE ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Southwest corner of Ryer St. and Lincoln Way West) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Robert L. Miller, Attorney, representing Hartman Builders;,; Inc. and Humble Oil and Refining Company. Speaking against the proposed ordinance was Edwin Wroblewski of 3427 St. John's Way. Mr. James E. Nichols of 3509 St. John's Way also remonstrated against the proposed ordinance. Councilman Hunter made a motion that the ordinance be continued for public hearing until May 24th. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS. (Rectangular parcel of land on east side of York Road commencing approximately 370 feet south of Jackson Road) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed Ordinance for petitioners was Mr. Warren McGill, Attorney. Councilman Muszynski made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. RESOLUTION A RESOLUTION APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE SEWAGE DISPOSAL PLANT OF THE CITY OF SOUTH BEND AND ROBERT L. MILLER, AGENT FOR AN UNDISCLOSED PRINCIPAL, FOR FURNISHING OF WATER AND SEWAGE TREATMENT TO CLAY TOWNSHIP, ST. JOSEPH COUNTY, INDIANA. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Mr. Robert L. Miller, Agent for undisclosed principal, Party of the First Part, appeared before the Council. The Clerk read a report from the Capital Improvements Committee, as follows: (Continued) MAY 10. 1965 To the Common Council of the City of South Bend: May 10, 1965 189 Your Committee on Capital Improvements to whom was referred "A RESOLUTION APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE SEWAGE DISPOSAL PLANT OF THE CITY OF SOUTH BEND AND ROBERT L. MILLER, AGENT FOR AN UNDISCLOSED PRINCIPAL, FOR FURNISHING OF WATER AND SEWAGE TREATMENT TO CLAY TOWNSHIP, ST. JOSEPH COUNTY, INDIANA ". Respectfully report that they have examined the matter and that in their opinion the Resolution be reported to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Hunter made a motion that the resolution go to the Council as favorable. Councilman Geib seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Hunter made a motion to adjourn.
