HomeMy WebLinkAbout04-27-65 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THE WHOLE MEETING APRIL 27, 1965 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers in the City Hall on Tuesday, April 27, 1965, at 8;05 P.M., with all members present except Councilmen Geib and Glass. The meeting was called to order by Councilman Edwin Thomas Smith, Chairman, who presided. Chairman Smith introduced the Reverend Clifford 0. Nantz, Executive Secretary of Council of Churches of St. Joseph County, who gave the invocation. ORDINANCE AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS. (26.6 acres, more or less, East of Miami Road, South of Ireland Road, North of Jackson Road, and contiguous with the present city limits on the north and east sides) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking against the proposed ordinance was Mrs. Louise Goss, 59844 Miami Road. Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Huszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING - ZONING ORDINANCE N0, 3702 OF THE CITY OF SOUTH BEND, AS AMENDED, FOR THE PURPOSE OF CHANGING THE ZONING OF CERTAIN LAND SITUATED WITHIN THE CITY OF SOUTH BEND, INDIANA. (Southeast corner of intersection of Miami and Lincolnway East) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Charles Roemer, Attorney, representing all of the property owners who live within this triangular tract. Speaking against the proposed ordinance were Mr. and Mrs. C. F. Setteriand of 1221 Miami St, and Charles I Conrad of 1207 Miami St. Councilman Hunter made a motion that the ordinance be tabled for two weeks and referred back for public hearing on ORDINANCE (May 10th. Councilman Wise seconded the motion. Motion carried. AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF•SOUTH BEND, INDIANA. (Tract of land having a frontage of 125 feet on Hickory Road and a depth of 200 feet) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of the proposed ordinance was Attorney Samuel Schulman, representing petitioners along with Attorney Frederick K. Baer. John Siberell, 228 Timber Lane, asked whether the rezoning would commercialize all the property on the west side of Hickory North of McKinley. 5 MINUTE RECESS - 8:55 P.M. Councilman Hunter made a motion for a five minute recess. Councilman Wise seconded the .motion. Motion carried. RECONVENED MEETING - 9:00 P.M. ORDINANCE AN ORDINANCE TO A-= ORDINANCE NO. 37022 AS AMENDED, WHICH ORDINANCE IS COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Tract of land having a frontage of 125 feet on Hickory Road and a depth of 200 feet) Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND JAMES B. CLOW & SONS, INC., FOR THE PURCHASE OF CAST IRON WATER MAIN PIPES AND FITTINGS IN THE SUM OF $72,385.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Palmer made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE ADVANCE CONSTRUCTION CO., INC., FOR TWO 16 -INCH INSERTING VALVES, THREE 6 -INCH INSERTING VALVES, TWO 8 -INCH INSERTING VALVES AND TWO 4 -INCH INSERTING VALVES IN THE SUM OF $93,071.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Hunter made a motion that the ordinance go to the Council as favorable._ Councilman Wise seconded the motion. Motion carried. _ COMMTTTFE OF THE WHOLE MEETING APRIL 17.,-1965 ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND CITY WATER WORKS AND THE MUELLER CO. FOR MECHANICAL JOINT GATE VALVES IN THE SUM OF $79292.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Wise made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING ($3,460.00) TO THE OFFICE OF THE CITY JUDGE FOR THE PAYMENT OF A BAILIFF; SAID ($3,460.00) TO BE A TRANSFER FROM POLICE DEPARTMENT BUDGET ACCOUNT P -11 TO ACCOUNTS E -11 AND E -215, OFFICE OF THE CITY JUDGE, ALL WITHIN THE GENERAL FUND. This being the time heretofore set for public hearing on the above Ordinance, prpponents and opponents were given an opportunity to be .heard thereon. Councilman Hunter made a motion that the ordinance go to the Council as favorable. Councilman Palmer seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING $76,401.17 FROM THE BARRETT LAW FUND TO THE GENERAL FUND OF THE CITY OF SOUTH BEND. This being the time heretofore set for public hearing on the above Ordinance, prpponents and opponents were given an opportunity to be heard thereon. Councilman Szymkowiak made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS IN THE GENERAL IMPROVEMENT FUND IN THE, AMOUNT OF $413,901.17. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an.opportunity to be heard thereon. Councilman Szymkowiak made a motion that the ordinance go to the Council as favorable. Councilman Wise seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO THE SANITATION DEPARTMENT ACCOUNTS XX263, XX71, XX722, AND XX73 IN THE TOTAL AMOUNT OF $34,500.00. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Councilman Allen made a motion that the ordinance go to the Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. There being no further business before the Committee of the Whole, Councilman Allen made a motion to adjourn. Councilman Hunter seconded the motion.
