HomeMy WebLinkAbout04-27-65 Council Meeting MinutesREGULAR MEETING APRIL 27, 1965 Be it remembered that the Common Council of the City of South Bend., Indiana, met in Regular Session in the Council Chambers in the City Hall on Tuesday, April 27, 1965, at 9 :48 P.M., with all members present except Councilmen Geib and Glass. The Meeting was called to order by President John L. Hunter Jr., who presided. ROLL CALL PRESENT: Cou cilmen Rfihter,Alleny ?almer, Wise, Szymkowiak, Smith and Muszynski. ABSENT: Councilmen Geib and Glass. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved.. Is/ John L. Hunter Jr. Committee Meeting of April 12, 1965. Is$ Janet S. Motion carried. 183 REGULAR - MEETING APRIL 27s_ 1965 PETITION Petition of Irvin F. and Gertrude E. Sikorski, Genevieve Leaman and Eleanore Bucholtz to rezone property at 602 to 606 So. Walnut St. Councilman Smith made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Council to annex 29.84 acres, more or less,bounded on east, north and south by present city limits, on the west by Maple Road between Cleveland Road and Lathrop. Councilman Allen made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION Petition of Council to annex 167.79 acres, more or less, being generally between Colfax Road and Northern Indiana Toll Road, bounded on east, south and west by city limits and fronting on Portage Road. Councilman Smith made a motion that the petition be referred to the City Planning Commission. Councilman Palmer seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Humble Oil Company, Inc. to rezone from "B" Residential Use and "B" Height and Area District to "C" Commercial Use and "B" Height and Area District a parallelogram having 200 feet frontage on the southerly right -of -way line of Lincoln Way West and 139 feet frontage on the west right -of -way line of Ryer Street was legally advertised.under date of February 12, 1965 and given public hearing on February 23, 1965. The following action was taken: After due consideration the Commission found that the proposed zoning would be an unwarranted intrusion into a residential neighborhood. It was therefore duly moved, seconded, and uanimously carried that the petition be recommended unfavorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: April 27, 1965 Your Committee of the Whole to whom was referred "AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS ". (Location: East of Miami Road, South of Ireland Road, North of Jackson Road, and contiguous with the present city limits on the north and east sides). Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Muszynski made a motion that the report be accepted and placed on file. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: April 27, 1965 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING ZONING ORDINANCE NO. 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING OF CERTAIN LAND SITUATED WITHIN THE CITY OF OF SOUTH BEND, INDIANA ". (Location: Southeast corner of intersection of Miami and Lincolnway East covering 1114 through 1134 Lincolnway East and 1232 through 1240 Miami). Respectfully report that they have examined the matter and that in their opinion this ordinance be tabled for two weeks and referred back for public hearing on May 10th. /s/ Edwin Thomas Smith, Chairman Councilman Smith made a motion that the report be accepted and placed on file. M, .f; REGULAR MEETING APRIL 27-165 — REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: April 27, 1965 Your Committee of the Whole to whom.was referred "AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA ". (Location: Hickory Road, approximately 726 feet North of McKinley Highway on the West side of Hickory Road. It is a tract of land having a frontage of 125 feet on Hickory Road and a depth of 200 feet). Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. /s/ Edwin Thomas Smith, Chairman Councilman Muszynski made a motion that the report be accepted and placed -on file. CLOW & SONS, INC., FOR THE PURCHASE OF CAST IRON WATER MAIN PIPES AND FITTINGS IN THE SUM OF $723,385.00 ". INC., FOR TWO 16 -INCH INSERTING VALVES, THREE 6 -INCH INSERTING VALVES, TWO 8 -INCA INSERTING VALVES AND TWO 4 -INCH INSERTING VALVES IN THE SUM OF $9,071,00;.'. Motioiicarried. 85 REGULAR MEETING APRIL 27, 1965 REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: April 27, 1965 Your Committee of the Whole to whom was referred "AN ORDINANCE TRANSFERRING $76,401.17 FROM THE BARRETT LAW FUND TO THE GENERAL FUND OF THE CITY OF SOUTH BEND ". ORDINANCE NO. 4743 - -65 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. ORDINANCE N0. 4750 - -65 AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO THE SANITATION DEPARTMENT ACCOUNTS XX263, XX71, XX722, AND XX73 IN THE TOTAL AMOUNT OF $34$00.00. ORDINANCE, FIRST & SECOND READING ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Southwest corner of Ryer Street and Lincoln Way West) The ordinance was given first reading by title and second reading in full. Councilman Szymkowiak made a motion that the ordinance be set for public hearing on May 10, 1965. Councilman Wise seconded the motion. Motion carried. RESOLUTION A RESOLUTION RELATIVE TO THE INTRODUCTION OF FLUORIDES INTO THE PUBLIC WATER SUPPLY WHEREAS investigation by competent dental,medical and public health authorities show that the presence of fluoride in drinking water is a deterrent to tooth decay; and WHEREAS laboratory analysis shows that such chemical substance in optimum quantities is not found naturally in the public water supply of South Bend, Indiana; and WHEREAS Regulation HSE 2 of the Indiana State Board of Health permits the addition of certain fluoride compounds to public water supplies within controlled limits: THEREFORE BE IT RESOLVED that the City Council of South Bend is hereby petitioned and requested to provide the means for, and to proceed.with whatever action is necessary that will result in the addition of suffic quantities of fluoride compound to the public water supply to bring the total amount of fluoride ions (F 1) present in the finished water to the optimum concentration recommended by State Board of Health but not exceeding 1.5 parts per million by weight. RESOLUTION A RESOLUTION APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE SEWAGE DISPOSAL PLANT OF THE CITY OF SOUTH BEND AND ROBERT L. MILLER, AGENT FOR AN UNDISCLOSED PRINCIPAL, FOR FURNISHING OF WATER AND SEWAGE TREATMENT TO CLAY TOWNSHIP, ST. JOSEPH COUNTY, INDIANA. Councilman Smith made a motion that the Resolution be referred to the Capital Improvement Committee and setifor public hearing on May 10, 1965. Councilman Wise seconded the motion. Motion carried. REGULAR MEETING APRIL 27, 1965 NEW BUSINESS: Councilman Smith asked the Council to investigate some means of warning to all residents in the city and county of the threat of disaster such as the Palm Sunday tornadoes. At the request of Councilman Glass, Councilman Wise was appointed as the Council's temporary representative to the Area Planning Commission. Councilman Allen informed the Council that she will be absent from the next meeting of the Council on May 10th. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Councilman Szymkowiak seconded the motion. Motion carried and Council adjourned at 10:25 P.M.
