The Meeting was called .to order by,Vice- President John V. Wise, who presided. ROLL CALL PRESENT: Councilmen Allen, Palmer, Wise, Geib, Szymkowiak, Smith and Museynski. ABSENT: Councilmen Hunter and Glass. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your-Committee on" the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION South Bend City Planning Commission March 17, 1965 129 West Colfax Avenue South Bend, Indiana Re: Petition of Humble Oil Gentlemen: It is requested that the first petition filed on behalf of Humble Oil which related to the entire lot be dismissed. REGULAR MEETING APRIL 12, 1965 REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend, Indiana Gentlemen: The attached petition of the Common Council to annex to the City of South Bend, Indiana 26.6. acres, more or less, situated East of Miami Road, South of Ireland Road, North of Jackson Road and contiguous with the present city limits on the north and east sides was legally advertised under date of March 22, 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found that the six determinants of annexation apply to the area in issue. It was therefore duly moved, seconded, and unanimously carried that the petition be recommended favorably to the Council. Very truly yours, CITY PLANNING COMMISSION Robert L. REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Crest Manor Development Corporation to annex to the City of South Bend, Indiana a rectangular parcel of land lying 400 feet South of the centerline of Jackson Road and 165 feet East of the centerline of York Road, containing 6.88 acres, more or less, was legally advertised under date of March 22,: 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found that the six determinants of annexation apply to the area in issue. REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of the Oxford Development Corporation to rezone from "A" Residential Use to "A -2" Residential Use the property generally described as bounded on the North by Darden Road, on the East by Riverside Drive, on the South by the Northerly boundary of Riverside Manor 2nd Section, and on the West by an extension of Glenview Drive was legally advertised under date of March 22, 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found that due to the shape and location of the subject tract of land, the proposed use would not be in the best interest of the surrounding area, nor would it be the best use of the land. BRGuLAR MEETING Artci.L iL, L7VJ REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Oden & Martha Robertson to rezone from "A" Residential Use and "A" Height and Area District to "C" Commercial Use and "A" Height and Area District a trapizoidal shaped parcel of land lying approximately 200 feet West of Iowa Street and being bounded on the North by Elwood Avenue and on the South by Lincoln Way West was legally advertised under date of December 28, 1964 and given public hearing on January 7, 1965. The following action was taken: After due consideration the Commission found that the proposed rezoning would be in the best interest of the subject area. REPORT OF CITY PLANNING COMMISSION April 6; 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of John Hartman and Virginia Crawford to rezone from "A" Residential Use and "A" Height and Area District to "C" Commercial Use and "B" Height and Area District a trapezoidal shaped parcel of land bounded on the North by Elwood Street, on the East by Iowa Street, on the Southwest by Lincoln Way West and being 230.44 feet deep east and west was legally advertised under date of February 12, 1965 and given public hearing on February 23, 1965. The following action was taken; After due consideration the Commission found that the proposed zoning would be in the best interest of the subject area and a natural extension of the commercial zoning to the east. REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of John H. and Maude A. Mink, et al, to rezone from "B" Residential Use to "C" Commercial Use the property generally located at the Southeast corner of Miami and Lincoln Way East was legally advertised under date of March 22, 1965 and given public hearing on April 1, 1965. The following adtion was taken: After due consideration the Commission found that the proposed rezoning would not be in the best interest of the subject area, that sufficient commercial zoning exists in the area, and that commercial development of this area would generate a serious traffic problem. ORDINANCE NO. 4738 - -65 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Donald St., Sampson St., Ewing Ave. and Twyckenham Drive) The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Hunter and Glass). ORDINANCE NO. 4739 - -65 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Calvert St., Sampson St., Donald St. and Twyckenham Drive) The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Hunter and Glass). ORDINANCE NO. 4740 - -65 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 (Twyckenham Drive, Calvert St., Leer St. and Ewing Ave.) The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Hunter and Glass). REPORT OF CITY PLANNING COMMISSION April 6, 1965 The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The attached petition of Jake and Rose Weingarten to rezone from "A" Residential Use and "A" Height and Area to "C -1" Commercial Use and "B" Height and Area District a rectangular parcel 125 feet North and South by 200 feet East and West lying 726 feet North of the intersection of McKinley Highway and Hickory Road, and abutting Hickory Road was legally advertised under date of Febr uary 12, 1965 and given public hearing on April 1, 1965. The following action was taken: After due consideration the Commission found that the proposed rezoning would be in the best interest of the IIII subject property. Councilman Geib made a motion that the ordinance be set for public hearing on May 10, 1965. Councilman Muszynski seconded the motion. Motion carried. Ellis, President of the Courtesy Cab Company, requesting that a copy of the proposed ordinance be forwarded to them. Councilman Geib made a motion that a copy of the proposed ordinance be forwarded to Mr. Ellis. Councilman Palmer seconded the motion. Motion carried. The ordinance was given first reading by title and second reading in full. Councilman Smith made a motion that the ordinance be set for public hearing on April 27, 1965. ORDINANCE, FIRST & SECOND READING AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS TO THE SANITATION DEPARTMENT ACCOUNTS XX263, XX71, XX722, AND XX73 IN THE TOTAL AMOUNT OF $34,500.00. The ordinance was given first reading by title and second reading in full. Councilman Geib made a motion that the ordinance be set for public hearing on April 27, 1965. Councilman Smith seconded the motion. Motion carried. NEW BUSINESS Councilman Smith made a motion that the Clerk see to it that the public address system is put in proper working order for the next meeting on April 27th. Councilman Allen seconded the motion. Motion carried. Councilman Geib informed the Council that he must be in Detroit on business and will not be able to attend the meeting on April 27th. REGULAR:x:MEETING � tta iyo� NEW BUSINESS Councilman Smith made a motion for the improvement of Ironwood Road between Ewing Ave. and Ireland Road. Councilman Palmer seconded the- motion. Motion carried. Councilman Geib asked the status of the Portage Ave. bridge replacement. City Edgineer Lloyd Taylor stated that the City was awaiting a response from the New York Central System on a proposal by the City to erect a concrete structure. There being no further business before the Council, Councilman Smith made a motion to adjourn. Councilman Geib seconded the motion. Motion carried and Council adjourned at 9:35 P.M.
